ROLL CALL - LISTA The Board of Supervisors of Maricopa County, Phoenix, Arizona, convened in Formal Session at 9:30 AM on Wednesday, March 29, 2023, in the Supervisors' Auditorium, 205 W. Jefferson Phoenix, AZ 85003, with the following members present: Clint Hickman, Chairman, District 4; Jack Sellers, Vice Chairman, District 1; Thomas Galvin, Supervisor, District 2; Bill Gates, Supervisor, District 3; Steve Gallardo, Supervisor, District 5. Also present: Juanita Garza, Clerk; Joy Rich, County Manager; Andrea Cummings, Legal Counsel; Kelly Gardiner, Minutes Coordinator. 2. INVOCATION - INVOCACIÓN Supervisor Galvin introduced his guests, Darcy Norberg, Michael Norberg, and Ryan Smith of the Hawes Trail Alliance. Michael Norberg offered the invocation. 3. PLEDGE OF ALLEGIANCE - JURO FIDELIDAD A LA BANDERA Ryan Smith led the Pledge of Allegiance. Supervisor Galvin asked his guests to come forward so he could acknowledge their contributions to Maricopa County. He gave an overview of the Hawes Trail Alliance (HTA), formed in 2018 and acknowledged the many contributions of this 501(c)(3). Supervisor Galvin spoke about the recreational opportunities the HTA offers, and their partnership with the Tonto National Forest. The HTA performs bi-monthly trail maintenance, and a variety of safety features on the trails all performed by volunteers. Supervisor Galvin thanked his guests for helping make Maricopa County a better place. 4. PET SHOWCASE BY MARICOPA COUNTY ANIMAL CARE AND CONTROL - PRESENTACIÓN DE ANIMALES DOMESTICOS POR EL DEPARTAMENTO DE CONTROL Y CUIDADO DE ANIMALES Kim Powell, Communications Officer with Maricopa County Animal Care and Control introduced Butterball, a three-year-old Pitbull mix. She said Butterball plays catch, is well behaved, and knows basic commands. Ms. Powell announced that the Bissel’s Empty the Shelter Adoption Event is taking place April 1 – 10 and adoption fees were being waived for animals six months and older. Chairman Hickman asked the Clerk if there were any announcements or corrections to the agenda. The Clerk said there were none. PRESENTATIONS - PRESENTACIÓNES 5. JOY RICH RETIREMENT Recognition of Joy Rich, County Manager, for her years of service to Maricopa County (C-20-23-008-X-00) Chairman Hickman announced the next item was for recognition of retiring County Manager, Joy Rich. He commented on the many highlights of Ms. Rich’s accomplishments over the last six and one-half years as County Manager. She embodies what it means to be a public servant, a trusted advisor to the Board, and a Formal Meeting Minutes 03/29/2023 Page 3 of 36 mentor to her leadership team. When she retires on April 7, 2023, she will have spent 30 years in public service. A video was played in room that highlighted her accomplishments. Supervisor Hickman continued to comment on Ms. Rich’s many accomplishments including her work as the first woman to serve as County Manager. He is pleased to know she will have more time to spend with her family. Juanita Garza, Clerk of the Board, spoke and wished Ms. Rich all the best. She said it has been a pleasure working with her and witnessing her leadership for Maricopa County. Supervisor Galvin stated when he considered a position as a Supervisor, he knew of her great reputation as a County Manager. He commented on her ability to manage and lead 13,000 employees, work with five distinct Supervisor personalities, and take care of 4.5 million County taxpayers. He has appreciated her grace, dignity, and love of family. Supervisor Galvin thanked and congratulated her on her retirement. Supervisor Sellers commented on the great job she has done as County Manager of Maricopa County. He said her leadership has enhanced the greatness of Maricopa County. Supervisor Sellers said the true measure of a leader is how they respond in a time of crisis. Maricopa County has had its share of crisis including the pandemic, elections and an “audit” and he added that Ms. Rich was calm and rational about each of the situations the County dealt with. He thanked her and said the County would miss her. Chairman Gates echoed Supervisor Sellers’ comments on her steady hand in the handling of crises in Maricopa County. He talked about her many accomplishments during the calm times, including creating an environment where people want to work with better benefits, and solid leadership that she has demonstrated. The influence of her leadership in Maricopa County will be felt for years to come. Supervisor Gates encouraged Ms. Rich to enjoy her retirement. Supervisor Gallardo talked about the surprise he felt when Ms. Rich announced her retirement. He echoed his colleagues’ comments and what she has done for the employees on the subject of benefits. Supervisor Gallardo talked about how Ms. Rich has taken care of the constituents and has been responsive to the needs of the County. He touched on the flooding incident in Gila Bend and how Ms. Rich quickly called on the resources of Maricopa County to assist the community in need. Supervisor Gallardo said