The C-2 CUPD will facilitate the construction of storage garages for individual ownership. 
Although no plan of development is incorporated into this request, there will be a subsequent 
condominium plat submitted for administrative approval.  
 
• 
Water service to the site is identified as Arizona Water Company. Wastewater is via individual on-
lot septic systems. The lack of sewer necessitates limited land uses and the CUPD overlay is 
applied to limit entitled uses to only uses that can be accommodated via septic system 
acceptable to the Planning & Development and Environmental Services departments. 
 
• 
Perryville Rd. forms the eastern boundary of the site. It is under the jurisdiction of the City of 
Goodyear. A Traffic Impact Statement will be required to be submitted and approved by the City. 
 
• 
The County’s comprehensive plan designates the site within a Rural Development Area (RDA). 
The subject site is within the City of Buckeye’s municipal planning area and is designated Rural 
in their general plan. Development within this designation should retain rural character of the 
surrounding area and be low density. Although the area falls under the City of Buckeye municipal 
planning area, the City of Goodyear jurisdiction is immediately east of the property boundary 
encompassing Perryville Rd. The City of Buckeye is not opposed to the C-2 CUPD zoning but 
expressed concern with the potential for all commercial uses normally entitled with C-2 zoning.

There are no outstanding concerns from reviewing agencies. There is no known opposition.

Recommendation: 
On 6/11/26, the Commission voted 6-0 (motion by Commissioner 
Leighton D4, seconded by Chair Milhaven D2) to adopt a motion 
recommending the Board of Supervisors approve Z260009 subject 
to conditions ‘a’ – ‘i’:  
 
 
a. 
Development of the site shall be in substantial conformance with the Zoning Exhibit 
entitled “Zone Change with Overlay 4606 N Perryville Rd: Luxury Garage Condominiums“, 
consisting of 1 full-size sheet, dated 5/11/26, and stamped received 5/12/26, except as 
modified by the following conditions. Staff may determine slight refinements to remain in 
substantial conformance with the approved site plan.  Minor and major amendments to 
the site plan will be determined in accordance with Chapter 3 of the Maricopa County 
Zoning Ordinance. 
 
b. 
Development of the site shall be in substantial conformance with the Narrative Report 
entitled “Zone Change with Overlay 4606 N Perryville Rd: Luxury Garage Condominiums”, 
consisting of 11 pages, dated 5/11/26, and stamped received 5/12/26, except as modified 
by the following conditions. 
 
c. 
The following Planning Engineering conditions shall apply: 
1. A traffic impact study is required with the Plan of development.  The traffic impact 
study (TIS) shall be approved by the City of Goodyear since access will be via Perryville 
Road which is under Goodyear jurisdiction. a. Since access is via Perryville Road, City 
of Goodyear roadway, please seek a TIS review waiver from MCDOT. 
2. Engineering and drainage review was based on a zone change without a plan of 
development. Therefore, without the submittal of a precise plan of development, no 
development approval is inferred by this review, including, but not limited to number 
of proposed building lots/units, drainage design, access and roadway alignments. 
These items will be addressed as development plans progress and are submitted to 
the County for further review and/or entitlement. 
3. Engineering review of re-zone cases is conceptual in nature. All development and 
engineering design shall be in conformance with Section 905 of the Maricopa County 
Zoning Ordinance; Drainage Policies and Standards; Floodplain Regulations for 
Maricopa County; MCDOT Roadway Design Manual; and current engineering policies, 
standards and best practices at the time of application for construction. 
4. The County does not provide fire service, therefore, it is incumbent that the applicant 
seek service and approval of plans from the jurisdictional fire service provider.   
 
d. 
The following Maricopa County Environmental Services Department (MCESD) conditions 
shall apply: 
1. A Notice of Intent to Discharge application for a septic system is required for any 
construction. Application must be submitted to the MCESD Onsite Wastewater 
Program.  
2. Wastewater is not permitted to discharge to an adjacent parcel’s septic system.  
3. If conducting food service in unincorporated Maricopa, a grease trap will be required 
by Onsite Wastewater program.  
4. Setback requirements must be maintained per Arizona Administrative Code, Title 18, 
Chapter 9, Article 312, C (Features Requiring Setbacks).

5. Dependent/independent recreational vehicles cannot discharge wastewater to any 
septic system(s). A dump station/holding tank will be required for any onsite 
recreational vehicle wastewater dumping under a 4.14 General Permit: Sewage Vault.    
6. Projected flows between 3,000 and 24,000 gallons per day require a 4.23 General 
Permit and may require nitrogen treatment.

