Abandonment Hearing Officer.

This request will NOT be completed until all the stipulations have been met and this request is formally
adopted by City Council. It is the APPLICANT’S RESPONSIBILITY to ensure that all stipulations are

completion of the stipulations.

Upon completion of the stipulations, Robert G. Martinez will schedule your request for City Council
action.

If the stipulations of abandonment are not completed within one year from the date of your conditional
approval (your expiration date is March 26, 2020), this request will then expire. At that time a new
submittal will be required along with the required payment for the abandonment process. A one time,

Hearing Summary

Mr. Christopher DePerro, the Hearing Office opened the discussion by turning it over to the applicant to
expand on the abandonment request.

Mr. Jared Gisher, the applicant, expanded on the abandonment request by stating during the permanent site
plan approval meeting for a proposed single story detached rental project, an 80 foot roadway easement
was identified, the 47 feet dates back to 1970, with a sequential 33 foot easement that supplements it,
dating back to the 1920's. Mr. Gisher also stated that during conversation with City staff it was identified 99"
Avenue right-of-way is a proposed 70 foot right-of-way, and with the existing 80 feet roadway declaration it is
on, dating back to 1970 when Maricopa County was in control.

Mr. DePerro reviewed the drafted stipulations with Mr. Gisher.
The Hearing Officer granted a conditional approval with revised stipulations.

Stipulations of Conditional Approval

The request of abandonment, is conditionally approved by the Abandonment Hearing Officer. The
following stipulations will need to be met:

1. Either a or b shall be complied with:

a. All utilities shall be relocated to locations approved by each affected utility company. All

work is to be done by each affected utility company at no expense to the affected utility
company. The existing sewer main must be relocated or abandoned in place as approved
by the Water Services Department. The extent of the portion to be relocated or abandoned
has not been determined at this time but may include portions of this main located outside of
the abandonment area, and other affected mains, as determined by WSD.

b. All right-of-way shall be retained as a public utilities easement with 24-hour vehicle
maintenance access.

2. The applicant shall dedicate right-of-way totaling 70 feet for the west half of 99th Avenue.

3. All stipulations must be completed within one year from the Abandonment Hearing Officer's
decision.
