The rezoning will facilitate commercial development. Since no plan of development is included
with this request, a subsequent plan of development application will be required for administrative
approval. The proposal is for an RV and boat storage facility.
•
The site will be served initially by well and septic, although the developer may connect the site to
the West End Water Company in the future. Until the site is served by sewer, the C-3 CUPD zoning
district limits entitled uses to RV/boat storage facilities, self-storage facilities, and other uses that
MCESD determines can be accommodated by septic systems. The Arizona Fire & Medical
Authority (North County Fire & Medical District) and MCSO will provide fire and police protection,
respectively.
•
The site is located at the southwest corner of Dove Valley Road and Grand Avenue (US 60). The
developer intends to provide access to the site at Dove Valley Road. There will be no direct access
onto Grand Avenue.
•
The site is within the City of Surprise’s municipal planning area. Surprise has no objection to the
case.
•
Per the Maricopa County Framework 2040 Comprehensive Plan, the subject site is within the Area
of Municipal Influence due to its location within Surprise’s MPA. However, since the White Tank /
Grand Ave. Area Plan and the Surprise General Plan designate the site for rural residential uses,

the site is also within the Rural Service Area. Framework 2040 recognizes that certain commercial
uses may be acceptable in the Rural Service Area upon satisfying acceptable alternative solutions
consistent with the Urban Solutions for Urban Development (USUD) strategy. An RV and boat
storage facility is generally compatible with the Rural Service Area. The site’s location at the
corner of a principal arterial and an ADOT-maintained highway also supports the establishment
of a limited commercial use.
•
There are no outstanding concerns from reviewing agencies. Staff received one item of support
and no items of opposition. It will require a majority vote of a quorum to approve Z260005.
Commission
Recommendation:
On 6/11/26, the Commission voted 6-0 (motion by Commissioner
Leighton D4, seconded by Chair Milhaven D2) to adopt a motion
recommending the Board of Supervisors approve Z260005 subject
to conditions ‘a’ – ‘k’:
a.
Development of the site shall be in substantial conformance with the Zoning Exhibit
entitled “Dove Valley – Rezone,” consisting of one full-size sheet, dated March 16, 2026,
and stamped received March 19, 2026, except as modified by the following conditions.
Staff may determine slight refinements to remain in substantial conformance with the
approved site plan. Minor and major amendments to the site plan will be determined in
accordance with Chapter 3 of the Maricopa County Zoning Ordinance.
b.
Development of the site shall be in substantial conformance with the Narrative Report
entitled “Dove Valley & US 60: Grand RV & Boat Storage,” consisting of five pages, dated
March 18, 2026, and stamped received March 19, 2026, except as modified by the
following conditions.
c.
The following Planning Engineering conditions shall apply:
1.
Any new site improvements will require a Plan of Development (that will require an
engineered grading and drainage plan) and Traffic Impact Study.
2.
The site contains areas of regulated floodplains (FEMA Zone AE). Any
development must comply with the Floodplain Regulations of Maricopa County.
3.
Given the site’s proximity to US-60, the applicant shall inquire of any concerns with
ADOT via their red-letter process (email redletter@azdot.gov).
4.
Without the submittal of a plan of development, no development approval will be
inferred by the engineering review, including, but not limited to drainage design,
access and roadway alignments. These items will be addressed as development
plans progress and are submitted to the County for further review and/or
development.
5.
Engineering review of planning and/or zoning cases is for conceptual design only.
All development and engineering design shall be in conformance with Section 905
of the Maricopa County Zoning Ordinance; Drainage Policies and Standards;
Floodplain Regulations for Maricopa County; MCDOT Roadway Design Manual;
and current engineering policies, standards and best practices at the time of
application for construction.