8. An Approval to Construct application is required and must be submitted to MCESD’s 
Subdivision & Infrastructure Program for water, reclaimed water and/or wastewater 
system infrastructure. 
9. A Water Service Agreement signed by the Utility is required and must be submitted to 
MCESD’s Subdivision & Infrastructure Program if the site/development will be 
provided with water and/or reclaimed water by a Utility.  A Capacity Assurance Form 
issued by the Utility is required to MCESD’s Subdivision & Infrastructure Program if the 
site/development wastewater service is being provided by a Utility. 
 
e. 
The applicant will not oppose annexation into a municipality should it become available 
at any future point. 
 
f. 
The following CUPD standards shall apply:  
1. Maximum Height: 30’ 
2. Uses allowed: Until such time as the site is served by sewer, uses on the site shall be 
limited to garage storage units including condominiums for individual ownership and 
ancillary uses; and other uses acceptable to the Maricopa County Environmental 
Services Department (MCESD) that can be accommodated by septic systems and 
ancillary uses. 
3. Prohibited land uses: Adult oriented uses, Marijuana uses, boarding houses, halfway 
houses, Recovery Communities, Liquor Stores, Cash Advance and Payday Loan 
Facilities, Pawn Shops, Group care facilities and hospitals, Mobile Home Sales & 
Storage, maintenance of agricultural equipment 
 
g. 
Prior to plan of development approval the applicant shall provide documentation that they 
have contacted (and any response) the City of Buckeye requesting the city’s specific site 
design and landscaping requests for incorporation into the garage condominium project.  
 
h. 
Administrative approval of a Plan of Development and/or Final Plat will be required prior 
to approval and issuance of construction permits to develop and establish use of the site. 
Prior to issuance of a building permit, written confirmation will be required from the 
emergency fire protection jurisdiction having authority that the facility has been designed 
in accordance with their regulations and requirements, and that emergency fire protection 
service will be provided to the facility. Prior to issuance of the certificate of occupancy, 
local fire protection jurisdiction review and approval will be required. 
 
i. 
The granting of this change in use of the property has been at the request of the applicant, 
with the consent of the landowner.  The granting of this approval allows the property to 
enjoy uses in excess of those permitted by the zoning existing on the date of application, 
subject to conditions.  In the event of the failure to comply with any condition, the property 
may be considered for revocation to the zoning that existed on the date of application.  It 
is, therefore, stipulated and agreed that either revocation due to the failure to comply with 
any conditions, does not reduce any rights that existed on the date of application to use, 
divide, sell or possess the property and that there would be no diminution in value of the 
property from the value it held on the date of application due to such revocation of the

Zone Change.  The Zone Change enhances the value of the property above its value as of 
the date the Zone Change is granted and reverting to the prior zoning results in the same

Project Summary: 
 
1. 
The request seeks to rezone two parcels, APNs 502-29-026J & 502-29-026H, under unified C-2 
CUPD zoning. The cumulative size of the properties are approximately 9.75 acres and are located 
midblock between Camelback Rd. & Indian School Rd. The C-2 CUPD will facilitate the 
construction of storage garages for individual ownership. This type of development will require a 
final plat as a plan of development. 
 
2. 
Current site conditions include a honeybee production facility in a 29,000 sq. ft. building on parcel 
502-29-026J and a single-family residence on parcel 502-29-026H. The application was filed on 
3/11/2026 and a TAC meeting was held on 4/21/2026. This application does not include a precise 
Plan of Development (POD), so operational and site details will be submitted with a future POD 
application for administrative review and approval prior to commercial construction permit/s to 
establish the use. 
 
3. 
Building height deviation and use restrictions are requested as part of the CUPD overlay. The 
following CUPD table shows a reduction in the maximum height from 40’ to 30’ and is requested 
to limit visual impacts from adjacent residential development. The CUPD would restrict uses to 
garage condominiums for individual sale & ownership.

immediately east of the property’s boundaries encompassing Perryville Rd. 
 
Public Participation Summary:

The applicant received no opposition to this request after performing all required citizen 
participation outreach. The applicant complied with required posting and notification 
requirements. The citizen results report indicated that there was no public comment to the 
application. Staff has not received any public comment on the application.  
 
Outstanding Concerns from Reviewing Agencies:

The City of Buckeye requested the CUPD limit uses to garage condominiums and to codify the 
City’s development and landscape standards as noted in an e-mail dated 5/12/26. The e-mail 
referenced that the City is not opposed to the proposed development of a luxury storage unit, but 
were concerned with the potential for all commercial uses normally entitled with C-2 zoning. The 
City recommended limiting the use to just the garage storage with enhanced design and 
landscaping requirements. The applicant ensured staff they would meet with City staff and a 
revised narrative was provided with a list of the restricted uses along with clarification that 
allowed uses per the CUPD would be limited to garage condominiums for individual sale. The 
applicant did not provide comment to staff in regard to the City’s request to codify their 
development and landscape standards. Staff has recommended as a condition of C-2 CUPD 
zoning approval that part of the POD the applicant provide documentation from the City as to 
appropriateness of screening/landscaping. 
 
Staff Analysis: 
 
11. 
The C-2 CUPD request would be the only permanent commercial island located midblock at an 
unsignalized residential intersection surrounded on three sides by residential subdivisions. 
Further, the proposal does not align with City or County comprehensive planning policies that call 
for preservation of rural character. This matter can be addressed with screening/landscaping at 
POD. Staff also notes the proposal calls for limiting building heights to 30’ which is below that of 
surrounding residential zoning districts.

