1 Planning and Development Department CONDITIONAL APPROVAL – ABND 220064 Your abandonment request was granted CONDITIONAL APPROVAL. This request will NOT be completed until all the stipulations have been met and this request is formally adopted by City Council. It is the APPLICANT’S RESPONSIBILITY to ensure that all stipulations are satisfied. Please contact the Abandonment Coordinator at (602) 534-7321 for questions and notification of your completion of the stipulations. Upon completion of the stipulations your request will be scheduled for City Council formal approval. You will receive a copy of the abandonment document after it has been recorded with Maricopa County. If the stipulations of abandonment are not completed within two years from the date of your conditional approval (your expiration date is February 3, 2023), this request will then expire. At that time a new submittal will be required along with the required payment for the abandonment process. A one time, one year extension can be requested prior to the expiration date, with applicable extension fee due. ATTACHMENT B 2 Planning and Development Department February 3, 2023 Abandonment Staff Report: ABND 220064 Project# 22-3017 Council District: 8 Location: Central Avenue and Pierce Street Applicant: Downtown Phoenix Resi Owner, LLC, c/o Clayco, Inc Request to abandon: To abandon the 8-foot public utility easement along south property of APN 111-43-151. Purpose of request: The applicant states this is to accommodate the redevelopment of the Site which is currently unimproved with a mixed-use development. 3 City Staff Comments and Recommendations: Street Transportation Department – Maja Brkovic No comment received. PDD Civil Reviewer – Bonnie Montero No comment received. PDD Traffic – Derek Fancon Recommend Approval. Water Services Department – Donald Reynolds WSD has One stipulation for the requested abandonment area. The existing water meter off of Pierce St. shall be relocated onto the public right of way or a water easement around the existing water meter in accordance with plans submitted to and approved by the Planning and Development Department. All work is to be done by City forces at no expense to the City of Phoenix. PDD Site Planning – Danielle Bohannan Recommend approval of the abandonment of the 8 ft PUE on this site and have no stipulations about it. PDD Village Planner – Sarah Stockham 4 No comment received. Street Transportation Utility Coordination – Rozanna Brown: The Street Transportation Department Utility Coordination section has no comments. Utility Comments The request was also routed to outside utility companies for their input. Listed below are the responses from each utility. Cox – Zach Lawson This will be a conflict review, Cox has facilities in the area. Southwest Gas – Susan Mulanax After reviewing the plans for the above-referenced project, it has been determined that while there are no apparent conflicts between the Southwest Gas (SWG) system and your proposed abandonment of the public utility easement, SWG does have existing service lines to the property crossing the subject PUE. Please direct applicant to SWG’s Conflict Management contact, Andrew Saks, at Andrew.saks@swgas.com. Arizona Public Service – Roger Watkins Recommend Approval. CenturyLink – VeShon Sheridan No comments received. Salt River Project – Michael Laguna Salt River has no objection to the Abdon of this 8-foot Public Utility Easement along the south property of APN 11-43-151. This is in an Arizona Public Service serving area. Stipulations of Conditional Approval The request of abandonment ABND 220064 is conditionally approved and the following stipulations will need to be met: 1. All utilities must be resolved and approved by each affected utility company. All work is to be done by each affected utility company at no expense to the affected utility company. Verification of conflict resolutions by the applicant and provided to the City of Phoenix, Planning and Development Department. 2. The existing water meter off of Pierce Street shall be relocated into the public right of way, or a water easement shall be retained around the existing water meter in accordance with plans submitted to and approved by the Planning and Development Department. All work is to be done by City forces at no expense to the City of Phoenix. 5 3. The abandonment must be completed within two years from the conditional approval decision dated February 3, 2023. This conditional approval has been reviewed and approved.