6.
Based on the conceptual design nature of the information submitted, changes to
the site layout and/or a reduction in the number of building lots may be
necessitated by the final engineering design of the drainage infrastructure.
7.
Detailed Grading and Drainage (Infrastructure) Plans must be submitted with the
application for Building Permits.
d.
All buildings shall be subject to noise attenuation per ARS § 28-8482(B).
e.
Until such time as the site is served by sewer, the C-3 CUPD zoning district limits entitled
uses to the following:
1.
Self-storage facilities.
2.
RV and boat storage facilities.
3.
Other uses acceptable to the Maricopa County Environmental Services
Department (MCESD) that can be accommodated by septic systems.
4.
Accessory uses incidental to the above.
f.
The C-3 CUPD zoning district prohibits the following uses:
1.
Adult-oriented facilities.
2.
Marijuana establishments.
3.
Halfway houses.
4.
Boarding houses.
g.
A public water system and public sewer system shall be required prior to establishment
of any use at the determination of MCESD per condition ‘e.3’.
h.
Administrative approval of a Plan of Development will be required prior to approval and
issuance of construction permits to develop and establish use of the site. Prior to
issuance of a building permit, written confirmation will be required from the emergency
fire protection jurisdiction having authority that the facility has been designed in
accordance with their regulations and requirements, and that emergency fire protection
service will be provided to the facility. Prior to issuance of the certificate of occupancy,
local fire protection jurisdiction review and approval will be required.
i.
Noncompliance with any of the conditions assigned to the approval of this Zone Change
by the Maricopa County Board of Supervisors may be grounds for revocation in
accordance with the requirements and procedures set forth in the Maricopa County
Zoning Ordinance.
j.
The property owners and their successors waive claim for diminution in value if the County
takes action to rescind approval due to noncompliance with conditions.
k.
The granting of this change in use of the property has been at the request of the applicant,
with the consent of the landowner. The granting of this approval allows the property to

enjoy uses in excess of those permitted by the zoning existing on the date of application,
subject to conditions. In the event of the failure to comply with any condition, the property
may be considered for revocation to the zoning that existed on the date of application. It
is, therefore, stipulated and agreed that either revocation due to the failure to comply with
any conditions does not reduce any rights that existed on the date of application to use,
divide, sell, or possess the property, and that there would be no diminution in value of the
property from the value it held on the date of application due to such revocation of the
Zone Change. The Zone Change enhances the value of the property above its value as of
the date the Zone Change is granted and reverting to the prior zoning results in the same
value of the property as if the Zone Change had never been granted.

Project Summary:
1.
The applicant is requesting a zone change from Rural-43 and C-2 to C-3 CUPD for an
approximately 8.7-acre property located at the southwest corner of Dove Valley Road and Grand
Avenue (US 60) in the Wittmann area. This is also within the Wickenburg Highway Scenic Corridor
(WHSC) overlay zoning district. The applicant is not presently proposing a plan of development
(POD). However, the purpose of this request is to obtain the zoning entitlements necessary to
support a planned RV and boat storage facility.
2.
The applicant’s request specifically proposes RV and boat storage for this location because such
uses are generally quiet, generate very little traffic, have little impact on utilities and none on
schools, provide a service for nearby communities, and serve as a useful buffer between rural
residential uses and more intense uses such as highways, railways, and other commercial uses.
Since there is no POD with this application, final site design and operational details such as hours
of operation are subject to change. Even so, the narrative assures that all C-3 and WHSC
development standards will be met when the POD is ready for review, that sight visibility triangles
will be accommodated with any proposed driveways, and that outdoor nighttime lighting will be
limited to the minimum amount necessary for safety.
3.
The project area corresponds with four parcels plus a portion of one additional parcel. Together
these parcels form a triangular “island” surrounded by perimeter rights-of-way. The Grand Avenue
right-of-way borders the site to the northeast, the current alignment of Dove Valley Road borders
the site to the northwest, and the historic section line alignment of Dove Valley Road borders the
site to the south. The developer intends to provide access to the site at the current alignment of
Dove Valley Road. The subject area is bisected by a narrow floodway that runs through much of
the westernmost of the five subject parcels (APN 503-17-001D). The applicant’s request only
extends from Grand Avenue to the eastern edge of the floodway. The portion of APN 503-17-001D
west of and including the floodway is not included with this request. The applicant has provided
a legal description in the zoning exhibit corresponding with the intended project area.
4.
The site is located within the WHSC overlay zoning district Class 2 and Class 4 intensity levels as
regulated in MCZO Section 704. Class 2 corresponds with the County jurisdiction from 300’ to ¼
mile (1,320’) out from the Grand Avenue right-of-way, whereas Class 4 corresponds with County
jurisdiction within 300’ of the Grand Avenue right-of-way. The Class 2 development regulations
are minimal, only requiring structures to adhere to a maximum height of 33’ and otherwise
requiring development to observe the goals and policies established in the WHSC plan to the
extent practicable. The Class 4 development regulations are more specific. In addition to the 33’
height restriction, the Class 4 standards also establish specific screening regulations, requiring
that parking areas, loading areas, and outdoor storage areas be screened from the highway with
a solid fence and that drought-tolerant landscaping be placed in front of any wall facing the
highway. Loading and outdoor storage areas must also be placed to the rear of any principal
building(s). The Class 4 standards also require a minimum landscape setback of 25’ from the
highway right-of-way, within which natural desert vegetation must be preserved or provided.
Finally, the Class 4 standards restrict direct access to Grand Avenue. The applicant is not
requesting modifications to any of the WHSC standards.
5.
The applicant is not requesting any modifications to the C-3 development regulations except to
prohibit specific uses that may not be compatible nor desirable with nearby rural residences in
the Wittmann area. The applicant specifically requests that the CUPD overlay zoning district
restrict adult-oriented facilities, marijuana dispensaries and/or establishments, halfway houses,
and boarding houses. Below is the proposed CUPD table from the applicant’s project narrative.

