RESOLUTION
ROAD DECLARED (ROAD FILE NO. 4426-R.2)

WHEREAS, pursuant to A.R.S. § 28-6701(A), the County is authorized to establish, alter, or abandon
a highway in the County; and
WHEREAS, A portion of Jomax Road and 155th Avenue were declared public highways which are
depicted and described in the plat recorded on May 8, 1990 in instrument 1990-0205665 in the office of the
Recorder Maricopa County; and
WHEREAS, pursuant to A.R.S. § 28-6701(B), the County Engineer has recommended that Road File
No. 4426-R be revised and that the Board resolve to adopt a resolution for Road File No. 4426-R.2 declaring
the highways alteration as described herein to be public highways; and
WHEREAS, the Department of Transportation desires to declare Road File No. 4426-R.2 and
WHEREAS, Jomax Road and 155th Avenue alignments are described as follows:

Two roadways having a varying widths, together with all appurtenant rights and lying within
Section 6, Township 4 North, Range 1 West and Sections 31 and 32, Township 5 North,
Range 1 West of the Gila and Salt River Meridian, Maricopa County, Arizona, whose
centerlines are described as follows:
BEGINNING at a point on section line 55 feet east of the Northwest corner of Section 6,
Township 4 North, Range 1 West, thence with a road width of 110 feet, run east along the
section line between said Sections 6 and 31 to the Southeast corner of said section 31;
Thence, with a road width of 55 feet west and 33 feet East, run north along the section line
between said sections 31 and 32 to a point 990.33 feet north of the East quarter corner of
said section 31.
Together With:

A road being consistent with the right of way, together with all appurtenant rights and lying within
Sections 6 and 5, Township 4 North, Range 1 West of the Gila and Salt River Meridian, Maricopa
County, Arizona, whose centerlines is described as follows:
BEGINNING at the Northeast corner of said Section 6 and run thence South along the section line
between said Sections 6 and 5 to the East quarter corner of said Section 6.
The beginning, ending, general course and direction of the highway is depicted in the
attached Exhibit, pursuant to A.R.S. § 28-6701(B).
The highways are known as Jomax Road from 163rd Avenue (south alignment) to 155th
Avenue and 155th Avenue from Jomax Road to 990.33 feet north of the East quarter corner
of said section 31, and 155th Avenue from Jomax Road to the East quarter corner of said
Section 6, lying in Supervisor District 4 and unincorporated Maricopa County; and
WHEREAS, the day and hour set by the Board for a public hearing on the County Engineer’s
recommendation has arrived, and notice of the hearing has been given to the public by advertising once a
week for two consecutive weeks in The Arizona Gazette pursuant to A.R.S. § 28-6702(A)(3); and

WHEREAS, no objections to declaration of such highway have been filed; and
WHEREAS, the Board finds that approving the County Engineer’s recommendation to declare
Road File No. 4426-R.2 is in the best interests of Maricopa County; and
WHEREAS, the Board has determined that the road alignment as described in this Resolution is
necessary to provide a public highway and is needed by the County; and
NOW, THEREFORE, BE IT RESOLVED that Road File No. 4426-R.2 hereby is declared as more fully
set forth above and in the attached exhibits, and that the County Engineer hereby is directed to make a plat
or map of the highway and cause the same to be recorded in the Office of the Recorder of Maricopa County
as provided by law; and
BE IT FURTHER RESOLVED by the Board that its Chairman execute this Resolution evidencing the
determination by the Board that the road alignment as described in this Resolution is necessary to provide
a public highway and is, therefore, needed by the County, and that acquisition of rights-of-way and
easements by donation, purchase, or condemnation hereby is authorized; and
BE IT FURTHER RESOLVED that the Board accept any right-of-way, easements or property
donated to the County or State for the highway and its construction, operation, and maintenance.
