Sarah Stockham, staff, provided background on the request. Ms. Stockham displayed an aerial map, reviewed the site history and previously approved stipulations and site plan, and displayed the requested changes to the stipulations, proposed site plan and elevations. Mr. Kurtz displayed the property owners and community members who were notified of the request, shared that they did not receive any feedback from those notified regarding the request, and that the notices were sent in English. Mr. Kurtz explained that the units were two-story apartments with private garages, the units have a lot of glazing oriented to a side yard, and that they are incorporating a brick material on the elevations which is like a material used on the adjacent properties. Mr. Kurtz displayed a site plan showing the unit layout, open space areas, driveway locations, and shared that units are compatible with the existing single-family residential to the south and east of the site and the site was designed to buffer the multifamily from the single-family residences. Mr. Kurtz reviewed the existing stipulations for the site and explained that the proposal to modify the stipulations are because the site is a smaller portion of a larger site and most of the stipulations no longer apply. Questions from the Committee: Vice Chair Nate Sonoskey asked if the storage facility to the west had to go through a stipulation modification process when they developed the site. Ms. Stockham replied that the west portion of the site received a special permit in 2015 shortly after the original case was approved in 2014 to allow the self-storage use, and the stipulations for the special permit apply for that new use. Vice Chair Sonoskey asked Mr. Kurtz why they are requesting to delete stipulations that they comply with, such as the square footage maximum and height maximum, and if it was staff’s direction to delete them to clean up the stipulations. Mr. Kurtz replied that during their evaluation of the site and the existing stipulations the input received was to try and clean up the stipulations since many of them are not relevant anymore. Ryan Boyd asked if they could build the proposed site plan without the Planning Hearing Officer’s decision on modifying the stipulations. Mr. Kurtz replied that no, during their pre-application meeting the development staff pointed out that the existing stipulations needed to be addressed, especially the general conformance date on Stipulation No. 1. Mr. Kurtz added that they are also abandoning old easements on the site and this stipulation modification request is also very costly, so they are happy that the developer is sticking with the project to clean up the site. Mr. Boyd asked why the units do not front either of the public streets. Mr. Kurtz replied that the units are designed with a lot of glazing that face a side yard which adds a lot of natural light into the units and privacy. Mr. Kurtz added that the units along 17th Street and Portland Street do have windows looking towards those streets, and that the units have little front porches on the upper level that look out over the green space. Vice Chair Nate Sonoskey asked if Mr. Kurtz received any feedback from the adjacent neighbors. Mr. Kurtz replied that no, they have not received any feedback but there is still an opportunity to comment at the Planning Hearing Officer meeting on November 17. Discussion: Chair Rachel Frazier Johnson asked staff to clarify if the request was to modify or delete Stipulation No. 4. Ms. Stockham replied that the request is to modify Stipulation No. 4, and delete Stipulation Nos. 4.a and 4.b, and apologized for the mistake on her presentation slide. Vote: 12-0, motion to approve passes with Committee Members Boyd, Burns, Gonzalez, Lockhart, Martinez, Olivas, Panetta, Rainey, Starks, Uss, Sonoskey and R. Johnson in favor. STAFF COMMENTS REGARDING VPC RECOMMENDATION: None.