White Tank / Grand Avenue Area Plan (updated December 6, 2023): The county’s area plan
designates the site for rural single-family uses, which generally limits residential densities to no
more than one dwelling unit per acre. For sites 40 acres or fewer, the county’s comprehensive
plan does not require an amendment to the governing land use plan if a zone change furthers a
preponderance of planning policies.
10.
Framework 2040 Maricopa County Comprehensive Plan (updated May 20, 2026): Although the
County’s comprehensive plan generally defers to the White Tank / Grand Avenue area plan for the
designation of land uses, the comprehensive plan nevertheless establishes a strategic framework
(Municipal-Rural Influence Framework) for managing urban and rural development across the
unincorporated county. The municipal and rural influence area classifications serve as guides for
determining where urban and rural development is most appropriate. Per the map provided on
page 95 of the plan, the subject site is within an area of municipal influence due to its location
within the Surprise MPA. However, since the area plan and the Surprise General Plan designate
the site for rural residential uses, the site is also considered to be within a rural service area. The
comprehensive plan recognizes that certain commercial uses may be acceptable in the rural
service area upon satisfying acceptable alternative solutions consistent with the plan’s “urban
solutions for urban development” strategy.
11.
Surprise 2040 General Plan (updated July 30, 2024): The site is within the City of Surprise’s
municipal planning area. Surprise’s general plan places the site within its neighborhood character
area, which supports residential development of rural, suburban, or urban densities. The general
plan also establishes a rural residential overlay that includes the project area. The stated focus
of this overlay is to recognize, preserve, protect, and enhance the character and quality of existing
residential development in a manner that promotes traditional rural lifestyles, keeping of
livestock, farmland and agricultural enterprises, open space, scenic vistas, recreation, and historic
resources, while also allowing for compatible surrounding development. The general plan goes
on to advise that future development within this overlay should be compatible with the rural
character of the area. To ensure compatibility, proposed development can incorporate such
measures as natural landscape buffering adjacent to existing residential uses and limiting traffic
generation so that the existing rural roadways can be maintained as practicable.
Public Participation Summary:

The applicant complied with the requirements of the citizen review process by posting the site
and sending notification by first class mail to interested parties and adjacent property owners
within 300’ of the site. Two signs were posted onsite in accordance with applicable regulations.
13.
Staff received correspondence from the Arizona Fire & Medical Authority (AFMA), the Maricopa
County Sheriff’s Office (MCSO), and Luke Air Force Base all confirming no objections. The Arizona

