VPC DISCUSSION & RECOMMENDED STIPULATIONS: 
Sarah Stockham, staff, displayed an aerial map and reviewed the surrounding zoning, 
land uses and the site history. Ms. Stockham reviewed the request to modify existing 
stipulations of entitlement and the proposal for multifamily residential uses on the site. 
 
Adam Baugh, applicant and representative with Withey Morris, PLC, reviewed the 
surrounding land uses, the site’s zoning history and the proposal for apartment units 
and townhomes on the site. Mr. Baugh explained that the townhomes will front onto 
Encanto Bouvard with patio entrances and provides for different housing options for 
families who might outgrow an apartment but want to remain in the area. Mr. Baugh 
concluded that this proposal is less dense that the currently approved site plan, will 
provide a better produce design and more housing variety, and is consistent with the 
Maryvale Core Plan.  
 
Jeff O’Toole asked why the applicant cannot build the proposed development under 
the existing entitlements and if they are still providing the amenities listed under the 
current first stipulation. Mr. Baugh replied that the proposed site plan is not in general 
conformance to the site plan from 2008, and they are still providing amenities such as a 
pool on site.  
 
Saundra Cole asked who will maintain the landscaping and trees on site and how long 
will it be maintained. Mr. Baugh replied that the townhomes are for rent, not for sale, so 
the site will be managed by a property management company in perpetuity.

Mike Weber asked if this request is to modify the stipulations, and shared concern that 
the site will not provide a mix of uses as the Core Plan calls for a mix of residential and 
commercial at this intersection. Chair Gene Derie asked staff to clarify the request and 
if multifamily could still be developed on the site given the existing entitlement. Sarah 
Stockham, staff, replied that the site has C-2 HGT/WVR DNS/WVR zoning and 
multifamily residential is permitted under the existing zoning.  
 
Jeff O’Toole shared that he likes the proposed development and that it is less dense 
than the development on the original site plan.   
 
 
MOTION: 
Chair Gene Derie motioned to recommend approval with three additional stipulations 
as follows: 
1. The developer shall dedicate a minimum 50 feet of right-of-way and a minimum 
18-foot wide public sidewalk easement along the west side of 79th Avenue, as 
approved the Planning and Development Department. 
2. The developer shall dedicate a minimum 50 feet of right-of-way and a minimum 
2-foot wide public sidewalk easement along the north side of Encanto Boulevard 
consistent with the Maryvale Village Core Plan, as approved by the Planning and 
Development Department. 
3. The developer shall construct a minimum 2-foot-wide landscape strip from the 
existing face of curb with an adjacent, at-grade, concrete, minimum 6-foot wide 
active transportation path, and an adjacent minimum 6-fot wide landscape strip 
behind the active transportation path, along the north side of Encanto Boulevard, 
consistent with the Maryvale Village Core Plan, as approved by the Street 
Transportation Department.  
 
Jeff O’Toole seconded the motion.  
 
DISCUSSION: 
Chair Gene Derie explained that the subject site is in the heart of the Maryvale Village 
Core and the Core Plan shows cross sections for 79th Avenue and Encanto Boulevard 
with enhanced pedestrian and bicycle amenities. Chair Derie continued that the site at 
the northeast corner of 79th Avenue and Encanto Boulevard (rezoning case no. Z-40-
20) was subject to stipulations to ensure the development of the streets per the Core 
Plan, therefore he proposed the same stipulations for this case to continue the 
improvements along those streets.  
 
VOTE: 
9-0, motion to approve with additional stipulations passed with committee members 
Barba, Battle, Cole, Demarest, DuBose, O’Toole, Valenzuela, Weber, and Derie in 
favor.