she has helped set a new standard for women, being a true inspiration for leaders of the future and communicating what is true, not just what people want to hear. He thanked her for all she has done. Chairman Hickman talked about how long he has known and worked with Ms. Rich. He spoke about how she has worked hard to bring in new leaders, setting the stage for more success in Maricopa County. He talked about the previous County Manager, Tom Manos who set a similar stage for Ms. Rich to step into. He said the great leadership has continued and will continue with the appointment of Jen Pokorski. Chairman Hickman said it has been a pleasure witnessing the progression of County Managers, each one building on the last. He is happy she will be able to spend time with her family and reiterated that she knows how to run a County. Ms. Rich thanked the Board profoundly and spoke about her career path that included her previous employment with the City of Phoenix 26 years ago. When she started at Formal Meeting Minutes 03/29/2023 Page 4 of 36 Maricopa County, she thought she would be passing through but ended up falling in love with the County and all that it had to offer. Ms. Rich said, as public servants, we meet a lot of people on their very worst day, and she believes the role of government is to serve those in need. She is proud to serve with the principled group of elected officials, including the Board of Supervisors. During the crises previously mentioned, the decisions were based on facts not political persuasion, always doing what was right. She talked about the 8:30 a.m. meetings during the pandemic, with the elected officials and the appointed departments all rowing in the same direction and that was emblematic of who we are as a team. Leadership has been strong, and she touched on the strengths of many of her staff. Jen Pokorski, the next County Manager, has been a gem and a joy to watch grow in the County and she will be a great leader. Supervisor Hickman asked the Board to come down for a picture followed by several pictures of County staff and Ms. Rich. IGA/MOU REGARDING RIO REIMAGINED – URBAN WATERS AMBASSADOR Approve an Intergovernmental Agreement (IGA) by and among the City of Avondale, the City of Buckeye, the City of Goodyear, the City of Mesa, the City of Phoenix, the City of Tempe, the County of Maricopa, the Salt River Pima-Maricopa Indian Community (“SRP- MIC”), the Salt River Project Agricultural Improvement and Power District, the Arizona Board of Regents for and on behalf of Arizona State University, and the Maricopa Association of Governments, which joins in this Agreement by way of Memorandum of Understanding (MOU). The purpose of this Agreement is to set forth the terms and conditions under which the Parties agree to: (a) the terms under which the Maricopa Association of Governments (“MAG”) will engage an outside consultant who will act as RIO Ambassador to the Urban Waters Federal Partnership (UWFP) (the “Position”) with direction from an advisory group composed of one representative from each Party; and (b) contribute to the cost of the Position. This Agreement will begin on the Effective Date and continue for a period of four years (the “Initial Term”). Thereafter, this Agreement may be renewed and updated, subject to available funding support and mutual written agreement of the Parties for additional two- year terms (each a “Renewal Term”). APPOINTMENT OF A CONSTABLE FOR THE MOON VALLEY JUSTICE PRECINCT Pursuant to ARS §11-251(16), consider a nomination for appointment of a Constable for the Moon Valley Justice Precinct to fill the vacancy created by the resignation of Carl Seel, the previous Constable. This appointment shall be to fill the vacancy for the remainder of the term which ends December 31, 2024. The recommended salary for the newly appointed Constable is $48,294.00, consistent with A.R.S. §11-424.01(C)(2) and the Board of Supervisors’ action related to Constable salaries. (C-06-23-611-X-00) Supervisor Gates spoke briefly about the Constable appointment and the importance of this position. He said in filling this vacancy, a kind and compassionate person is needed, and Matthew McRae rose to the top. Mr. McRae has a degree in criminalogy from Arizona State University with an interest in Public Safety. IGA WITH CITY OF SHOW LOW FOR SWORN BASIC TRAINING ACADEMY Approve an Intergovernmental Agreement (IGA) between Maricopa County on behalf of the Sheriff’s Office (MCSO) and City of Show Low (Show Low) regarding the Maricopa County Sheriff’s Office Sworn Basic Training Academy. This Agreement allows Show Low Police Department law enforcement recruits to participate in scheduled MCSO Sworn Basic Training Academies at a cost of $750 per registrant. The term is effective April 1, 2023, and when signed by all parties through March 31, 2025, plus one, two-year automatic renewal. RESCIND AND REPLACE COMPETITION IMPRACTICABLE FOR LEADS ONLINE LLC Rescind action taken by Board of Supervisors on February 08, 2023 under C-50-23-125-X- 00 concerning