Department of Transportation (ADOT) confirmed that it is neutral on zoning matters but will want
to review a site plan and traffic impact analysis or statement (TIA/TIS) when available (these
resources will be available when the POD is submitted for review). The Arizona Game & Fish
Department (AGFD) provided a list of general recommendations for the developer to pursue when
creating the POD. Finally, the City of Surprise Planning Manager for Community Development
provided comments on the case. These comments confirm that the site is within the general
plan’s neighborhood character area and is also subject to a transit-oriented development overlay.
However, while the site is within Surprise’s municipal planning area, it is not adjacent to its
municipal boundaries. The comments from Surprise advise that, while RV storage is consistent
with Surprise’s own C-3 zoning district, C-3 zoning is not supported within the neighborhood
character area. Nevertheless, the City did not express opposition to the request.
14.
Staff received one letter of support from the public – a neighbor who owns 675 acres due south
of the subject site across the historic Dove Valley Road alignment. This neighbor’s property was
rezoned in 2022 to include R1-6 RUPD zoning and C-1 zoning. The purpose of this rezoning was
to entitle the future development of the Walden Ranch and Rancho Maria communities. Per the
letter of support, the C-1 zoning was requested due to the potential for commercial demand
adjacent to Grand Avenue. Furthermore, the neighbor’s letter argues that the future residential
properties will inevitably generate demand for offsite RV and boat storage and that the requested
C-3 zoning is more appropriate zoning than the existing Rural-43 zoning.

Staff Analysis:

Framework 2040 provides framework for the county’s long-standing policy of “urban solutions for
urban development”. This strategy aims to guide staff’s analysis of zone change requests by
identifying whether the infrastructure and services available to a site can support proposed
development over time.
17.
Staff believes that an RV and boat storage facility would make for an appropriate land use at the
proposed location. Although the site is considered to be within the rural service area as defined
in the comprehensive plan, RV and boat storage facilities generally require minimal new
infrastructure, utilities, and public services. Such uses generate low volumes of traffic and can
generally be accommodated on septic systems due to the low number of employees and patrons
onsite at any given time (in fact, some facilities are unmanned except for occasional maintenance
and customer visits). As for water, whether a public water system (PWS) would be required is
determined by the Environmental Services Department (MCESD) based on the number of people
served or the number of service connections made per day. A PWS does not necessarily require
a connection to a water service provider; an onsite well can meet this requirement if certain
criteria are met. The site is within the jurisdiction of the West End Water Company and the project
narrative attests that a connection could be made if necessary. Finally, the site is within the
jurisdiction of an established fire authority, that being the North County Fire & Medical District, a
division of the Arizona Fire & Medical Authority.
18.
In summary, the envisioned use of the site is generally compatible with the rural service area. The
site’s location at the corner of a principal arterial and an ADOT-maintained U.S. highway also
supports the establishment of a limited commercial use. That said, because of the limited
services presently available to the site, and considering that the project narrative specifically

proposes an RV and boat storage facility, staff believes it would be appropriate to limit the uses
allowed onsite to self-storage facilities and RV / boat storage facilities, as well as other uses
acceptable to MCESD that can be accommodated on septic systems (plus accessory uses
incidental to these), with the CUPD overlay. Staff believes this is appropriate until such time as
water and sewer services are both established in the area.
Recommendation:
19.
Staff recommends the Commission adopt a motion recommending that the Board of Supervisors
approve Z260005 subject to the following conditions ‘a’ – ‘k’:
a.
Development of the site shall be in substantial conformance with the Zoning Exhibit
entitled “Dove Valley – Rezone,” consisting of one full-size sheet, dated March 16, 2026,
and stamped received March 19, 2026, except as modified by the following conditions.

Purpose of Request
This request seeks to rezone the subject parcel (APN’s 503-17-016R, 503-17-016M, 503-
17-016K, 503-17-016H, and portion of 503-17-001D), the “Property” from Rural-43 and C-
2 (Intermediate Commercial) to C-3 (General Commercial) with a Commercial Unit Plan of
Development (CUPD) overlay with respect to the Wickenburg Highway Scenic Corridor
(WHSC), for the entire 8.68 gross acres. The parcel is located on the Southwest corner of
Dove Valley Rd. & U.S. Hwy 60 (Grand Ave.). The requested change to C-3 CUPD WHSC
would allow for the use of RV and Boat storage, which is a low traffic generator and an
appropriate use for the underutilized land. Specifically, the benefits of RV and Boat storage
are that:
• RV and Boat storage facilities are generally quiet
• They provide an excellent buffer between zones
• They create very little traffic
• They have little impact on utilities
• They have no impact on schools
• They provide a community service
Description of Proposal
The subject Property is currently undeveloped, with the long-term objective of developing
an RV and Boat storage facility. A Plan of Development (POD) will be submitted in a future
phase of the entitlement process. To ensure compatibility and minimize any potential
impacts, the developer will comply with all required setbacks, provide adequate screening,
and limit outdoor lighting to the minimum necessary for safety. RV and Boat storage
facilities generate very low traffic volumes, especially during peak commuting hours, and
typically require minimal customer parking as visits are short in duration.
A conceptual site plan is included with this rezoning request. This site plan shows the
estimated parking, placement, office location, and most likely placement for entrances and
exits. However, any future commercial development will be in compliance with the
Maricopa County Zoning Ordinance (MCZO) C-3 zoning district standards and regulations
per Section 504 and will be in compliance with C-3 development standards and regulations,
meeting setbacks, signage criteria, etc. Operational details including number of
employees, hours of operation, and other information will be discussed when the POD is
submitted in the future. Lastly, all materials and screening will comply with the WHSC.
Commercial Unit Plan of Development (CUPD)
The Commercial Unit Plan of Development (CUPD) Overlay is proposed to deviate the
MCZO standards for allowable uses in the C-3 district.
Given the range of uses permitted under C-3, flexibility exists to prohibit certain uses that
may not be the best fit for the property.

The Property is split into different zones based on their distance from the right-of-way of
the US 60 Highway. This site is within the Class 4 (0 to 300’ from the Highway) the most
restrictive and Class 2 (300’ to 1,320’ from the Highway) less restrictive zone. After review,
the Property will comply with all standards required by the WHSC. Specifically, the
developed Property will be around 70 feet from the edge of the hard shoulder, and the
property will follow all proper screening procedures by adhering to a minimum landscape
setback of 25’ from the US 60 right-of-way as required in the Class 4 intensity zone.
Relationship to Surrounding Properties
The property is surrounded by a plethora of uses. To the Southeast, properties are zoned
mostly commercial along Route 60 either C-1 or C-2. To the North and West, the properties
are RU-43, and surrounding properties consist primarily of undeveloped land and any
single-family residential uses are approximately 450 feet away from the potential use.
Justification for Use
The proposed rezoning for a RV and Boat storage facility represents a compatible, low-
impact land use that meets a clear community need while enhancing safety, accessibility,
and protection of surrounding properties.
The proposed rezoning to allow an RV and Boat storage facility address a demonstrated
need within the community while maintaining compatibility with surrounding land uses. The
facility would provide a convenient and accessible storage option for local residents and
travelers, reducing the burden of traveling long distances to find secure RV and Boat
storage. Most lots in Wittman area are under 7,000 square feet which is not conducive to
RV and Boat storage. Not only do those under 7,000 square feet exist in Wittman but also
the nearby communities such as Mobile Gardens and Circle City. Currently, there are no
comparable storage facilities within approximately six miles of the site, highlighting a clear
gap in available services. This RV and Boat storage facility provides necessary local
storage for the nearby neighborhoods.

