Introduction
This firm represents TBBG Investments in its request to develop a small community of attached
townhomes on approximately 1.7 gross acres located at the southwest corner of the Western Canal and
Jesse Owens Parkway as shown on the Aerial Map attached at Tab 1 (the “Property”). The Property is
currently zoned C-2 as shown in the Zoning Map attached at Tab 2. Despite being rezoned to C-2 in 1987
for the expansion of an existing shopping center, the Property has remained vacant and undeveloped for
the last 36 years. In order for TBBG to properly develop the site, modifications to the stipulations in the
underlying zoning case (Z-206-86) are necessary.
Existing property conditions
As noted above, the Property is a 1.7-gross-acre parcel at the southwest corner of the Western Canal
and Jesse Owens Parkway in Phoenix, Arizona. The Property is vacant, unimproved land.

Zoning Case History
On February 3, 1987, the Phoenix City Council approved rezoning of the Property from R-4 and R-3A to
C-2 for the expansion of an existing commercial and retail shopping center known as “Southgate Center”.
See Rezoning Approval Letter at Tab 3. The conceptual development plan for the original project showed
the Property as “Offices”. See Z-206-86 Site Plan at Tab 4. The rezoning was ultimately approved subject
to twenty (20) stipulations, including general conformance to the submitted site plan. A Planning Hearing
Officer application was later approved in August 1989 for a six-month time extension of the conditional
zoning time stipulation and modification of stipulations related to landscape setbacks along Central
Avenue and the site plan for the proposed K-Mart on the east side of Jesse Owens Parkway. See 1989
PHO Approval Letter at Tab 5. The Property is the only remaining undeveloped land in the commercial
shopping center south of the Western Canal that was the subject of this zoning case.
Project Overview
The proposed project will utilize the approved C-2 zoning for the development of an intimate residential
community of sixteen (16) modern two-story townhomes utilizing the R-3 development standards
permitted in the C-2 zoning district. See Site Plan at Tab 6. The residences will be configured around a

U-shaped private drive with opposing duplexes on each side of the private drive, slightly offset from one
another to avoid a monotonous or uniform building layout.
The building layout is central to overall design of the site and remaining faithful to the Baseline Area
Overlay District’s (BAOD) prioritization of view corridors looking toward South Mountain. As illustrated by
the attached View Corridor Exhibit at Tab 7, the buildings are deliberately pushed to the eastern portion
of the site to maintain the view corridor looking south from Jesse Owens Parkway. The townhomes will
be entirely tucked behind the two-story element of the senior living facility on the north side of the Western
Canal. Additionally, the townhomes are broken up into duplexes to avoid long expanses of horizontal
building planes and allow visual permeability looking both north/south and east/west.
The community will be generously landscaped both internally and externally with a lush, drought-tolerant
landscape palette as illustrated by the Landscape Plan attached at Tab 8. Large, landscaped open space
areas are provided on the northern and southern ends of the community, with network of pedestrian paths
offering convenient access to neighboring properties and the Western Canal to the north. A total of 7,334
SF of open space is provided on the Property – more than twice the required open space in the R-3
development standards.
The proposed development is an ideal use for an infill site that has been overlooked for development
since it was originally zoned in the mid-1980s. This stipulation modification request aligns with several
General Plan goals and policies, including the encouragement of a mix of housing types in neighborhoods
where transit or transportation alternatives exist and promotion of development in compact cores, centers,
and corridors connected by roads and transit. With the adoption of the South Central TOD Plan and the
planned extension of the Valley Metro Light Rail, the Property is perfectly located and suited for new high-
quality multi-family development with convenient access to public transit.
Stipulation Deletion/Modification Request
2. That development be in general conformance to the site plan submitted, with the understanding
that rezoning is required to adjust district boundaries.
Rationale: This stipulation is somewhat redundant with Stipulation 19 and makes no reference to
a dated site plan. Moreover, the zoning boundary-related portion of the stipulation is no longer
relevant based on the available zoning records.
19. That the site be developed in general conformance to the site plan presented to the Planning
Hearing Officer on July 26, 1989, which is for the property east of the Jesse Owens Parkway and
is for a K-Mart development. The development shall be in general conformance with the site plan
date stamped June 1, 2022 as approved by the Planning and Development Department.
Rationale: This modification will allow TBBG to move forward with the development of a small,
contextually appropriate townhome community on a site that has remained vacant since it was
rezoned over 35 years ago. The proposed development will provide well-designed housing in an

area of Phoenix in need of new, high-quality housing inventory in close proximity to a future
planned Valley Metro Light Rail station at Central Avenue and Baseline Road.
Conclusion
Approval of the requested stipulation modifications will allow the applicant to construct a high-quality
multi-family townhome development on a site that has been vacant for over three and a half decades.
The proposed development is a direct response to the City’s recently adopted Housing Phoenix plan,
which aims to add 50,000 new housing units to the City of Phoenix by 2030. Coupled with the recent
adoption of the South Central TOD Plan, the area surrounding the Baseline Road and Central Avenue
light rail station is poised to become a re-invigorated hub of activity for South Mountain Community.
Convenient, attainable, and high-quality housing options are going to be critical to the success of the
South Mountain TOD Plan’s vision, and the proposed project is a small but important step toward that
goal.

The purpose of this memo is to discuss the current, base stipulations relevant to the
modification requests in Rezoning Case No. PHO-2-22—Z-206-86-8. After a review of
Rezoning Case No. PHO-1-89--Z-206-86-8, it was noted that there was no approval
letter issued that contained a complete list of stipulations resulting from the City Council
approval of this case.
PHO-1-89--Z-206-86-8 was heard by the Planning Hearing Officer (PHO) in two parts:
requests regarding Stipulations 5 and 19 were heard on July 26, 1989 (Attachment A);
requests regarding Stipulations 11 and 16 were heard on August 2, 1989 (Attachment
B). Both parts were heard by the City Council on August 30, 1989 (Attachment C). Two
separate approval letters were issued (Attachments D and E).
The complete stipulations of PHO-1-89--Z-206-86-8, which are the current, base
stipulations applicable to the subject property of PHO-2-22—Z-206-86-8, are those from
the original approval letter of Rezoning Case No. Z-206-86-8 (Attachment F) as
modified by the City Council actions reflected in the two approval letters issued for
PHO-1-89--Z-206-86-8.
Additionally, note that PHO-1-89--Z-206-86-8 was filed concurrently as PHO-1-89--Z-
207-86-8 and PHO-1-89--Z-208-86-8. The current stipulations described in this memo
are also relevant to the subject property of Rezoning Case No. Z-207-86-8 and a copy
of this memo is being placed in that case file. However, based on the PHO summaries,
City Council minutes, and approval letters, the PHO request was not ultimately heard or
approved for Rezoning Case No. Z-208-86-8 and is not relevant to that case.
Complete Stipulations of PHO-1-89--Z-206-86-8
• Written in legislative edit format, depicting the approved modifications of
Stipulations 5, 11, 16, and 19.
1.
That within 90 days of final City Council approval of this zoning change, a
rezoning application be filed to adjust zoning district boundaries to conform
to alignment of the loop road, and to include the existing C-2 zoned
property fronting Central Avenue.

That development be in general conformance to the site plan submitted,

with the understanding that rezoning is required to adjust district
boundaries.
3.
That the entire development proposal be subject to the Development
Coordination Office site plan review and approval in accordance with

districts within 24 months and the residential districts within 36 months of
City Council zoning approval in accordance with Section 108-M of the
Zoning Ordinance.
5.
That an average landscaped setback of 55 51 feet for any building and
parking area will be provided along Baseline Road and average
landscaped setback of 25 feet will be provided along Central Avenue
measured from the property lines LINE.
6.
That two rows of 24-inch box-sized citrus trees and/or date palms and
large areas of flowers will be planted along Baseline Road, 20 feet on
center or equivalent groupings as approved by the Development
Coordination Office.
7.
That there shall be mature landscaping along Central Avenue to include
24-inch box trees spaced a maximum of 25 feet on center or placed in
equivalent groupings.
8.
That all parking along Baseline Road and Central Avenue shall be
screened with landscaped berms, a three-foot wall, or combination thereof,
as approved by the Development Coordination Office.

That five percent or more of interior parking shall be landscaped with
reasonable distribution throughout the parking area and along the face of
the buildings.

That no drive-through facility on the site will have its drive-through land
facing any public right-of-way with the exception of the new road.

That a pedestrian and bike trail be provided and maintained along
Baseline Road and the loop roadway, the location, width, coloration, and

(recommendations) adopted by the South Mountain Village Planning
Committee (the “Committee”) for the Baseline Scenic Parkway, provided:
a.
Those guidelines are adopted by the time the applicant is ready to
install signage;
b.
The applicant has the opportunity to provide input to the Committee
concerning the appropriate dimensions and appearance of the
signage;
c.
The guidelines specifically address signage for commercial shopping
centers.
15.
That the intersection of Central Avenue with Jesse Owens Parkway is to
align with Fremont Drive (one quarter mile point) to the west of Central
Avenue or offset no more than a half street width to the south of that
alignment. (This is imperative in order to coordinate the traffic signals and
minimize delay for traffic on Central).
16.
That future signalization of Jesse Owens Parkway AND with Central
Avenue and Baseline Road will be at the expense of the developer. Traffic
signals will not be installed until the warrants are met. OR A NEED IS
SUPPORTED BY A TRAFFIC STUDY SUBMITTED AND REVIEWED BY
THE STREETS AND TRAFFIC DEPARTMENT.
17.
That right lanes will be required on Baseline Road at Jesse Owens
Parkway and on Central Avenue at Jesse Owens Parkway.
18.
That construction of an internal loop road and bridge over the Western
Canal be provided by the applicant/property owner with cooperation and
support by the City of Phoenix in the first phase of development.
19.
That the site be developed in general conformance to the site plans
submitted December 8, 1986, including the public amenities enumerated
on the site plans PLAN PRESENTED TO THE PLANNING HEARING
OFFICER ON JULY 26, 1989, WHICH IS FOR THE PROPERTY EAST
OF THE JESSE OWENS PARKWAY AND IS FOR A K-MART
DEVELOPMENT.
20.
That wall or fencing along the north side of the Western Canal shall be

This hearing is

that they were requesting to provide the pedestrian and bike
trail in a similar manner as the adjacent developments.
He noted that improvements were made to the site (sidewalks, etc.)
as part of
the Jesse
Owens Parkway/Baseline Road Improvement District.
He requested that
these improvements be retained when this stipulation is considered
and
there
be no requirement to
remove these improvements.
He stated that due to
increasing traffic and traffic concerns, K-Mart would request
that instead of
the
traffic
signals
not
being installed until the warrants are met that they
would be installed within two weeks of the developer receiving
the
certificate
of occupancy for the retail centers.
The Planning
Hearing
Officer stated that he contacted the Streets and Traffic
Department about the signalization modification.
They were not
in
favor
of
the modification
because of liability concerns but would consider installation
of the traffic signals based upon a traffic study
submitted by the applicant
supporting the need for signalization at these locations.
He
noted
that
the
existing
improvements
along
Baseline
(sidewalks and
landscaping) should be retained when the applicant is providing the
pedestrian
and bike
trail.
These
should be consistent with the trail improvements made
by the development to the east.
He questioned the applicant about his meetings with the various
committees in
this village and their support of the request.