Competition Impracticable and replace with this action: Approve a Competition Impracticable for services from LeadsOnline, LLC. Also approve the corresponding agency agreement. The term of the purchase agreement is January 1, 2023 and is effective for three years for a total amount not to exceed $172,875. MCSO has contracted for this service using the City of Mesa’s contract. As of December 31, 2022, MCSO must enter into its own agreement with LeadsOnline, LLC. Approval of this item allows MCSO to continue using the LEADS online law enforcement investigations system to help solve cases concerning the buying and selling of stolen property through pawn shops and other venues. SUPPLEMENT TO AGREEMENT WITH THE OFFICE OF NATIONAL DRUG CONTROL POLICY (ONDCP) FOR THE HIGH INTENSITY DRUG TRAFFICKING AREA (HIDTA) – INITIATIVE XXXII Approve Supplement #1 to the Agreement with the Office of National Drug Control Policy (ONDCP) Award Number G22SA0005A, for the High Intensity Drug Trafficking Area (HIDTA) Program. The amount of supplement #1 is ($15,000), decreasing the amount from $662,747 to $647,747. The term of this funding is unchanged, January 1, 2022, to December 31, 2023. This funding supports of the Sheriff’s public safety mandate through efforts to reduce illegal drug use with the interruption of drug trafficking. The funding is recurring and has been awarded to the Sheriff’s Office for over twelve years. There is no matching requirement and Formal Meeting Minutes 03/29/2023 Page 9 of 36 there are no future or ongoing contributions required after the grant period ends. This is a competitive award. The Sheriff’s Office indirect cost rate for FY23 is 12.30%. There are no unrecoverable indirect costs associated with this decrease in funding. This award was initially accepted in BOS action C-50-21-186-X-00 on June 9, 2021. Grant revenues are not local revenues for the purpose of the constitutional expenditure limitation, and therefore, expenditures of these revenues are not prohibited by the budget law. ANNUAL RENEWAL OF DEEP UNDERCOVER VEHICLE REGISTRATIONS Approve renewal of deep undercover registrations and exemptions from markings which includes non-government license plates, per A.R.S. 38-538-03, for Sheriff’s RICO vehicles that are used for conducting investigations into major felony crimes, narcotics operations, and organized crime activity throughout Maricopa County. The Sheriff’s Office maintains a fleet of RICO deep undercover vehicles that are approved by the Board on a case by case basis as one-time additions to fleet with exemptions from markings and non-governmental plate registrations. Annual approval by the Board is required per A.R.S. 35-538-03 in order to renew these undercover vehicle registrations. A confidential list will be provided the Clerk of the Board in a sealed envelope to be opened only in the presence of a designated Sheriff’s Deputy, authorized to handle the list. FY 2023 BUDGET ADJUSTMENT FOR ONE-TIME ITEMS Pursuant to A.R.S. 42-17106(B), authorize the following appropriation adjustments to the FY 2023 budget: 1. Increase the expenditure authority in the Non Departmental (D470) General Fund (100) Operating (OPER) budget in the line “MCSO FY 2024 One-Time Items Purchase” by $1,017,482. 2. Decrease the expenditure authority in the Sheriff’s Office (D500) Detention Fund (255) Operating (OPER) budget by $1,017,482. 3. Approve a decrease to the FY 2023 fund transfer from the General Fund (100) to the Detention Fund (255) by $1,017,482. 4. Decrease the expenditure authority in the Non Departmental (D470) General Fund (100) Operating (OPER) budget in the transfer line “Jail Excise Maint of Effort Above Base” (4712) by $1,017,482. Decrease the revenue authority in the Non Departmental (D470) Detention Fund (255) Operating (OPER) budget in the transfer line “Jail Excise Maint of Effort Above Base” (4781) by $1,017,482. 6. Offsetting revenue and expenditure appropriation adjustments for the fund transfer in the Eliminations (D980) Eliminations Fund (900) Operating (OPER) by $1,017,482. These actions will have a net zero impact on the County-wide budget and do not alter the budget constraining the expenditure of local revenues duly adopted by the Board pursuant to A.R.S. 42-17105. These changes are necessary to move funding to the Non-Departmental General Fund – Operating budget from the MCSO Detention Fund – Operating budget to cover above-base one-time items requested in the FY24 budget. REPURCHASE AGREEMENT CONTRACT Request approval for the Master Repurchase Agreement contract with Daiwa Capital Markets America Inc. The Treasurer’s Office would like to invest in Repurchase Agreements with a short-term duration (estimated 1-10 business days). Repurchase Agreements are investments that will diversify the current short-term investment portfolio which already include overnight investments and money market funds. In addition, Repurchase Agreement investments will provide the opportunity to obtain a better short-term yield. Repurchase Agreements are collateralized by United States Treasuries at 102%, which limit the investment risk. PERMANENT ADDITIONS TO THE FLEET Approve a permanent addition to the fleet of three Ford Explorer Sport Utility Vehicles (SUV) to be used by Court Technology Services (CTS) and the Judicial Branch Warehouse. Two Ford Explorer SUVs will be used by Judicial Branch Court Technology Services to transport technology equipment and supplies between/among Branch locations. The estimated cost is $47,812.23 for each vehicle, for a total cost of $95,624.46 plus taxes and onboarding costs. One Ford Explorer SUV will be used by the Judicial Branch Warehouse. The SUV will be used to transport small equipment and supplies that do not require one of the larger vehicles already assigned to the warehouse. The estimated cost is $47,812.23 plus taxes and onboarding costs. The Grant funding is provided to the County through a non-competitive process and is a one-time occurrence. The Human Services Department submitted an application for the Carryover funds in October 2022. The Grant funding for FY2023 is now increased from $20,285,449 to $21,622,170, and the required non-federal share (NFS) match remains at $4,941,192 for the budget period of July 1, 2022, thru June 30, 2023. The total Federal and Non-Federal amount for the Project Period is $ $45,950,272. Future or ongoing contributions are not required after the grant period ends. Lessor owns the property located at 817 N Country Club, Mesa, Arizona. County’s Human Services Department utilizes a portion of the property for a Head Start program site since July 2, 2018. Pursuant to Section 6 of the Lease, County’s letter provides Lessor with ninety (90) days’ prior written notice to terminate the Lease on July 31, 2023. County’s final payment will be for July 2023 facility operating costs. Supervisor Galvin asked for a brief overview of what is being proposed. Ms. Bohn said the County has been leasing two classrooms and only one is being used and it is an underutilized location. The children at this location are aging out to kindergarten and no one will be left without services. The grant application is for fiscal year 2024 (FY24) and is for 3rd year Head Start/Early Head Start program performance. The Grant application is for $20,285,449 and the period of funding availability is July 1, 2023 through June 30, 2024. The Office of Head Start awarded Maricopa County with Grant No. 09CH012079 for Head Start/Early Head Start program for the project period of July 1, 2021 through June 30, 2026. The County is a current recipient of the stated grant and the funding opportunity is non-competitive. The Head Start Program goals are: 1. Better physical, cognitive, and social and emotional development in children 2. Improved Parent and Child Interactions that lead to Decreased Rates of Child Abuse and Neglect 3. Increase Parent Self-Reliance and Empowerment 4. Expand and Improve the Quality of the Early Childhood Workforce Also request authorization for the Chairman to sign documents related to this funding application. The Office of Head Start requires the Maricopa County Board of Supervisors Chairman to sign all grant applications, applications for additional funds, as well as amendments and budget revisions to the Grant. Amendments are required if the program needs to transfer funds between budget line items in an aggregate amount of $250,000 or more. The Grant requires a 20% non-federal share (NFS) match of the total approved project costs. The total required NFS for FY2024 is $5,071,363 for the budget period of July 1, 2023 thru June 30, 2024. NFS is generated through in-kind donations of goods and services as well as parent volunteering. ACCEPT SUPPLEMENTAL FY23 VICTIM COMPENSATION FUNDING FROM ARIZONA CRIMINAL JUSTICE COMMISSION Accept additional grant funds from the Arizona Criminal Justice Commission (ACJC) in the amount of 25,000 for FY23 Victim Compensation claims. The funds are $25,000 in State funds (ACJC). The addition of the supplemental funding brings the total amount of the FY23 grant award to $2,281,503.00. The supplemental funding is limited for use in paying Victim Compensation claims and cannot be used for indirect costs. The Arizona Criminal Justice Commission Grant Number VC-23-oo8 commenced on July 1, 2022, and terminates on June 30, 2023. The Maricopa County Attorney's Office's composite indirect cost rate for FY23 is 22.35% or $5,587.50 for the additional funding. The recoverable indirect cost of administering this grant is $0; the non-recoverable indirect cost is $5,587.50. Non-recoverable indirect costs will be covered by the departmental general fund budget. There is no requirement for matching funds. The original grant was competitive and does not require ongoing cash contributions after the grant period's end date. The Clerk said there was one email received regarding Maricopa County Animal Care and Control and that email has been shared with the Board offices. She also reported there were no in-room speaker forms received. SUMMARY OF CURRENT EVENTS - EL RESUMEN DE TEMAS DE ACTUALIDAD 76. Supervisors'/County Manager's summary of current events - Resumen de temas de actualidad de los Supervisores/Administrador del Condado Joy Rich thanked the Board for honoring her and for the video that included her family. Supervisor Gates thanked Chairman Hickman for putting together such a nice tribute to honor Ms. Rich. He announced the upcoming District 3 Farm City Breakfast this Friday, March 31, 2023 at the Arizona Wholesale Nursery. He thanked the Arizona Farm Bureau for their continued partnership in these community events. Supervisor Galvin said he enjoyed attending the grand opening for the Southeast Justice Center. This new facility is a consolidation of services including updated technology to better serve the public. He said he held his Farm City Breakfast last week at the Freeman Corn Patch, cohosted by Councilmember Mark Freeman. Supervisor Galvin said there was a great turnout with approximately 100 people in attendance. He also thanked Chairman Hickman and the Communications Department for the great tribute to Ms. Rich. Supervisor Sellers said he attended and appreciated the opening of the Southeast Justice Center. He said he also attended a tour of our Elections Center with the Committee for Safe and Secure Elections. He attended an Arizona Department of Transportation (ADOT) reception for newly appointed Jennifer Toth. He attended the International State of the State put on by Governor Hobbs and held at the Biltmore Hotel. This event is attracting foreign businesses including a $5.5 billion battery factory coming to Queen Creek. Supervisor Sellers talked about the importance of expansion and the associated infrastructure needed. He has been doing a lot of networking to move Prop 400 E forward. Supervisor Sellers thanked Ms. Rich again for her leadership and said it has been a pleasure working with her. Supervisor Hickman acknowledged Assessor, Eddie Cook. He came forward to speak in honor of Ms. Rich’s retirement. Assessor Cook said having been the County Assessor for three years, sees the One Team spirit in the County Manager and spread across the County. He presented a memento to Ms. Rich which was a copper coin with the embossed words: One Team. He said he wanted to present this to Ms. Rich as a reminder of the One Team spirit that included all of Maricopa County. He thanked her for her many years of faithful service. Supervisor Gallardo thanked Ms. Rich for all she has done for Maricopa County. Supervisor Gallardo spoke about the groundbreaking ceremony he attended last week for Centerline in Glendale, a 368-unit affordable housing project, which includes a variety of wrap around services. He said it was a great example of what can be done when partnerships and people work together. He thanked all the State, County and Local government agencies involved in this project. Supervisor Gallardo also shared a report that was put out by the Center for Disease Control (CDC) regarding underprivileged youth that are less likely to participate in extracurricular activities or sports due to lack of financial resources. He said he is a huge advocate for youth Formal Meeting Minutes 03/29/2023 Page 33 of 36 especially those economically disadvantaged. He said it was an eye opener and he is willing to share the report with those who are interested. Supervisor Hickman commented on the many events happening across the County and the accomplishments of his colleagues in their respective districts. He felt some pride in the good things that are happening in Maricopa County despite the many negative headlines that have persisted. He spoke about his District 4 Farm City Breakfast and said Assessor Cook and Sheriff Penzone were in attendance, both wearing their signature cowboy hats. Chairman Hickman asked that they be the speakers for the breakfast, and they did a fine job. He thanked Assessor Cook and Sheriff Penzone for representing farmers and the rural lifestyle at the Farm City Breakfast. He concluded his comments by telling the story on how he met Joy Rich. IGA WITH THE CITY OF SCOTTSDALE FOR THE PIMA ROAD DRAINAGE CHANNEL PROJECT Approve Intergovernmental Agreement (IGA) FCD 2022A001 for the Rights-of-Way Acquisitions, Utility Relocations, Construction, Construction Management, and Operation and Maintenance of the Pima Road Drainage Channel Project (PROJECT) between the City of Scottsdale (CITY) and the Flood Control District of Maricopa County (DISTRICT). This Agreement shall become effective as of the date it has been executed by all PROJECT PARTNERS and shall expire ten years from that date or upon PROJECT completion, whichever occurs first. The Pima Road Drainage Channel was identified in the Pinnacle Peak South Area Drainage Master Study as a necessary solution to mitigate the flood hazards in the area. The PROJECT will provide 100-year flood protection to 56 structures and reduce the frequency of flooding and flood damage for 73 structures. This Agenda Item impacts Supervisorial District 2.
