58. 2013 EDWARD BYRNE MEMORIAL JUSTICE ASSISTANCE GRANT (JAG) 1. Approve a Memorandum of Understanding (MOU) between Maricopa County and the Cities of Avondale, Chandler, Glendale, Goodyear, Mesa, Peoria, Phoenix, Scottsdale and Tempe, and the Town of Gilbert. On June 19, 2013, the Board of Supervisors approved applying for and accepting 2013 Edward Byrne Memorial Justice Assistance Grant (JAG) funding in the amount of $1,287,217. This MOU is required pursuant to the grant application requirements. The MOU includes a negotiated reallocation to Maricopa County of $235,315 and $1,051,902 in funds to be reallocated to the Cities of Avondale - $24,702; Chandler - $51,115; Glendale - $86,334; Goodyear - $7,948; Mesa - $127,177; Peoria - $19,566; Phoenix - $632,462; Scottsdale - $28,126; Tempe - $59,798; and the Town of Gilbert - $14,674. Grant awards are to be expended within a four (4) year period of time, starting October 1, 2012 and ending September 30, 2016. The JAG grant does allow up to 10 percent of the award for costs associated with administering JAG funds which includes indirect costs, and Maricopa County has been designated as the fiscal agent for this consortium of municipalities. 2. Approve the distribution of 2013 JAG funding among four County departments. Maricopa County will receive $235,315 through this grant. The Assistant County Manager’s Office will receive $64,360; Adult Probation will receive $56,985; the County Attorney’s Office will receive $56,985; and Juvenile Probation will receive $56,985. 3. Approve the waiver of administration costs above 5% of funding allocated to County Manager/Justice System Planning and Information. Administrative costs over 5% are being waived so that a majority of the grant funding can be sub-granted to partner agencies, per the Memorandum of Understanding. Recovery of Indirect costs for remaining county departments (Adult Probation, County Attorney, and Juvenile Probation) and subrecipients is not allowed. County Manager/Justice System Planning and Information FY14 indirect rate is 14.4%. Department will receive a total of $64,360 for administration, which includes $3,064.76 indirect cost recovery and $5,761.75 waived for administration. Adult Probation will receive a total of $56,985; at their FY14 indirect rate of 10.5%, their indirect costs are $5,983.43, all of which is unallowable. The County Attorney’s Office will receive a total of $56,985; at their FY14 indirect rate of 13.9%, their indirect costs are $7,920.92, all of which is unallowable. Juvenile Probation will receive a total of $56,985; at their FY14 indirect rate of 25.3%, their indirect costs are $14,417.21, all of which is unallowable. Total indirect costs are $37,148.07 of which $3,064.76 is recoverable and $34,083.31 is unallowable/waived. The Local Law Enforcement Block Grants (LLEBG) preceded JAG. LLEBG procedures included a provision to protect counties from major funding disparities that resulted from the block grant formula. The formula allocated funds to communities by rate of violent crime arrests (predominantly by municipal police agencies), failing to reflect the substantial responsibilities of counties for adjudicating these high level crimes (including incarceration, prosecution, defense, and court processing). If declared disparate, communities were required to concur in a reallocation of the award amounts or no distribution of LLEBG funds occurred. As a result of the request for consideration by Maricopa County, in FY 2004 the Arizona Attorney General certified that the cities of Phoenix, Mesa, and Glendale were scheduled to receive an award twice as much as the projected County award. As the County allocates more than 50% of the local incarceration or prosecution expenditures for Part I, violent crimes, the Attorney General declared that the local funding of LLEBG dollars was disparate. Because of this decision, the 2013 JAG grant again requires a collaboration of all named cities and towns with Maricopa County. The following is the result of the negotiation process whereby Maricopa County will be allocated $235,315 of the total award. Adult Probation will receive $56,985 for the Community Restitution Program. The County Attorney’s Office will receive $56,985 to prosecute violent crimes involving deadly weapons (guns). Juvenile Probation will receive $56,985 to fund JPO positions responsible for providing support to Juvenile Probation Department community safety efforts. (C-95-14-001-G-00)
