Special Emergency Meeting Minutes Wednesday, August 31, 2022 10:45 AM BOARD OF SUPERVISORS Maricopa County, Arizona (and the Boards of Directors of the Flood Control District, Library District, Stadium District, Improvement Districts and/or Board of Deposit) "The mission of Maricopa County is to provide regional leadership and fiscally responsible, necessary public services to its residents so they can enjoy living in healthy and safe communities” Board Members Bill Gates, Chairman, District 3 Clint Hickman, Vice Chairman, District 4 Jack Sellers, District 1 Thomas Galvin, District 2 Steve Gallardo, District 5 County Manager Joy Rich Clerk of the Board Juanita Garza Meeting Location Supervisors' Conference Room 301 W Jefferson, 10th Floor Phoenix, AZ 85003 BOARD OF SUPERVISORS The Board of Supervisors of Maricopa County, Phoenix, Arizona, convened in Special Emergency Session at 8:45 AM on Wednesday August 31, 2021, in the Supervisors’ Conference Room 301 W Jefferson, 10th Floor Phoenix, AZ 85003, with the following members present: Bill Gates, Chairman, District 3; Clint Hickman, Vice Chairman, District 4 (remote); Jack Sellers, Supervisor, District 1; Tom Galvin, Supervisor, District 2 (recused); Steve Gallardo, Supervisor, District 5(remote). Also present Juanita Garza, Clerk of the Board; Lori Medaris, Minutes Coordinator (remote); Joy Rich, County Manager; Andrea Cummings, Legal Counsel. 1. EXECUTIVE SESSION Vote to convene in Executive Session to consider the items on the Executive Agenda dated Wednesday, August 31, 2022, for Board of Supervisors and relevant Special Districts pursuant to the statutory authority listed for each item. Chairman Gates called the meeting to order stating that this was the emergency session for the Maricopa County Board of Supervisors to consider Legal Advice and possible action regarding: ELECTIONS; BOARD AUTHORITY AND RESPONSIBILITY; GOLEC V. GALVIN, CV-2022-011268 . Andrea Cummings, Legal Counsel, stated that the emergency was due to the need to get legal advice regarding an election lawsuit filed which requests to change the ballots and to decertify the 2022 primary election. The County was not named in this suit, Gail Golec v. Thomas Galvin, CV2022-011268. The County is an essential party and must join the suit within five days to defend the County Elections. Supervisor Sellers made the motion for the Board to convene in Executive Session. The motion was seconded by Vice-Chairman Hickman. Motion carried unanimously: Ayes: Gates, Hickman, Sellers, and Gallardo. At this point, the Board recessed into executive session to receive advice from their attorneys regarding this matter. After being briefed in Executive Session, Chairman Gates adjourned Executive Session and reconvened the Board into Open Session. Special Emergency Meeting Minutes Wednesday, August 31, 2022 Page 2 of 2 OPEN SESSION RECONVENED The Chairman reconvened Open Session in the Board of Supervisors’ Conference Room to consider the following agenda item. Supervisor Sellers made a motion to authorize the Maricopa County Attorney to intervene in the lawsuit on behalf of Maricopa County, in the matter of Gail Golec v. Thomas Galvin, CV-2022-011268, seconded by Vice-Chairman Hickman. Ayes: Gates, Hickman, Sellers, and Gallardo.