Staff notes this type of product services a regional market, arguably calling for the C-2 
intermediate commercial zoning designation rather than a C-1 neighborhood commercial 
designation (C-1), arguably more appropriate for this location which would be less intense with 
uses that serve lower density neighborhoods such as those that surround the subject property. 
However, the proposed use will be a low-traffic generator compared to the myriad of more 
conventional neighborhood and community/intermediate commercial uses such as retail sales 
and services. The latter uses would be inappropriate for the subject site.

The applicant justifies the use as compatible and references the neighborhood north of Coolidge 
St. (not adjacent to the site) as a location with non-residential uses permitted under Special Use 
Permits. Staff notes SUP (Z2023034) for an adjacent wireless communication facility was not

approved, but was referenced in the applicant’s narrative as recently approved. Said parcel 
contains Crossroads Baptist Church. Additionally, staff notes two historic SUPs, one for a dog 
kennel Z 73-49, and another for a roping arena / saddle shop and auction house Z 88-108; despite 
age of SUP entitlement and subsequent lot splitting, the latter appears to still be operating on a 
portion of the original site based upon interpretation of aerial photography and the Assessor’s 
classification.  With regard to the former it now contains a fire station for the Arizona Fire and 
Medical Authority based upon the same review. Staff notes some business listings appear on this 
neighborhood street in online searches including towing and trailer manufacturing, but no 
commercial zoning nor SUPs for these uses exist. The church, fire station, and a private 
residential sport court developed in this neighborhood are uses by-right in the Rural zoning 
districts. These were referenced in the applicant’s narrative as approved under SUPs.

Having said all this, staff supports the request.  The use will be limited to condominium storage 
and thus will not generate traffic, lighting or noise to be disharmonious with the surrounding 
residential neighborhoods.  Limited building height will help preserve the area’s rural character. 
Staff will require the developer to coordinate with the City of Buckeye on ultimate screening and 
landscaping of the site, which may also help to preserve rural character. To date, there is no 
known public opposition nor concern with the proposed C-2 CUPD zoning. 
 
Recommendation:

Staff recommends the Commission adopt a motion recommending that the Board of Supervisors 
approve Z260009 subject to the following conditions ‘a’ – ‘i’:

Purpose of Request 
 
This request seeks to rezone the subject parcel (APN’s 502-29-026J, 502-29-
026H), the “Property” from Rural-43 to C-2 (Intermediate Commercial) with a 
Commercial Unit Plan of Development (CUPD) overlay, for the entire 9.75 gross 
acres. The parcel is located on N Perryville Road between W Camelback and W 
Indian School Road. The requested change to C-2 CUPD would allow for the use 
of Luxury Garage Condominiums, which is a low traffic generator and an 
appropriate use for the underutilized land. Specifically, the benefits for Luxury 
Garage Condominiums are that:

Luxury Garage Condominium facilities are generally quiet  
• 
They create very little traffic 
• 
They have no impact on schools 
• 
Acts as a noise buffer between new residential to the south and to the north
 
towing company, church, trailer manufactory, roping arena/saddle shop, 
 
and fire station 
• 
They provide a community service as no comparable facilities exist currently 
in the area 
 
Description of Proposal 
 
The subject Property was an existing honeybee production facility that was located 
in a 29,000 square foot building. In the front, is a residential residence being used 
as an Airbnb. With the rezoning of the dairy to the south to a residential 
subdivision, the old honeybee operation became less compatible with the 
encroaching residential uses.  This proposed rezoning seeks to utilize an existing 
property that has historically operated as a non-residential, but legal use into a 
more compatible use to the area. 
 
A Plan of Development (POD) will be submitted in a future phase of the entitlement 
process. Luxury Garage Condominiums generate very low traffic volumes, 
especially during peak commuting hours, and typically require minimal customer 
parking as visits are short in duration.  
 
A conceptual site plan is included with this rezoning request. Any future 
commercial development will be in compliance with the Maricopa County Zoning 
Ordinance (MCZO) C-2 zoning district standards and regulations per Section 504 
and will be in compliance with C-2 development standards and regulations, 
meeting setbacks, signage criteria, other than what is identified below in the CUPD

table. Operational details including number of employees, hours of operation, and 
other information will be discussed when the POD is submitted in the future.  
 
Commercial Unit Plan of Development (CUPD) 
 
The Commercial Unit Plan of Development (CUPD) Overlay is proposed to deviate 
the MCZO standards for C-2. 
 
Height: In consideration of the surrounding land uses, the proposed development 
includes a reduction in the height of the Luxury Garage Condominiums to 30 feet 
from 40 feet. This design adjustment is intended to create a smoother and more 
appropriate transition between the facility and the adjacent new residential units.  
 
Compatibility: There are four uses within the district that would not be suitable for 
this specific location due to their potential impact on the surrounding residential 
properties. As this narrative proposes Luxury Garage Condominiums, the client 
would like to restrict the following uses for any future developer: Adult-oriented 
facilities; Medical Marijuana Dispensary Facilities; Halfway Houses; Boarding 
Houses; Recovery Communities; