The Phoenix City Council at its meeting held May 21 2003 considered a
request for a Special Permit concerning 2 36 acres located approximately 660
feet south of the southeast corner of 51st Avenue and Baseline Road from Rural
43 (Pending S-1) to R-3 SP
The Council granted this application subject to Stipulations 1 through 22 with
modification to Stipulation 18 replacing the reference to 35 idwelling units with
3 6 dwelling units and adding an additional Stipulation 23 as follows
Stipulations
Commercial Development
1 That the commercial development shall be in general conformance to the
site plan date stamped May 14 2003 with regard to building and pad
locations and square footages with specific attention applied to the
number of pads and the overall site design (angled orientation to
intersection) as approved or modified by the Development Services
Department and the following stipulations
a That the anchor will be between 45 000 to 65 000 square feet
b That the overall building square footage for the commercial
development not exceed 110 000 square feet

That the proposed drive thru facilities shall orient drive-thru windows
away from Baseline Road and/or adjacent residential uses generally
as shown on the site plan Drive-thru queuing lanes shall be
screened from view of Baseline Road and/or residential uses
through the incorporation of a landscaped berm screen wall or
combination of a wall and berm, at least 4-feet in height
That 10% of the parking areas shall be landscaped excluding
perimeter landscaping
That the walkway islands from parking lots to the main buildings
shall be shaded and protected by curbs
That a walkway shall be provided from Baseline Road to the center
of the site generally as shown on the site plan The walkway area
including the walkway and adjacent shading shall be a minimum of
15-feet wide to make shoppers feel safe from cars and be designed
to emphasize a pedestrian priority by providing shade structures or
trees
That alternate paving materials shall be used where walkways cross
driveways
That the commercial development shall be in substantial conformance to
the conceptual elevations date stamped May 14 2003 as approved or
modified by the Development Services Department and the following
stipulations
a
That the pad buildings and gas stations shall be complementary to
the major building on site
That the arcades and/or overhangs shall be incorporated into the
building design along all pedestrian walkways with a minimum 10
foot continuous shade-provided walkway along the shops generally
as shown Patios trellises, and recesses may also be used to
provide shade and break up building mass
That gas/service station development shail be in general conformance with
the canopy elevations (1 sheet) date stamped May 14 2003 as approved
or modified by the Development Services Department and the following
stipulations
a
That the canopy height measured from finished grade to the lowest
point of canopy fascia shall not exceed 14-feet in height and the
overall canopy height shall not exceed 16 feet provided however
that the lowest point on the canopy fascia and the overall canopy
height can be increased by up to 1-foot and 2-feet respectively if
permitted by the Development Services Department or the City s
Design Guidelines in effect at the time a building permit 1s issued
for the canopy
That the fascia of the canopy shall be finished with similar or
compatible materials textures and colors as those of primary
buildings on site The fascia may bear no advertising or lighting
other than a corporate logo not to exceed ten percent of the
surface area of the fascia
c That the column treatment shall be finished with similar materials
and accents as those used on the kiosk as depicted on the
elevation Fintshed column treatment shall be used from the
ground to the canopy
d That the canopy lights shall be fully recessed The intensity of the
lighting under the canopy shall not exceed 20-foot candles as
measured at the finish ground plane
That the corporate colors and associated graphics shall be used only as an
accent feature as determined by the Development Services Department A
complete sign package will be submitted to the Laveen Village Planning
Committee for reference prior to or concurrent with Development Services
Department submittal
Street Transportation

That the following rights-of-way shall be dedicated as approved or
modified by the Development Services Department
a Right-of-way totaling 60 feet, as measured from construction
centerline as determined by the Street Transportation Department
and a ten-foot sidewalk easement shall be dedicated for the south
half of Baseline Road
b Right-of-way totaling 60-feet as measured from construction
centerline as determined by the Street Transportation Department
and a ten foot sidewalk easement shall be dedicated for the east
half of 51st Avenue
c A 21 foot by 21 foot right-of-way triangle shall be dedicated at the
southeast corner of 51st Avenue and Baseline Road
d That the developer shall construct all streets within and adjacent to
the development with paving curb gutter sidewalk curb ramps
streetlights median islands landscaping and other incidentals per
plans approved by the Development Services Department All
improvements shall comply with all ADA accessibility standards
e The applicant shall submit a Traffic Impact Statement with projected
traffic volumes generated by the site to the City for this development
f The applicant shall complete and submit the Developer Project
Information Form for the MAG Transportation Improvement Program
to the Street Transportation Department This form is a requirement
of the EPA to meet clean air quality requirements

The developer shall provide transit improvements as directed by the Public
Transit Department Public Transit shall approve the location of the stop
transit accessory pad design and construction All right-of-way dedications
and construction of the transit accessory pad shall be the responsibility of
the developer as follows
a Eastbound Baseline Road east of 51st Avenue Right-of way and
construction for bus bay (Detail P 1257) and transit pad (Detail P-
1261) subject to change to a transit pad only if necessary due to
major power pole conflict
b Northbound 51st Avenue north of South Mountain Parkway Right-
of-way and construction of transit pad (Detail P-1262)
c Northbound 51st Avenue north of Beverly Road Right of-way and
construction of transit pad (Detatl P-1262)
d Eastbound Baseline Road east of 48th Drive Right of way and
construction of transit pad (Detatl P-1262)
Trails/Landscaping

The developer shall provide a 10-foot wide multi-use trail along the east
side of 51st Avenue on both the residential and commercial areas as
approved by the Parks and Recreation Department Trail development
and any subsequent changes thereto shall be completed in concert with
the City s Trails Coordinator
That the commercial project will incorporate 3-dimensional public art of a
rural nature at the intersection of 51st Avenue and Baseline Road
That the center identification sign walls rail fencing and screening at the
immediate corner of 51st Avenue and Baseline Road shall be in
substantial conformance with the Laveen Ranch detail and signage board
date stamped May 14 2003 as approved or modified by the
Development Services Department Where split rail type fencing occurs
landscaping shall be provided along both sides of the fence The
enhanced iandscape feature at the intersection of 515‘ Avenue and
Baseline Road Is intended to emphasize Laveen s agricultural character
and heritage with regard to plant type (trees shrubs groundcover
annuals etc) selection placement (large tightly planted street trees) and

color and shall include four 3 caliper fantex ash trees turf (approximately
25’ x 25’) and other appropriate landscaping Appropriate selections
include
a Trees pecan Arizona ash evergreen elm heritage live oak
sycamore or other similar trees
b Shrubs myrtle (true dwarf or twisted), pomegranate or other
similar shrubs
c Accents deer grass wild sunflowers or other similar accents
d Vines white Lady Banks Rose flowering jasmine or other
flowering vines
That detached sidewalks with trees staggered along both sides will be
provided along Baseline Road and 51st Avenue as approved or modified
by the Development Services Department
That a minimum 50-foot landscape setback will be provided along
Baseline Road and that an average 50-foot landscape setback (with a 20
foot minimum) will be provided along 51st Avenue as approved or
modified by DSD
That a minimum 10-foot landscape setback will be provided north of the
commercial property line adjacent to Lots 188-204 If the commercial wall
typically required north of Lots 188-204 1s by variance eliminated or
modified to provide open views into the adjacent open space an
additional minimum 20-foot landscape setback will be provided south of
the commercial property line adjacent to Lots 188-204 This landscape
buffer shall include a double row of trees staggered twenty-feet on center

That the residential development shall be in general conformance to the
date stamped May 12 2003 revised conceptual subdivision plan (if the
commercial wall typically required north of Lots 188-204 1s by variance
eliminated or modified to provide open views into the adjacent open
space) as approved or modified by the Development Services
Department and shall use the Planned Residential Development (PRD)
option with specific attention applied to providing open space areas
shown on the applicable subdivision plan The screen wall adjacent to
Lots 188-204 shall be 8-feet in height The developer shall be
responsible for maintaining the side of the screen wall facing the
commercial development along Lots 188 204

a That recreational amenities including a 10-foot wide multi use trail
as approved by the City s Trail Coordinator and landscaping be
provided in the WAPA corridor and the Salt River Project area
subject to approval by Salt River Project and/or Western Area
Power Administration as applicable
b That an alternate paving surface be provided as approved by the
City s Trail Coordinator where the above multi-use trail crosses
the only east/west street towards the north side of the WAPA
corridor
That view fencing consisting of wrought iron panels between columns or
pillars (such as brick stone, split-faced CMU or stucco CMU) shall be
required on all lots that back onto open space except along major
arterials and other high traffic areas and except along the C 2 and R-3SP
parcels as approved or modified by Development Services Department
Where more than one side of a lot borders open space solid wall may be
used along a maximum of 60% of the aggregate length of the sides
bordering open space

Architectural details and materials or other exterior detailing such as
pop-outs stucco recesses accent materials corbels or wrap around
architectural detailing shall be used on all elevations visible from a public
street (including corner lots and homes that back square or at less thana
45 degree angle to 51st Avenue or Baseline Road) as approved or
modified by the Development Services Department
That the maximum residential density shall not exceed 36 dwelling units
per acre (based on gross acreage measured to the centerline of
Baseline Road 51st Avenue and South Mountain Parkway) the
maximum number of lots shall not exceed 296 the minimum standard lot
width shall be 50 feet the minimum Villa lot width shall be 45 feet and the
average Villa lot width shall be 50 feet These minimum lot widths are for
typical lots necessary reductions tn lot width at the street may occur to
accommodate right-of way required for cul-de-sacs knuckles and other
similar features as approved or modified by the Development Services
Department
Provide a range of durable building materials for the housing product and
offer, as options accent materials such as decorative brick decorative
concrete block stone accents or other treatments
That detached sidewalks shall be provided along both sides of the street
behind lots 33 39 along the east side of Lots 1 24 25 and 39 and along
the west side of Lots 40 55 56 and 123
That the Laveen Ranch residential portion of the development will be
subject to the Laveen Residential Design Guidelines for the Preservation

City Council prior to the preliminary stte plan review of the residential