The location is well suited for this use due to its proximity to Grand Avenue, making it the
only storage facility bordering this roadway northwest of 163rd Ave. This strategic
placement allows for direct access from a major corridor, minimizing traffic through nearby
residential streets and enhancing overall circulation and safety. By offering an organized,
designated storage location, the facility also helps prevent Boats and RVs from being
parked on public streets or residential properties, which can negatively impact
neighborhood appearance and safety.
The proposed development makes efficient use of existing infrastructure, including
established road access and utilities, and does not require significant public investment.
Overall, the requested rezoning supports responsible land use planning, meets an unmet
community need, and provides a low-impact commercial use that is compatible with the
surrounding area while offering long-term benefits to residents and the broader community.
Location and Accessibility
The site is located along West Dove Valley Road, an urban principal arterial, with proposed
access exclusively from West Dove Valley Road. This sufficient access point ensures
minimal disturbance to surrounding properties. A floodway exists to the west of the site on
the remaining portion of APN 503-17-001D, which is excluded from the proposed
development area. RV and Boat storage facilities generate very low traffic volumes,
especially during peak commuting hours, and typically require minimal customer parking
as visits are short in duration.
Compliance with City/Town General Plan
The site is located within Surprise Planning District. However, the site is not annexable due
to the the fact that the site is not adjacent to any Surprise parcels. Surprise General Plan
2040 classifies this site as Neighborhood. The general plan for Surprise shows a large area
of land directly to the north of the site across Grand Avenue as Employment. This General
Plan shows that the property in actuality acts as a buffer from the intensive future
employment to the future uses southwest of Grand Avenue. This includes a letter of support
from the property to the south that plans to have traditional small lot single-family suburban
housing to the south. While RV and Boat storage are not considered a residential use, it
does serve the nearby residents. RV and Boat storage facilities are quiet and will provide
a good buffer between the future employment district, highway corridors, and any future
residential homes. RV and Boat storage generate very little traffic and has a low impact on
utilities. Taking into consideration the size of the Property, (8.68± acres) its impact will be
similar to residential uses.
Circulation System
Dove Valley Road is a roadway under the Maricopa County Department of Transportation
(“MCDOT”) roadway classification system. This road only receives 858 vehicles a day.

Surrounding roadways in the area are generally unimproved and lack curb, gutter, and
sidewalk. Dove Valley Road along the property frontage is a two-lane roadway with a
center turn lane under the jurisdiction of Maricopa County, while Grand Avenue is under
the jurisdiction of the Arizona Department of Transportation (ADOT). Grand Avenue has a
traffic count of around 39,620 vehicles a day.
Regarding traffic numbers for RV and Boat storage facilities, these facilities commit low
traffic volumes compared to almost any other commercial, industrial, and even residential
use. The Institute of Transportation Engineers (ITE) publication Trip Generation, 11th
Edition, 2021, give these types of facilities a low rate of use. Therefore, RV and Boat
storage will most likely not significantly increase the number of vehicles using this roadway
as before and would be better than most other uses for the property.
Moreover, to access Dove Valley Road off Grand Avenue, there are deceleration lanes,
and this site should not decrease any visibility for cars entering Dove Valley to Grand Ave.
Additionally, sight visibility triangles (each measuring 25’ x 25’) will be maintained on either
side of each driveway entrance as well as the property corner where Dove Valley Road
and Grand Ave intersect.
Development Schedule
A Plan of Development (POD) for development of the Property will be applied subsequent
to obtaining commercial zoning entitlement approval once specific land use(s) are
determined. If approved POD submittal will likely take place in the fourth quarter of 2026;
however, this date range is preliminary and subject to change.

Conclusion
The requested rezone to C-3 CUPD WHSC is justified given the location to major
crossroads, future development of the area, and proximity to communities that utilize RV
and Boat storage facilities. Given this location, the Property is not suitable for rural or large-
scale residential development. This use conforms with the purpose of the C-3 zoning
district, as it is suitable for nearby properties and the site has access to a major street or

1. Any new site improvements will require a Plan of Development (that will require
an engineered grading and drainage plan) and Traffic Impact Study.
2. The site contains areas of regulated floodplains (FEMA Zone AE). Any
development must comply with the Floodplain Regulations of Maricopa
County.
3. Given the site’s proximity to US-60, the applicant shall inquire of any concerns
with ADOT via their red-letter process (email redletter@azdot.gov ).
4. Without the submittal of a plan of development, no development approval will
be inferred by the engineering review, including, but not limited to drainage
design, access and roadway alignments. These items will be addressed as
development plans progress and are submitted to the County for further review
and/or development.
5. Engineering review of planning and/or zoning cases is for conceptual design
only. All development and engineering design shall be in conformance with
Section 905 of the Maricopa County Zoning Ordinance; Drainage Policies and
Standards; Floodplain Regulations for Maricopa County; MCDOT Roadway

