The Board of Supervisors of Maricopa County, Phoenix, Arizona, convened in Formal Session at 9:30 
AM on Wednesday, August 31, 2022, in the Supervisors' Auditorium, 205 W. Jefferson Phoenix, AZ 
85003, with the following members present:  Bill Gates, Chairman, District 3; Clint Hickman, Vice 
Chairman, District 4; Jack Sellers, Supervisor, District 1; Thomas Galvin, Supervisor, District 2; Steve

INVOCATION - INVOCACIÓN
Supervisor Galvin introduced former Secretary of State and current Justice of the Peace 
Michelle Reagan who offered the invocation.
3.
PLEDGE OF ALLEGIANCE - JURO FIDELIDAD A LA BANDERA
Judge Michelle Reagan led the assemblage in the Pledge of Allegiance to the flag.
Supervisor Galvin noted Judge Reagan has served in all three branches of government. 
Her father, Michael Reagan, served as Justice of the Peace for over 15 years. Judge 
Reagan is currently establishing a new Veterans Treatment Court in the northeast valley. 
Veterans Treatment Court focuses on therapy and counseling rather than fines and 
incarceration. Supervisor Galvin thanked Judge Reagan for her continued service in 
excellence for Arizona. 
Chairman Gates noted he has known Judge Reagan for many years and thanked her for 
all she was doing.
Supervisor Gallardo stated he and Judge Reagan were elected to the House of 
Representatives in the same year, and they served together in the State Senate as well. 
He concurred with Supervisor Galvin that Judge Reagan was easy to work with and come 
to a consensus with.

PET SHOWCASE BY MARICOPA COUNTY ANIMAL CARE AND CONTROL -

Rosie, a three-year-old terrier/shepherd mix, that has been at the shelter for three weeks.

to consider the petition to establish the Rio Verde Foothills Domestic Water Improvement District.

This item was continued from the August 29, 2022 meeting. Supervisory District No. 2 (C-64-23-

Chairman Gates introduced the item and asked Supervisor Galvin to take over.
Supervisor Galvin acknowledged the citizens in the auditorium who were present for this 
item. He said when he was appointed on December 8, 2021, he was immediately greeted 
with hundreds of emails regarding this important water issue. He continued by saying that 
whatever decision was reached on this matter, there would be people who would not be 
satisfied and reminded everyone that they are neighbors and mutual respect was important.
Supervisor Galvin made a motion to dismiss the petition to establish the Rio Verde Foothills 
Domestic Water Improvement District.
In response to petitions filed by the proposed members of the Rio Verde Foothills Water 
District, and after consideration of information received by the Board at the hearings held 
April 21, 2021 and August 29, 2022, as well as written submissions by property owners in 
Rio Verde Foothills, pursuant to A.R.S. § 48-906(B), I move that the Board of Supervisors 
determine that the territory set out in the petition should not be incorporated into an 
improvement district, and the proceedings be dismissed.
This Motion is supported by the following findings:
1.           Arizona law requires the Board to consider the interests of the Rio Verde Foothills 
community at large, not only the interests of those who would be included as members of 
the proposed district.
2.           There are more than 4000 parcels in Rio Verde Foothills, and the petitioners are 
owners of a minority of those, approximately 550 parcels.  The majority of comments that 
the board has received on the petition have opposed creation of the district.
3.           If established, the district would have the power to condemn property outside its 
boundaries for certain purposes related to provision of water for members of the proposed 
district.

e. All new buildings are subject to noise attenuation as per ARS § 28-8482(B).

revocation of this Military Compatibility Permit as set forth in the Maricopa County Zoning 
Ordinance. 
h. The property owner/s and their successors waive claim for diminution in value if the County 
takes action to rescind approval due to noncompliance with conditions. 
i. The granting of this change in use of the property has been at the request of the applicant, with 
the consent of the landowner.  The granting of this approval allows the property to enjoy uses in 
excess of those permitted by the zoning existing on the date of application, subject to conditions. 
In the event of the failure to comply with any condition, and at the time of expiration of the Military 
Compatibility Permit, the property shall revert to the zoning that existed on the date of application. 
It is, therefore, stipulated and agreed that either revocation due to the failure to comply with any 
conditions, or the expiration of the Military Compatibility Permit, does not reduce any rights that 
existed on the date of application to use, divide, sell or possess the property and that there would 
be no diminution in value of the property from the value it held on the date of application due to 
such revocation or expiration of the Military Compatibility Permit.  The Military Compatibility 
Permit enhances the value of the property above its value as of the date the Military Compatibility 
Permit is granted and reverting to the prior zoning results in the same value of the property as if

