To Whom It May Concern:
Our firm represents Taylor Morrison Homes (“Taylor Morrison”), which is seeking to develop +/-
14.73 acres of real property zoned C-2 located at the southwest corner of 67th Avenue and
Broadway Road into a residential community with a combination of duplexes and single-family
detached units. The project consists of three parcels 104-67-001A, 104-67-002C and 104-67-003
(the “Site”). The proposed changes to the site plan for solely residential units versus commercial
buildings will provide a more fluid and appealing environment for the local area as illustrated in
Exhibit A attached hereto (“Proposed Site Plan”). The Site will provide 162 units with a mix of
one and two bedroom concepts to meet a growing market of residents seeking an economic
alternative to traditional housing in Arizona. This request seeks to modify stipulations of previous
site plans to provide for a renewed vision in Phoenix.

Background
The Site and the Meritage Property (collectively the “Property”) were divided into commercial and
residential areas utilizing C-2 zoning for the Site and R1-6 PRD for the Meritage Property. The
Property was originally approved for a site plan by the Phoenix City Council on October 24th, 2012
pursuant to Ordinance G-5796 (“2012 Site Plan”) and amended on October 17th, 2018 pursuant to
G-6516 (“2018 Site Plan”) with respect to rezoning application Z-45-12-7. Although the 2012 and
2018 Site Plans were granted with stipulations, development of the Property was not undertaken
and remains an active dairy farm. Taylor Morrison is bringing this Property back on the map in a
revitalized effort to create an aesthetic neighborhood and residential complex in place of the mixed
commercial and residential use 2012 and 2018 Site Plans.
Approval of the 2012 and 2018 Site Plan was subject to 17 stipulations. Stipulation 1 of that
approval requires that the development be in general conformance with the site plan stamped on
October 24th, 2012 for the commercial portion (on the Site) and September 13, 2018 for the
residential portion (on the Meritage Property), as approved by the Planning and Development
Department. Taylor Morrison generated the Proposed Site Plan based upon the evolving economy
of Phoenix in addition to the current locale; however, the Proposed Site Plan requires that the
previous stipulations be modified.

Request
This request seeks to create a new site plan in lieu of the fissured commercial and residential
portions of the 2012 and 2018 Site Plans. This request also seeks to modify other stipulations with
the Proposed Site Plan in mind. This PHO request only applies to 6 of the 17 stipulations. All other
stipulations will remain in full force and effect. A copy of the stipulations with the proposed
modifications is also attached hereto as Exhibit B.
Specifically, this request seeks to:
1. Modify Stipulation 1 which requires general conformance with the 2012 Site Plan.
2. Modify Stipulation 2 which requires a minimum of 16% open space.
3. Modify Stipulation 3 which states the maximum number of lots shall not exceed 140.
4. Delete Stipulation 5 which contemplates commercial development only.
5. Modify Stipulation 14 which confirms the construction requirements that all streets within
and adjacent to the site must adhere to.
6. Modify Stipulation 16 which requires that a bus stop pad be constructed west of 67th
Avenue on Broadway road.
Request to Modify Stipulation 1
Current language:
The development shall be in general conformance with the site plan date stamped October 24,
2012 FOR THE COMMERCIAL PORTION AND SEPTEMBER 13, 2018 FOR THE
RESIDENTIAL PORTION, as approved by the Planning and Development Department.
Proposed Language:

Rational:
This stipulation is being modified to permit the Proposed Site Plan. The Proposed Site Plan
contributes 162 new units through a combination of single family residential units and duplexes in
place of the previous 2012 Site Plan which called for a commercial development. The Proposed
Site Plan serves a more functional purpose in light of the rapid growth within the Phoenix
metropolitan area.
Request to Modify Stipulation 2
Current Language:
A minimum of 16% open space shall be provided, as approved by the Planning and Development
Department.
Proposed Language:

A minimum of 16% 15% open space shall be provided, including attached rear yards, landscaping
pathways, general open space and any area 10 feet in width or greater excluding private roadways,
as approved by the Planning and Development Department.
Rational:
This is a minute decrease in the required open space. The Proposed Site Plan provides every unit
with a rear yard and dictates that a pool and accompanying pool deck be included. Additionally,
the Proposed Site Plan also includes a small dog park adjacent to units 68 and 69. Although 162
units are proposed, the design is such that they are not narrowed to a particular area. The Proposed
Site Plan spreads the units throughout the almost 15 acres of the Site. Only 57 of the 162 units are
attached, and the remaining 105 units are detached with ample space in between each unit so that
congestion is not a concern. The flowing composition of the Proposed Site Plan in addition to the
planned pool and park maintains the open space within a graceful design.
Request to Modify Stipulation 3
Current Language:
The maximum number of lots shall not exceed 140, as approved by the Planning and Development
Department.
Proposed Language:
The maximum number of lots shall not exceed 140 310, as approved by the Planning and
Development Department.
Rational:
On its face the increase in proposed lots is roughly 120%, however, the conversion of the 2012
Site Plan from commercial to residential units is the culprit. The Proposed Site Plan employs the
entirety of the +/-14.73 acres of 2012 Site Plan for residential use. The stipulations take into
account the adjacent parcel 104-67-002B (“Meritage Property”) contemplated the 2018 Site Plan
which allows the 140 units as stated in the current language of Stipulation 3.
The Proposed Site Plan offers 162 units in addition to the 140 units exhibited in the 2018 Site Plan
on the Meritage Property. This obviously only amounts to 302 units, not 310. The reasoning behind
Taylor Morrison requesting 310 units is to give them leeway if a few additional units are required
in place of the Proposed Site Plan or the 2018 Site Plan. Despite the fact that Taylor Morrison is
intent on developing the property in accordance with the Proposed Site Plan, permitting a few
additional units prevents the need for a stipulation modification in the future should unforeseen
events cause the plans to be altered. An additional 8 units to the proposed 310 is a relatively meager
increase of 2.6% over an approximate 46 acres.
Request to Delete Stipulation 5
Current Language:
For commercial development only – A sidewalk/pedestrian path constructed of decorative pavers,
stamped or colored concrete, or another material, other than those used to pave the parking surfaces
and drive aisles, shall be provided to allow pedestrian connections between shops A, B, and C to

pads A, B, C and D, as approved by the Planning and Development Department and street
transportation department.
Rational:
In sum, this language is extraneous to the Proposed Site Plan. Stipulation 5 was relevant to the
development of the commercial 2012 Site Plan. The language of Stipulation 5 dealt specifically
with the pathway for pedestrians between the proposed shops in the 2012 Site Plan. Here, the
Proposed Site Plan does not provide for, or even contemplate, the development of commercial
structures. Stipulation 5 would only serve to cause confusion and is superfluous as it relates to the
Proposed Site Plan.
Request to Modify Stipulation 14
Current Language:
The developer shall construct all streets within and adjacent to the development with paving, curb,
gutter, sidewalk, curb ramps, streetlights, median islands, landscaping and other incidentals as
approved by the Planning and Development Department. All improvements shall comply with all
ADA accessibility standards.
Proposed Language:
The developer shall construct all streets within and adjacent to the development with paving, curb,

applicable as approved by the Planning and Development Department. All improvements shall

Rational:
The Property is comprised of R1-6 PRD and C-2 areas. The Proposed Site Plan is located within
the area zoned C-2. This modification is more intended for clarification purposes as Taylor
Morrison is under the assumption that the C-2 area is not subject to the development standards set
forth within Stipulation 14 because the access throughout the Proposed Site Plan is not for public
use.
Here, the proposed roadways are for private use only and are not intended to be public streets. As
such, the private roadways do not meet the standards set forth in Stipulation 14 – except for the
ADA accessibility standards. Requiring the area zoned C-2 to be subject to Stipulation 14 would
ultimately be wasteful as the project’s roadways are not going to be utilized by the public at large,
but are simply there to assist and permit access throughout the Site for its residents.
Request to Modify Stipulation 16
Current Language:
The right of way shall be dedicated and a bus stop pad constructed on eastbound Broadway Road
West of 67th Avenue. . . .
Proposed Language:

The right of way shall be dedicated and a bus stop pad constructed on eastbound Broadway Road
West East of 67th Avenue. . . .
Rational:
Stipulation 16 calls for the local bus stop to be developed on eastbound Broadway Road
immediately prior to the intersection with 67th Avenue. Bus stop pads are preferably constructed
after an intersection for purposes of traffic safety and congestion. The National Association of City
Transportation Officials concurs on the matter. Specifically stating that “far-side pull-out stops use
intersection space efficiently, with little impact on general traffic if they are wide enough for a bus
to pull completely out of traffic. Among pull-out configurations, far-side stops are preferred.” See

Conclusion
The Property has remained untouched as it relates to the 2012 and 2018 Site Plans, and Taylor
Morrison is prepared to proceed with development of the Proposed Site Plan. Revising the
stipulations in the proposed form allows for improvement in the area and also provides more
efficient use of local transit. The previous site plans maintained a mix of commercial and residential
uses, however, Taylor Morrison’s new Site provides a small variety of mixed one bedroom and two
bedroom single family units to enhance the residential options for the local neighborhood.

Discussion
A motion was made and seconded to approve Items 38-87, except Items 39,
42, 46-47, 52, 58-61, 64, 66, and 86; noting Item 41 has been withdrawn; and
Item 54 is as corrected.
Councilman DiCiccio interjected his preference to hear Item 41 in order to vote
yes or no instead of withdrawing it.
Vice Mayor Waring expressed his displeasure that Item 41 was being pulled off
as he expected to vote on it today. He said he did not think it was a productive
use of taxpayer money. He stated he would get three Council members to sign a
letter to place it on the November 7 agenda for a vote. He asked what the
deadline was for membership and how the league got paid in the interim.
City Manager Ed Zuercher replied this item authorized staff to write a check to
the league, noting in some years the City did not pay the league until the
following year so there was no hard deadline.
Vice Mayor Waring asserted the City should have its own lobbyist team or be a
member of the league to save taxpayers some money.
Councilman DiCiccio remarked this item was always controversial and reiterated
his preference to vote it up or down today. He said he realized it would be

controversial if the City left the league; however, it showed a level of
dissatisfaction from multiple people.
Vice Mayor Waring recalled this item failed in 2012 but there were only eight
people on the Council now so it was a different dynamic. He also noted the
league conducted a poll about consolidated elections and did not share that
information with Council.
Note: Councilman Nowakowski joined the voting body at the dais.

City Controller to disburse funds up to amounts indicated for the purpose of
paying vendors, contractors, claimants and others, and providing additional
payment authority under certain existing city contracts. This section also
requested continuing payment authority, up to amounts indicated below, for the
following contracts, contract extensions and/or bids awarded. As indicated

Call to order, introduction of committee members, and announcements by the chair.
The meeting was called to order at 6:25 PM with a quorum of 7 members present.

the August 21, 2018, minutes.

Z-45-12-7 (PHO-1-18): Presentation, discussion, and possible recommendation on
a request to modify stipulations of entitlement for the property approximately 825
feet west of the southwest corner of 67th Avenue and Broadway Road. Request to
modify Stipulation Nos. 1, 2, 4, 5, and 6. Request to delete Stipulation No. 8.
Ms. Elyse DiMartino noted to that the Committee had heard an informational
presentation regarding this PHO case at the August 21, 2018, VPC hearing. She
provided an overview of the modification requests including presentation of aerial
photographs, zoning maps, previously approved site plan, and current proposed
site plan. She discussed the rezoning case that applied the subject property. She
explained the applicant’s request and discussed the proposed stipulation
language.
Ms. Jackie Guthrie, representative with EPS Group, reiterated that they were
before the Committee at the August VPC meeting. She provided some brief
background and explained that the applicant had taken many of the Committee’s
concerns into consideration. She explained there were modifications made to the
original PHO request language and explained the requests as follows:

Stipulation 1: Modifying to be in general conformance with the site plan
presented at the September 11, 2018, VPC meeting.
Stipulation 2: No longer needs to be modified, 16% open space will be provided.
Stipulation 3: Modifying to reduce the requested maximum number of units to
140.
Stipulation 4: No longer a deletion, now a modification to require the alternative
surfaces only at crossings at the project entries or as shown on the site plan.
Stipulation 5: Modifying to state the stipulation is only for commercial
development.
Stipulation 6: No longer being modified.
Stipulation 8: Modifying with lot numbers that apply to the new site plan.
Ms. Lisa Perez commented that she appreciated the changes that were made to
address the Committee’s concerns with relation to density, open space, and
alternative surfaces.
The Committee discussed making a motion to approve the case. Ms. DiMartino
explained that the applicant was presenting stipulation requests that were different
from their advertised requests. She further explained that if the Committee wanted
to approve the case as presented by the applicant, they would need to make a
motion to approve with modifications as presented by the applicant.
MOTION:
Mr. Mark Cardenas made a motion to approve PHO-1-18—Z-45-12-7 with the
modifications presented by the applicant. Mr. Dafra Sanou seconded the motion.
Stipulations:
1. That development be in general conformance to the site plan submitted and
dated May 18, 1988 DATE STAMPED AUGUST 3, 2018, and as may be
modified by the following stipualations. AS APPROVED BY THE PLANNING
AND DEVELOPMENT DEPARTMENT.
2. That development not exceed a .3 FAR.
3. That 25-foot landscaped setbacks be provided for street frontages along Lower
Buckeye Road and 39th Avenue at the time of phased development. Such
landscaping is to include 2-1/2 inch caliper trees planted 20 feet on center or in
equivalent groupings. The landscaping shall be maintained with an appropriate
watering system.
5. That six-foot masonry walls be placed along the perimeter property lines
exclusive of frontages along Lower Buckeye Road and 39th Avenue at the time of
Phase 1 development. A five (5) foot landscape strip is to be placed along the
face of the perimeter walls.
6. That outdoor storage be limited to the yard area as specified on the submitted
site plan dated May 18, 1988. The yard area shall be screened with a six-foot

masonry wall and storage of items within the yard area shall not exceed six feet
in height.
7. That future development plans shall be subject to review by the Planning Hearing
Officer to determine the level of compliance with the stipulations listed above.

7-0, motion passed, with Committee Members Perez, Rush, Sanou, Cardenas,
Robles, Ademolu, Barquin in favor.

Z-120-88-7 (PHO-1-18): Presentation, discussion, and possible recommendation
on a request to modify stipulations of entitlement for the property approximately
565 feet west of the southwest corner of 39th Avenue and Lower Buckeye Road.
Request to delete Stipulation Nos. 1, 2, 3, 5, 6 and 7.
Ms. Elyse DiMartino provided an overview of the modification requests including
presentation of aerial photographs, zoning maps, previously approved site plan,
and current proposed site plan. She discussed the rezoning case that applied the
subject property. She explained the applicant’s request and discussed the
proposed stipulation language.
Mr. Adam Baugh, representative with Withey Morris, provided an overview of
the surrounding zoning, general plan some brief background regarding approved
site plan and proposed site plan. He explained that the proposed site plan
encompasses an area larger than the area of the rezoning case. He described the
site plan in further detail, explained there would be a 564,000 square foot
distribution center on site with improved landscaping and streetscape, dual access
points, enhanced elevations, and an increased building setback from Lower
Buckeye Road. Mr. Baugh detailed the requests to delete Stipulation Nos. 1-3 and
5-7. He explained that many of the stipulations are contradicting the current zoning
standards; therefore, removal of those stipulations will allow the applicant to
comply with current codes.
Ms. Lisa Perez expressed concern with removal of Stipulation No. 1 regarding
general conformance to the May 18, 1988, site plan. She explained she would
prefer to have the stipulation remain. Mr. Baugh stated the applicant would be
okay with keeping Stipulation No. 1 and modifying it to be in general conformance
with the site plan date stamped August 3, 2018.
MOTION:
Mr. Mark Cardenas made a motion to approve PHO-1-18—Z-120-88-7 as
requested with modifications to Stipulation No. 1. Mr. Dafra Sanou seconded the
motion.