foot half street from the center line per the Maricopa County Zoning Ordinance

The Maricopa County Environmental Services Department (MCESD) has completed review
for the Grand RV and Boat Storage planning case(s). Please note the following MCESD
requirements for site development:
Onsite Wastewater (Septic) –
A Notice of Intent to Discharge application for a septic system is required for any
construction. Application must be submitted to the MCESD Onsite Wastewater Program.
•
Wastewater is not permitted to discharge to an adjacent parcel’s septic system.
•
If conducting food service in unincorporated Maricopa, a grease trap will be
required by Onsite Wastewater program.
•
Setback requirements must be maintained per Arizona Administrative Code, Title
18, Chapter 9, Article 312, C (Features Requiring Setbacks).
Dependent/independent recreational vehicles cannot discharge wastewater to any septic
system(s). A dump station/holding tank will be required for any onsite recreational vehicle
wastewater dumping under a 4.14 General Permit: Sewage Vault.

The Department appreciates the opportunity to provide an evaluation of impacts to wildlife or wildlife habitats
associated with this project. Based on the information provided, the Department offers the following general
recommendations:
Minimize the potential introduction or spread of exotic invasive species, including aquatic and terrestrial
plants, animals, insects and pathogens. Precautions should be taken to wash and/or decontaminate all
equipment utilized in the project activities before entering and leaving the site. Please review the
Arizona Department of Agriculture’s website for a list of prohibited and restricted noxious weeds and
the Arizona Native Plant Society for recommendations on control methods. To view a list of
documented invasive species or to report invasive species in or near your project area
visit iMapInvasives - a national cloud-based application for tracking and managing invasive species.
If proposed ground disturbance (both temporary and permanent) will meet or exceed 0.25 acre in areas
with native vegetation, please ensure the project complies with Arizona Native Plant Law regulations.
A Native Plant Inventory may need to be conducted to identify, record, and coordinate plant salvage
efforts for species that are Protected under the Arizona Native Plant Law. In addition, the applicable
land management agencies should be consulted regarding guidelines for revegetation efforts.
If vegetation removal/trimming is required, the Department recommends that a qualified biologist
survey for nesting birds within the project area if work will be conducted during the breeding season.
The trees and/or vegetation within the project area may provide nesting opportunities for avian species
that are regulated under the Migratory Bird Treaty Act (MBTA) and protected under state law.
Breeding season for birds in the project vicinity is generally January through late June. If it is
anticipated the project will not be in compliance with MBTA, the Department also recommends
contacting the U.S. Fish and Wildlife Service (USFWS) for technical assistance and options to
comply with the MBTA.

Thank you for allowing Luke AFB to make comments on the zone change request for Dove Valley RV Storage.
This request will not have a negative impact on Luke AFB Flight Operations. Because the site is located within the
“territory in the vicinity of a military airport” it may be subjected to approximately 170 over flights per day. We
recommend a strong notification program to inform future applicants/occupants about Luke AFB operations; to
include review of the sound attenuation requirements found in A.R.S. §28-8482.
If applicable, it should be noted that certain investments and real estate transactions within the military
installation footprint of Luke AFB may be subject to review by the Committee on Foreign Investment in the United
States (CFIUS) to determine the effect of such transactions on the national security of the United States. The
CFIUS regulations, Foreign Investment Risk Review Modernization Act of 2018 (FIRRMA) provisions, and related
resources can be found on the Department of the Treasury’s website: http://www.treasury.gov/cfius.

Thank you for the opportunity to review and comment on the proposed Grand RV & Boat Storage. Based
on the information provided, the applicant seeks a rezone from Rural 43 WHSC and C-2 to C-3 CUPD
WHSC without a Plan of Development.
The City of Surprise provides the following comments/recommendations:
1. The subject property is outside of, and not abutting, the current Surprise municipal boundaries,
though it is within the Surprise Planning Area. The land use designation of the subject property
within the Surprise 2040 General Plan is Neighborhood Character Area with a Transit Oriented
Development (TOD) overlay.
a. The requested Maricopa County zoning of C-3 CUPD is akin to the Surprise C-3 Regional
Commercial zoning designation. RV Storage is a conditionally permitted use within the
C-3 zoning district. However, C-3 is not a supported zoning district within the
Neighborhood Character Area.
