This request will NOT be completed until all the stipulations have been met and this request is formally adopted by City Council. It is the APPLICANT’S RESPONSIBILITY to ensure that all stipulations are satisfied. Please contact Robert G. Martinez at (602) 495-0806 for questions and notification of your completion of the stipulations. Upon completion of the stipulations Robert G. Martinez will schedule your request for City Council formal approval. You will receive a copy of the abandonment document after it has been recorded with Maricopa County. If the stipulations of abandonment are not completed within one year from the date of your conditional approval (your expiration date is September 9, 2021), this request will then expire. At that time a new submittal will be required along with the required payment for the abandonment process. ATTACHMENT B 2 Planning and Development Department September 9, 2020 Abandonment Staff Report: ABND 200532 Project# 19-822 Location: SWC of Baseline Road and 43rd Avenue Applicant: Keith Green; Next Idea Architects Request to abandon: To abandon entirety of multi-use trail easement and vehicular non-access easement, adjacent to parcels addressed 4343 West Baseline Road and 7900 South 43rd Avenue. Purpose of request: Since 43rd Avenue was realigned; the existing multi-use trail easement does not go anywhere and is a dead end at the applicant southeast corner of property. Vehicular non-access easement will be abandoned because during B.O.A.; were requested to connect our property across parcel to 43rd Avenue and to do this we need to abandon this easement. 3 City Staff Comments and Recommendations PDD Civil Reviewer: “Keep portion of MUTE to extend to east property edge so it lines up with the 30’ MUTE along south side of Baseline Road to satisfy Prelim report stipulation.” PDD Planner: No comments received. WSD Water & Sewer Reviewer: “WSD has one stipulation for this abandonment. The applicant/property owners shall abandon all affected water utilities within the abandon requested area prior to the Resolution of Abandonment in accordance with plans submitted to and approved by the Planning and Development. The existing 12-inch water main be abandoned from water valve #203 within 43rd Ave. all the way through the easement to the 12-inch water main in Baseline Rd. at the tee.” Planning & Zoning: No comments received. Solid Waste: “Recommend approval.” Public Transit: “Public Transit Department does not have comment.” 4 Stipulations of Conditional Approval The request of abandonment ABND 200532 is conditionally approved and the following stipulations will need to be met: 1. Retain the northernmost 30’ of the MUTE which abuts Baseline Road. The above stipulations must be completed within one year from the conditional approval decision dated September 9, 2020.
