WHEREAS, A.R.S. §28-6701(A), authorizes the Board of Supervisors to establish, alter or
abandon a highway in the county; and
WHEREAS, on the 16th day of October 2002, the Board adopted a Resolution, designated
Road File No. A233, declaring said road a county highway in Recorders No. 2002-1095010,
Maricopa County Recorders; and
WHEREAS, on the 8th day of October 2003, the Board adopted a Resolution, designated
Road File No. A233-R, altering said county highway in Recorders No. 2003-1467857, Maricopa
County Recorders by excepting out any portion lying within the Southeast quarter of the
Northeast quarter of the Southwest quarter of the Southwest quarter (SE1/4 NE1/4 SW1/4
SE1/4) of Section Thirty-two (32), Township Two (2) North, Range Seven (7) East, as described in
two (2) parcels in Recorders No. 1990-105249, Maricopa County Recorders; and
WHEREAS, A.R.S. §28-6701(B), the County Engineer has determined that a portion of the
road as designated in Road File No. A233-R is not needed for a public road and prays for the
board to remove that portion no longer needed by adopting Road File No. A233-R.2.
Legal description
A 30-foot roadway having a width consistent with the right of way, together with all
appurtenances and easements of record, lying within Section Thirty-two (32), Township Two (2)
North, Range Seven (7) East, of the G&SRB&M, Maricopa County, Arizona. Said roadway is
described as follows:
The West 30 feet of the North half of the Southeast quarter of the Southeast quarter (N1/2
SE1/4 SE 1/4) of said Section Thirty-two (32).
Said roadway is known as 82nd Street from Southwest corner of the N1/2 SE1/4 SE 1/4 to Palm
Lane, lying in Supervisor District No. 2
A map depicting ROAD FILE NO. A233-R.2 is attached; and
NOW, THEREFORE, BE IT RESOLVED, that the Board believes that altering the described
portion of 82nd Street, as prayed for, is in the best interests of Maricopa County; and
BE IT FURTHER RESOLVED that the described portion of 82nd Street is hereby altered as
more fully set forth hereinabove.