b. Development and use of the site shall be in substantial conformance with the narrative report 
entitled “Lot 14 & Tract A of Buckeye Ranch Special Use Permit Major Amendment” consisting 
of twenty-three (23) pages, dated revised June 20, 2022, and stamped received June 28, 2022, 
except as modified by the following conditions.
c. All transformers, back-flow prevention devices, utility boxes and all other utility related ground 
mounted equipment shall be painted to complement the development and shall be screened with 
landscape material where possible.  All HVAC units shall be ground-mounted.
d. Prior to commencing construction of the arsenic treatment system, the applicant shall obtain 
an Approval to Construct from Maricopa County Environmental Services Department (MCESD). 
e. Prior to the issuance of construction permits, the applicant shall submit a Grading and 
Drainage plan and Drainage Report that have been signed and sealed by an Arizona Registered 
Civil Engineer.  Said plan and report shall include the following:
1. Retention basin needs to provide for a maximum side slope of 4:1. 
2. Drainage review of planning and/or zoning cases is for conceptual design only and does not 
represent final design approval nor shall it entitle applicants to future designs that are not in 
conformance with Section 1205 of the Maricopa County Zoning Ordinance and the Maricopa 
County Drainage Policies and Standards. 
3. All development and engineering design shall be in conformance with Section 1205 of the 
Maricopa County Zoning Ordinance and current engineering policies, standards and best 
practices at the time of application for construction. 
4. Any development in the floodplain will require a floodplain use permit issued concurrent with 
building permit(s) required for site development. 
5. Driveway access to Papago Street must be paved and will require a permit from MCDOT 
issued concurrent with building permit(s) required for site development. Drainage flow along the 
roadway must be maintained. 
6. All retention basins shall drain within 36 hours per County requirements. 
f. The applicant or his successor shall obtain approval of any development plans from the Office 
of the Arizona State Fire Marshal prior to any construction.
g. Development and use of the site shall comply with requirements for fire hydrant placement 
and other fire protection measures as deemed necessary by the applicable fire department. Prior 
to issuance of zoning clearance, the applicant shall seek review and comment from the 
applicable fire protection agency, and shall provide written confirmation that the site will be 
developed in accordance with their requirements.
h. All outdoor lighting shall conform to the Maricopa County Zoning Ordinance.
i. Prior to zoning clearance, developer(s) and/or builder(s) shall establish emergency fire 
protection services, covering all real property contained within the project area during course of 
construction and shall obtain a ‘will serve’ letter substantiating coverage from the appropriate 
Fire Department servicing the site.
j. In the event the use of this site is terminated for a period exceeding 180 days, the SUP shall 
expire, and all related equipment shall be removed within 180 days.

k. Major changes to the Special Use Permit shall be processed as a revised application, with 
approval by the Board of Supervisors upon recommendation of the Planning and Zoning 
Commission.  Minor changes may be administratively approved by the Planning and 
Development Department.  Major changes to the Special Use Permit may require a new Citizen 
Participation Process as determined by the Planning and Development Department.
l. Noncompliance with the conditions of approval will be treated as a violation in accordance with 
the Maricopa County Zoning Ordinance.  Further, noncompliance of the conditions of approval 
may be grounds for the Planning and Zoning Commission to take action in accordance with the 
Maricopa County Zoning Ordinance).
m. Non-compliance with the regulations administered by the Maricopa County Environmental 
Services Department, Maricopa County Department of Transportation, Drainage Review 
Division, Planning and Development Department, or the Flood Control District of Maricopa 
County may be grounds for initiating a revocation of this Special Use Permit as set forth in the 
Maricopa County Zoning Ordinance. 
n. Property owner and his successors waive claim for diminution in value if the County takes

Chairman Gates asked Jennifer Toth, Director of Transportation, to come forward to give 
the staff report on this item. 
Ms. Toth explained a petition was filed with the Clerk of the Board on April 15, 2022. The 
hearing was held on June 22, 2022 and continued. The petitioner was unavailable at the 
meeting to respond. Ms. Toth reviewed the scope of the project, and reviewed all the 
opposition and the costs associated with the project. She stated based on the extreme 
costs of the project, the recommendation of the department is to deny the formation of the 
improvement district.

APPROPRIATION ADJUSTMENT FOR A.R.S. §42-1733 (SCHOOL SAFETY PILOT 
PROGRAM)

The MCSO received a state funding appropriation for FY 2021-2022 per S.B. 1823 of the Fifty-
fifth Legislature to use in accordance with A.R.S. § 41-1733 for a school safety pilot program for 
interoperability.  The State Treasurer is charged with administering this fund and funds are 
eligible to the sheriff of a county that establishes a school safety pilot program and may be used 
only for a school safety pilot program that meets criteria outlined in the Statute (attached). This 
will be pass through funding for authorized school interoperability projects.
This state appropriation for a pilot school safety program may be reoccurring. There is no cash 
or in-kind match for this appropriation, nor is it applicable. Indirect cost recovery is not applicable. 
Future ongoing cash contributions are not applicable or are unknown. The appropriation is not a 
mandated function. Whether the appropriation was assigned via a competitive or non-
competitive methodology- not applicable. There are no costs that will need to be absorbed by 
the department’s operating budget.
Grant revenues are not local revenues for the purpose of the constitutional expenditure limitation 
and therefore, expenditures of these revenues are not prohibited by the budget law. This request 
does not alter the budget constraining the expenditures of local revenues adopted by the Board

FUNDS FROM ARIZONA GAME AND FISH COMMISSION FOR LAW ENFORCEMENT 
BOATING SAFETY FY23
Approve acceptance of up to $430,000 in continued funding from the Arizona Game and Fish 
Commission for Law Enforcement Boating Safety. The term of this funding is estimated to be 
July 1, 2022 through June 30, 2023. This funding will be used to pay for personnel costs, 
purchase equipment, maintenance/repair and/or replacement of watercraft patrol boat(s) to 
continue effectively patrolling the waterways, a mandated public safety function in Maricopa 
County. 
This funding award formulaic and non-competitive. It is recurring and has been awarded to the 
Sheriff’s Office for many years. These funds are the result of A.R.S. § 5-383 and indirect cost 
recovery is not allowed. The Sheriff’s indirect cost rate for FY23 is 12.30%. Of the $430,000 
estimated award, there will be capital equipment purchases valued at $250,000 and they are 
excluded in the indirect cost calculation. The indirect cost basis is $180,000 with a total 
unrecoverable indirect cost amount of $22,140 to be absorbed by the General Fund. 
There is no match requirement and there are no future or ongoing contributions required after 
the grant period ends; however, there is an expectation to continue patrolling Maricopa County 
waterways if the funding from the State was to end. This estimated funding amount is equal to 
the funding amount from FY 2022. 
Grant revenues are not local revenues for the purpose of the constitutional expenditure limitation,

ADDITIONAL FUNDING FROM THE OFFICE OF THE STATE TREASURER; SMART AND 
SAFE ARIZONA ACT GY2021
Approve acceptance of additional funding from the Office of the State Treasurer for the Smart 
and Safe Arizona Act of $427,290.06 for a total of $1,927,290.06. The anticipated term of this 
funding is July 1, 2022, through June 20, 2023.  Acceptance of an initial $500,000 was approved 
on June 23, 2021 (C-50-21-192-X-00), and an additional $1,000,000 on January 26, 2022 (C-
50-21-192-X-01). This funding is formulaic, non-competitive and will be reoccurring. There is no 
match requirement and no future or ongoing contributions are required when the funding period 
ends. The projected use for these funds is program related personnel costs.     
The funds are statutory (A.R.S. §36-2856) and indirect cost recovery is not allowed. The Sheriff’s 
indirect cost rate for FY23 is 12.30%. The indirect cost basis is $427,290.06 with a total 
unrecoverable indirect cost amount of $52,556.68 to be absorbed by the General Fund. 
Also approve in accordance with A.R.S. §42-17106(B) the following appropriation adjustment:

AGREEMENT WITH THE ARIZONA DEPARTMENT OF HOMELAND SECURITY FOR RRT 
SUSTAINMENT (50RRTSUST) - GY2023
Approve the Agreement and acceptance of reallocation grant funds to the Sheriff’s Office from 
the Arizona Department of Homeland Security, RRT Sustainment (50RRTSUST) Agreement 
Number 20-AZDOHS-HSGP-200812-06 in the amount of $40,128 for the award period of August 
1, 2022 to June 30, 2023. This Agreement may be terminated by any of the parties by written 
notice to the other parties thirty (30) business days prior to termination.
This funding award is non-recurring and there is no match requirement. The Sheriff’s Office 
indirect cost rate for FY23 is 12.30%. Of the $40,128 award, there will be a capital equipment 
purchase of $24,760, which is excluded in the indirect cost calculation. The indirect cost basis is 
$15,368 with a total unrecoverable indirect cost amount of $1,890.26 to be absorbed by the 
General Fund. 
There are no future or ongoing contributions required after the grant period ends; however, 
property (items) purchased with these funds must remain available to the unit for the duration of 
its existence and/or the useful life of the item. 
This is not a mandated function although it supports the MCSO public safety mandate and 
provides a benefit to the citizens by responding to serious incidents involving hostages and/or 
individuals which have been identified as having involvement in serious criminal offenses and/or 
terrorist activities. This is a competitive award. The Maricopa County Sheriff’s Office is one of 
several local law enforcement agencies in the Phoenix metro area that participate in this effort. 
This is reimbursement funding that will be used to purchase non-capital equipment. 
These revenues are not local revenues for the purpose of the constitutional expenditure 
limitation, and therefore, expenditures of these revenues are not prohibited by the budget law.

RESOLUTION APPROVING THE SUBMISSION OF PROJECTS FOR CONSIDERATION IN 
ARIZONA’S 2023 GOVERNOR'S OFFICE OF HIGHWAY SAFETY PLAN
Adopt a Resolution approving application and acceptance of up to $711,885 in reimbursable 
grant funding from the Governor’s Office of Highway Safety (GOHS). This pass-through federal 
funding will be used for overtime, training and equipment to accomplish projects related to 
highway safety.
This resolution for Maricopa County specifically authorizes the filing and acceptance of grant 
funding from the priority Program areas: 1) a. Impaired Driving (DUI Enforcement; Underage 
Drinking Enforcement; officer training for recognizing impairment and enforcing the law) 
$462,344; and b. Impaired Driving (Warrant Details) $42,000; 2) Accident Investigation, 
$116,541; and 3) Police Traffic Services Reckless/Aggressive Driver education and 
enforcement, speed related patrol enforcement, DUI enforcement/alcohol violations and school 
speed zone and construction zone enforcement) $91,000. The anticipated term of the funding is 
October 1, 2022 through September 30, 2023.
The Sheriff’s Office has received this funding for approximately 20 years. It is competitive and 
recurring. There is no match requirement. The funding limits employer related expense 
reimbursements to 40% and the Sheriff’s Office is required to fund the difference ($152,360) 
from its general fund appropriation.
This funding does not allow indirect cost recovery. The Sheriff’s Office indirect cost rate for 
FY2023 is 12.30%. This funding is earmarked primarily for overtime expense, training and the 
purchase of program related equipment. Capital equipment purchases comprise $99,512 of the 
$711,885 total, for an indirect cost base of $612,373 and estimated unrecoverable indirect costs 
of $75,322. There are no future or ongoing contributions required after the grant ends. This 
funding supports and enhances the Sheriff’s Office public safety mandate.
Also approve three one-time additions to fleet of fully equipped, police-packaged vehicles; and 
per ARS 38-538-03, approve exemptions from markings for these vehicles.   The Aggressive 
Driver grant funds one vehicle and DUI Enforcement funds two.  Specific vehicle information to 
be provided following acquisition.  Annual vehicle operating expense is estimated to be $7,500 
each for a total of $22,500 to be paid from the general fund.  The vehicles will be retired at the 
end of useful life with no funding for replacement from the General Fund.

and therefore, expenditures of these revenues are not prohibited by the budget law.
This funding is earmarked primarily for overtime expense, training, services and the purchase of

a 2014 Ford F450, VIN 1FDUF4GTXEEB52994, to be used haul heavy hay bales to events, 
large equine supplies, barricades, and any safety equipment the Lakes division may need. 
Because it will not be used for public safety response, minimal markings that include the 
Maricopa County Seal and a G-Plate registration are requested.   The annual operating expense 
for these vehicles is expected to be $7,800 each for a total of $15,600.   These vehicles will be 
retired at the end of its useful life with no funding from the general or detention funds for its

Award Number 2022-PTS-037, for the STEP Enforcement grant. The amount of the supplement 
is $110,000, increasing the amount from $72,486 to $182,486. The term of this funding is 
unchanged – October 1, 2021, to September 30, 2022. The Sheriff’s Office indirect cost rate for 
FY23 is 12.30% applicable to the supplement less the capital expenses of $110,000 for an 
indirect cost base of $0.00. There will be no unrecoverable indirect costs.  It is competitive and 
non-recurring. There is no match requirement.
Also approve two (2) one-time addition to fleet of traffic enforcement vehicles (two 2021 Ford 
Mustangs, specific detail to be provided later). These vehicles will be utilized for enhanced traffic 
enforcement in support of keeping the roadways safe. Annual operational costs are anticipated 
to be $7,500 each for a total of $15,000 to be paid from the General Fund.
Finally, approve per A.R.S. § 38-538-03 exemptions from markings for each of these vehicles.

Acknowledge the donation and distribution of Heat Relief kits to local non-profit organizations 
that provide services to individuals experiencing homelessness. Over 10,000 kits were 
purchased by Maricopa County Public Health Department and distributed by the Human 
Services Department to Maricopa Heat Relief Network, the Continuum of Care Outreach 
Collaborative, and local non-profits. 
Each Heat Relief kit contains a water jug, lip balm, sun screen, cooling bandana, hat, hygiene 
kit, and insect repellent. 
The estimated value of the Maricopa County donated kits is $372,212.74

INFANT, AND CHILDREN SERVICES
Approve Amendment 9 to Intergovernmental Agreement (IGA) Contract no. CTR04876 between 
Arizona Department of Health Services (ADHS), Women Infant and Children (WIC) Services and 
Maricopa County, by and through its Department of Public Health (MCDPH), to provide 
continued funding for WIC Services, Breast Feeding Peer Counseling Services Program (BFPC), 
WIC Special Projects, and LA Project.
 
This Amendment adds additional LA Project Funding to the WIC Services with funding of 
$194,651 for budget period April 1, 2022 to September 30, 2022. In addition, the Amendment 
increases the BPCS Project funds by $18,550 for a total increase of $213,201 for Amendment 
9. The budget period begins October 1, 2021 through September 30, 2022. The IGA term is from 
October 1, 2018 through September 30, 2023.
In addition, this amendment shall update the terms and conditions as follows:
1. Pursuant to Terms and Conditions, Page Seven (7), Provision Six (6), Contract Changes: the

rates.
The WIC Services award is reoccurring and has been awarded to the department for many years. 
This grant does not require match, indirect costs are fully recoverable and ongoing cash 
contributions are not required. The grant award is not a mandated function but provides a benefit 
to the citizens by providing vouchers for approved foods (milk, cheese, cereals, peanut butter, 
eggs, infant formula, and juice etc.) for low-income pregnant, post-partum, breast-feeding 
women, infants, and children up to five (5) years of age. Clients also receive nutrition and breast-
feeding education and referrals to applicable social services. The grant award is competitive, 
and there are no costs that will need to be absorbed by the department's operating budget. (C-

CARE PROGRAM COMMUNITY HEALTH NURSING PROGRAM
Approve Amendment 5 to the ADHS Contract for Community Nursing Services CTR046941 
awarded by the Arizona Department of Health Services (ADHS) High Risk Perinatal Program 
(HRPP) with Maricopa County by and through its Department of Public Health (MCDPH). 
Previously the BOS approved receiving a potential $590,000 for the budget period July 30, 2022, 
through June 30, 2023; however, ADHS has increased the maximum available funding to a total 
not to exceed amount of $603,250. Therefore, MCDPH requests this additional $13,250 to be 
approved if needed.

The funding for this program is on an “as needed basis” based on client visits/enrollments. 
Payments on an as needed basis allows ADHS greater flexibility in allocating funds based on 
the services being provided. The original contract term is from August 1, 2019 through June 30, 
2023 and we are in Year 4.
The Department of Public Health indirect rate for FY23 is %17.24.  The indirect costs are 
estimated at $1,948.40 and are fully recoverable. The HRPP NICP grant award is reoccurring 
and has been awarded to the department in prior years. This competitive grant does not require 
an in-kind match, indirect cost is fully recoverable, and ongoing cash contributions are not 
required. The grant award is not a mandated function but provides a benefit to the citizens by 
providing developmental follow-up through home-based services for families whose children 
received intensive or special care immediately after birth and for children with identified special 
health care needs.  All program costs are allocated to the grant so there will be no additional

AMENDMENT TO IGA WITH ARIZONA DEPARTMENT OF HEALTH SERVICES FOR TITLE 
V MATERNAL AND CHILD HEALTH HEALTHY ARIZONA FAMILIES
Approve Amendment 2 to the Intergovernmental Agreement (IGA), a cost reimbursement 
contract (CTR055260), Year 3, between Arizona Department of Health Services (ADHS), Title V 
Maternal and Child Health (MCH) Healthy Arizona Families & Preventive Health and Health 
Services and Maricopa County, by and through its Department of Public Health (MCDPH). The 
term of this cost reimbursement IGA began on July 1, 2020, and terminates on June 30, 2025. 
This Amendment 2 updates the scope of work and increases funding in the amount of $480,417 
($433,961 for MCH Healthy Arizona Families & $330,280 for Public Health Improvement (PHI) 
Program) for the budget period of July 1, 2022, through June 30, 2023. This will change the 
contract term total to a new not-to-exceed of $1,348,339. In addition, it revises Exhibit A and 
adds Exhibits B, C, and D related to the federal funding being received. 
This IGA was designed to leverage partnerships between ADHS and Local County Health 
Departments by providing Block Grant funding to support the health priorities identified in the 
AZCHIP, the county health improvement plans (CHIPs), and the 2020 Title V MCH Needs 
Assessment. The populations include Woman/Maternal and Perinatal Infant, Child Health, 
Adolescent Health, and Children with Special Health Care needs.
MCDPH’s Indirect Rate for FY23 is 17.24 %.  The indirect costs for MCH Healthy Arizona 
Families is estimated at $63,813.44 which are fully recoverable. Departmental indirect rates are 
reestablished at the beginning of each fiscal year and the future indirect rates will be collected 
at the corresponding rates. The PHI portion of the grant deviates from County Policy A2505 and 
does not allow for full indirect cost reimbursement, but a maximum of 10%.  The full indirect costs 
are estimated at $51,763.88 of which $30,025.45 is recoverable and $21,738.43 is 
unrecoverable.  
The grant award reoccurrence is unknown, there is no cash or in-kind match required. The grant 
award is non-competitive and on-going contributions are not required. Though not mandated, 
services are a benefit to citizens of Maricopa County by providing an evidence-based public 
health approach to improve the health and wellness of Arizona residents. 
Grant revenues are not local revenues for the purpose of the constitutional expenditure limitation, 
and therefore expenditure of the revenues is not prohibited by the budget law. This Agreement 
does not alter the budget constraining expenditures of local revenues duly adopted by the Board

pursuant to A.R.S. §42-17105.  The overall grant budget will be adjusted as necessary to 
accommodate this grant through a future reconciliation.  Funding for this Agreement is provided 
by a Grant from ADHS and will not affect the County’s general fund. 
The ADHS conducts a five (5) year statewide needs assessment to examine key health 
indicators and provide a comprehensive overview of the health of Arizonans. ADHS published 
the 2019 Arizona State Health Assessment which utilizes an evidence-based public health 
approach to improve the health and wellness of Arizona residents. This assessment informs 
other federally funded programs within ADHS that also require statewide needs assessments. 
One (1) of those programs is the Title V Maternal and Child Health (MCH) Block Grant located 
within the Bureau of Women’s and Children’s Health (BWCH). The mission of the BWCH is to 
“strengthen the family and community by promoting and improving the health status of women, 
infants, and children.” The BWCH administers the federal Title V MCH Block Grant. This IGA is 
intended to provide flexibility to the Maricopa County Health Department to meet the needs of 
local communities through high impact strategies that align with the 2020-2025 MCH health 
priorities, the identified national performance measures, and administrative functions.

AFFILIATION AGREEMENT WITH LITCHFIELD ELEMENTARY SCHOOL DISTRICT FOR 
DIETETIC INTERNSHIP TO PROVIDE CLINICAL NUTRITION TRAINING
Approve the Affiliation Agreement with Litchfield Elementary School District #79 to provide 
clinical nutrition training experience for graduate students in the dietetic internship program. The 
agreement is non-financial, and the term is to be from July 1, 2022 through June 30, 2032.
As a part of its established accredited dietetic internship program, the Department of Public 
Health seeks to provide its dietetic interns with a broad and diverse practicum experience.  This 
agreement with LESD will allow dietetic interns to continue to receive approved practicum 
experience in clinical nutrition.  Supervised by LESD registered dietitians in LESD facilities, 
interns would continue to be responsible to Public Health. This agreement is non-financial, and 
does not affect the County general fund.

IGA WITH THE CITY OF SCOTTSDALE  FOR THE PUBLIC HEALTH FELLOWSHIP 
PROGRAM
Approve an IGA between the City of Scottsdale and Maricopa County by and through its 
Department of Public Health (MCDPH) to provide Public Health Fellows (“Fellows") with a 
comprehensive, experiential public health experience, in a hybrid environment relating to issues 
exacerbated by the COVID-19 pandemic, including mental health and substance use/misuse 
and abuse. Fellows will receive training in the areas of program management, budget, and public 
health administration. The term of this Agreement shall begin upon Board approval (August 31, 
2022) and is thru June 30, 2024.
Fellows will be employed full time by the County and receive all benefits associated therewith. 
Fellows will be hired under the Market Range title “Public Health Intern” with a hiring 
compensation range of $24.05-$29.15 hourly. There will be no financial compensation from the 
City of Scottsdale under the terms of this agreement.  This Agreement/ IGA will be funded by the 
Senate Bill 1847. This Agreement may be terminated by either party upon prior written notice to 
the other party and the Agreement may be renewed for additional terms by the mutual consent

Approve and execute a contract developed under Maricopa County Department of Public Health 
(MCDPH) solicitation #PH RFP 220288, Federally Qualified Health Centers (FQHC) for COVID 
Response and Resilient COVID Response and Communities (CCR), between MCDPH and Valle 
del Sol, Inc.  This contract will allow the selected FQHC to assist MCDPH in our efforts to 
increase awareness in the detection and prevention of COVID-19 for the residents of Maricopa 
County. In addition, it hopes to reduce disparities in COVID-19 health outcomes as well as 
reduce disparities in socio-economic status due to COVID-19. 
The initial term of this fixed-price service contract is for ten (10) months, beginning September 
1, 2022 through June 30, 2023. The total budget is $677,925 for the first project period. Based 
upon continued funding, successful Contractor performance, and a continuous need for services, 
the contract may be extended for up to four (4) additional one-year terms.

GRANT AWARD FOR IGA WITH THE CITY OF PHOENIX FOR THE LEAD HAZARD 
CONTROL PROGRAM
Approve a grant award and authorize the Chairman of the Maricopa County Board of Supervisors 
to sign all related documents including the Intergovernmental Agreement with the City of Phoenix 
by and through the Neighborhood Services Department. This award provides funding in the not-
to-exceed amount of $319,453.00 for the contract period January 1, 2022 through May 14, 2025. 
In addition, an In-kind match requirement of $108,844 is required.  Program costs not covered 
by the grant will be subsidized by the MCDPH indirect cost pool.  
This grant was non-competitive in nature and MCDPH is historically awarded funding related to 
Lead Hazard mitigation efforts. This grant originates from the Residential Lead Based Paint Act 
of 1992 and the Department of Veterans Affairs, Housing and Urban Development. The funding 
will be used for the Lead Safe Phoenix Program. This award does not fund a mandated service, 
pursuant to Arizona Revised Statute, Sections 11-201, 11-952, and 11-251 (paragraph 17) but 
provides a benefit to County residents which includes testing of children for Blood Lead Levels 
(BLL), case management for children identified with elevated BLLs, educational interventions 
approved by the Lead Safe Phoenix Program, data collection and public education efforts.
This Grant deviates from County Policy A2505 and does not allow for full indirect cost 
reimbursement, but a maximum of 10% indirect cost reimbursement as delegated in the Grant 
Agreement. MCDPH's indirect rate for FY23 is 17.24%. The full indirect costs are estimated at 
$50,067.00 of which $29,041.18 is recoverable and $21,025.82 is unrecoverable.  Departmental 
indirect rates are re-established at the beginning of each fiscal year and the future indirect rates 
will be collected at the corresponding rates. There are no ongoing contributions after the grant

of Health and Human Services, Centers for Disease Control (CDC) to Maricopa County by and 
through its Department of Public Health (MCDPH) to provide continued funding for work focused 
on increasing access to comprehensive and timely surveillance data on opioid overdose 
morbidity and mortality rates.
The NOFO has extended the agreement term for an additional 12 months, which brings the term 
of the agreement from September 1, 2019, through term end date August 31, 2023.
Authorize the Board Chairman to sign all documents related to the NOFO as applicable. Subject 
to the availability of funds, the NOFO anticipates providing funding in the not-to-exceed amount 
of $2,588,960 for the budget period beginning September 1, 2022, through August 31, 2023.

Arizona Department of Economic Security (AZDES) and Maricopa County, by and through its 
Department of Public Health. Pursuant to IGA Section 9.0, Amendments, this Amendment 3 
extends the contract term from October 1, 2022, through September 3, 2023 with no changes in 
the rates for the extension period. All other terms and conditions of the original contract or 
subsequent amendments remain in full force and effect.
The Refugee award is reoccurring and has been awarded to MCDPH in previous years.  It does 
not require an in-kind match and indirect costs are fully recoverable. Refugee services are not 
mandated but provide a benefit to County residents by providing medical examinations and 
needed follow-up to newly arriving refugees for issues of public health significance. Should the 
grant cease, ongoing contributions should not be required.  This grant award was not 
competitive.

GOVERNMENTAL ACCOUNTING STANDARDS BOARD STATEMENT NO. 34
Amend action taken place on September 16, 2020 (C-64-02-262-5-03) to establish County policy 
for minimum road system condition levels per the requirement of the Governmental Accounting 
Standards Board Statement No. 34 using the modified approach for reporting infrastructure 
assets.
Amend as follows:
Road System – 75% of centerline miles with Overall Condition Index (OCI)≥60 and no more than 
5% of lane miles with OCI<40
The Department has made changes to the methodology for how pavement inspections are 
conducted.  The revised methodology is more robust and incorporates a Quality Assurance 
system that helps insure consistent, repeatable inspections.  The change in inspection 
methodology resulted in a significant drop in the OCI that is attributable to the new system, not 
to actual pavement condition changes.  As a result, we are amending the road system rating to 
conform to the new methodology.  This includes a revision to classification of the road condition 
based on OCI to the following:  Very Good (90-100), Good (75-90), Fair (60-75), Poor (40-60), 
and Very Poor (<40).
The Department of Transportation is required to comply with the Governmental Accounting 
Standards Board Statement No. 34 for reporting infrastructure assets (i.e., roads, bridges, etc.). 
The Department elected to use the modified approach for reporting infrastructure assets which 
means infrastructure assets will not be depreciated as long as two requirements are met.  First, 
the assets are managed using an asset management system.  Second, the government 
documents that the infrastructure assets are being preserved approximately at (or above) a 
condition level established and disclosed by the Board of Supervisors.  The condition levels 
established by the Board of Supervisors will be reported annually in the County’s Comprehensive 
Annual Financial Report (CAFR).  This agenda item establishes the policy for minimum condition 
levels to be disclosed annually in the CAFR and amends the previously established pavement 
condition rating system to follow the Cartegraph based rating system.
The condition of road pavement is measured using the Cartegraph rating system, which is based 
on the weighted averages of pavement surface distress factors using ASTM 6433.  The 
Cartegraph system uses a measurement scale to evaluate OCI ranging from zero for a failed 
pavement to 100 for a pavement in perfect condition.  Pavement condition assessments are 
determined annually for arterial roads and every other year for local roads.

The Department of Transportation is in compliance with these condition ratings and no additional 
funding will be required to maintain the current condition rating.

AUTHORIZE INITIAL VERSION OF MARICOPA COUNTY POLICY A1615 BRAND 
MANAGEMENT
Approve and authorize the new Brand Management policy which establishes the philosophy, 
responsibilities, and rules for using the Maricopa County seal, logo, and associated messaging 
for merchandising, digital and print communications, and marketing. A centralized Maricopa 
County brand shows unity of purpose, increases visibility of services through improved public 
recognition, and develops and promotes trust through clear identification of initiatives and 
services.  
This policy will apply to all Maricopa County appointed departments as well as the Flood Control 
District of Maricopa County, the Maricopa County Library District, and the Maricopa County 
Stadium District (Special Districts). The Board of Supervisors is authorized to jointly adopt 
policies applying to the Special Districts under the Intergovernmental Agreement, C-06-18-393-
6-00, approved on April 11, 2018. (C-20-23-004-X-00)

This agenda item is for an administrative change to acknowledge Franmar Manor Apartments, 
Inc. (Lessor) as the new property owner/landlord for the County’s lease for Public Health located 
at 3221 N. 16th Street, Phoenix. The property was conveyed to Lessor via Special Warranty 
Deed and recorded with the County Recorder on May 8, 2022.  All other terms and conditions of 
the subject Lease Agreement remain unchanged.

Chairman Gates asked the Clerk if there was anything to report regarding Public Comment 
email responses. The Clerk said there were 70 email comments regarding MCACC and all 
had been shared with the Board offices.
Dylan Kingsley, resident, stated the majority of people in the animal care community just 
want to see change. They would like to build a bridge between themselves and the Board 
and keep the animals safe and healthy. She would like a meeting with the Board to discuss 
some bylaws for a Citizens’ Advisory Committee. She has emailed the Chairman and is 
waiting for a response. She provided the Board with a handout.
Diane Barker, resident, commented on the water fountain at Margaret Hance Park burning 
her hand from the heat because it was not covered. She said the water fountains at light 
rail stations have the same problem.
Blue Crowley, resident, commented he is waiting on a copy of the Prop 400 document. He 
said the document he received had some flaws in it. He listed complaints he has with the 
Maricopa Association of Governments (MAG).

Chairman Gates commented briefly about restarting the District 3 Coffee Chat saying 
Jacqueline Edwards, Director of Human Services, would join them at the Sunnyslope Chat 
on homelessness. He thanked Supervisor Galvin again for his efforts on the Rio Verde 
Foothills issue. Chairman Gates handed the gavel to Vice Chairman Hickman.

Supervisor Gallardo reviewed the flood event in Gila Bend a year ago and the actions taken 
by MCDOT, Flood Control, Environmental Services, Human Services, Emergency 
Management, and Sheriff’s Office. He appreciated the teamwork exhibited by Maricopa 
County. He shared a video that showed the devastation caused by the flood.
Vice Chairman Hickman shared his experience and observations during this flood event.
Supervisor Sellers shared he was Chairman of the Board at that time and said he received 
a call informing him he needed to declare an emergency. He was thankful that Supervisors 
Gallardo and Hickman were already on their way to Gila Bend when he got the call. He 
spoke about the safety summit hosted by the Sheriff’s Department sharing how elected 
people and election workers can protect themselves. He attended the ribbon cutting 
ceremony for the Phoenix Mesa Gateway Air Traffic Control Tower named for Senator John 
McCain. Supervisor Sellers shared that the National Association of Counties gave 43 
awards to Maricopa County. He noted it was impressive that the County was recognized 
across the nation. He announced there will be a new Corning and AT&T fiber optic 
manufacturing facility in Gilbert and named those that participated in the event. Supervisor 
Sellers also took part in a roundtable discussion at Arizona State University concerning the

Chip Act that will bring chip manufacturing to Arizona. This will bring research and 
development back to this country.
Vice Chairman Hickman thanked the Workforce Development Board for inviting him to 
speak with them. He shared the Board went from “worst to first” during a time when stability 
was needed because infrastructure money was coming. He thanked Matt McGuire for his 
efforts that corrected the problems on the Workforce Development Board. Vice Chairman 
Hickman shared his first experience with a planning and zoning meeting. He said he was 
thankful for Supervisor Galvin and his staff for how they navigated this issue.
Supervisor Galvin explained that many times the Board faces events or issues where 
peoples’ lives are at stake. He expressed his gratitude for the support of this Board; for the 
great team he has, Garth Kamp and Dan Gardner; for County staff who worked with him 
every day; and the residents of the Rio Verde Foothills community. Supervisor Galvin 
stated he did not think the Rio Verde issue is over and he is going to continue working with 
the community.

CHANGE ORDER NO. 1 FOR GUADALUPE FRS INTERIM FIX FINAL DESIGN AND POST

Approve Change Order No. 1 in the amount of $400,000 and time extension to this Competition 
Impracticable (CI) contract that will allow the design consultant to prepare plans for a targeted 
demolition of the Guadalupe FRS Intake Structure which is failing and in need of immediate 
repair. Change order will also allow for the consultant to remain as the engineer of record during 
demolition and writing the completion report required by ADWR. The consultant will also assist 
the District with getting approval from ADWR and NRCS as to what the final permanent condition 
for the outlet structure can be.
