WRITTEN REQUEST
to modify stipulations imposed as conditions of a zoning change
PROJECT BACKGROUND AND DETAILED DESCRIPTION OF PROPOSAL
This project is proposing commercial multi-housing use with 17 free standing 2
story apartment units, each with private outdoor space and common amenity
space.
A Pre Application Review for this project occurred AUGUST 25, 2021. As a “next
step”, staff required two issues to be addressed prior to submitting for Preliminary
Site Plan Review,
1) PHO hearing modifications of existing stipulations and
2) Abandonment of existing sewer easement
A third issue to be addressed per the pre application meeting are Easement
Dedications regarding an existing concrete sidewalk and proposed fencing
(from one private outdoor space to another private outdoor space) that
penetrate the existing landscape setback at various locations.
This Written Request addresses the PHO Modification.
Zoning Ordinance Z-13-88 stipulations for this property are documented in a
letter (dated JANUARY 22, 2015) from the Phoenix Planning and Development
Department. In that letter 7 stipulations are listed as ratified by Phoenix City
Council. That letter was also provided by city staff as part of the pre application
meeting response for this project. A copy of that letter is included as part of this
written request.
Comments in a Hearing Officer Report (dated NOVEMBER 19, 2014) clarify:
•
Stipulations for this site originated in 1988, when the property was converted from
residential to commercial zoning to allow a four story office building.
•
There have been a number of actions to modify these stipulations.
•
The proposed stipulation changes in 2014 were for a townhome project with over
60 units on a parcel over 5 acres that stretched from 16th street to 17th street.
Stipulations formalized in 2015 refer directly to that project.
Since 2015, that project was not built. A self storage facility was built and is
currently in operation on a portion of that site. Some special use related
stipulations are applicable to that project, however those special use
stipulations are not applicable to this project.

Modify Z-13-88 stipulation 1.
That the development be in general conformance to the site plan date stamped
AUGUST 1, 2014 OCTOBER 2021 as may be modified by the Planning and
Development Department and by the following stipulations.
RATIONALE
This stipulation is intended to reference “general conformance “ to the current
site plan. ”.
This stipulation was modified in 2015 for general conformance to the site plan
proposed at the time (a considerably larger site and attached multi-family
units). This project includes a much smaller portion of that large parcel. Though
a multi-housing project, it is very different with multiple detached rental units.
Within city comments after the AUGUST 25, 2021 pre application meeting, this
stipulation is “…no longer applicable to the current site plan…
Delete Z-13-88 stipulation 1.a
a) The entire site shall be designed with a common architectural theme and
integrated with landscape pedestrian ways.
RATIONALE
What defines a “common architectural theme” is subject to varying opinions.
Whether a site is large or small, the propose character is important for a village.
This hearing and Design Review submittals require color elevations to be
submitted for review. Reviews like that already invite varying opinions about
materials and character appropriate within a specific village. Additionally,
existing regulations already guide design compliance for both landscape and
pedestrian circulation. This stipulation seems unnecessary.

stipulation is “…no longer applicable to the current site plan…

That development not exceed 150,000 square feet.
RATIONALE
This stipulation refers to a square footage of the development. This stipulation
does not clarify if it implies lot coverage, overall square footage within the
buildings, or some other square footage.
Existing net square footage and existing gross square footage of this property
are each less than 150,000 square feet.
Within city comments per our AUGUST 25, 2021 pre application meeting, this
stipulation is “no longer applicable to the current site plan”.
Delete Z-13-88 stipulation 3
That development be limited to three stories.
RATIONALE
This proposed project includes two story detached units compliant to current
zoning height restrictions. Current zoning does not allow three stories.
Within city comments per our August 25, 2021 pre application meeting, this
stipulation is “no longer applicable to the current site plan”.
Modify Z-13-88 stipulation 4
That sufficient right-of-way be dedicated at the time of the Planning and
Development Department site plan review. to provide.
RATIONALE
This modification allows right-of-way dedications to be addressed by the city
prior to site plan approvals. The two additional words create confusion.
AUGUST 24, 2021 per city traffic review confirmed that the existing locations of
street lighting within the right-of-ways meet City of Phoenix standards. In
response to the pre application meeting AUGUST 25, 2021, the Traffic Reviewer
addressed a variety of issues (including the need to dedicate an easement for a
portion of sidewalk in the right-of-way). This stipulation is not necessarily guiding
those reviews, but it does complement the existing preliminary design review
process.

Delete Z-13-88 stipulation 4.a
a) Additional right –of-way as may be required by the Planning and Development
Department along 16th Street for right turn lanes, bus bays, etc.
RATIONALE
This stipulation is about 16th Street. The proposed project does not have street
frontage on 16th Street.
Within city comments per our AUGUST 25, 2021 pre application meeting, this
stipulation is “no longer applicable to the current site plan”.
Delete Z-13-88 stipulation 4.b
b) Additional right-of-way as may be required by the Planning and Development
Department of abutting local streets.
RATIONALE
Though this stipulation specifically addresses “abutting” streets, Stipulation 4
already invites the city to address the issue of right-of-way prior to site plan
approvals. Thus, this stipulation seems unnecessary.
Within city comments per our AUGUST 25, 2021 pre application meeting, this
stipulation is “no longer applicable to the current site plan”.
Delete Z-13-88 stipulation 6
“The original stipulations of approval may be retained as an alternative
development concept for a period not to exceed 60 days following final City
Council approval upon notification from the property owner that the current
proposal is no longer valid.”
RATIONALE
This stipulation directly refers to a prior project as an “…alternative design
concept…”. There is no longer a larger site to consider for an alternate design.
Additionally, this stipulation is poorly written and invites a future of ongoing and
varying interpretations.
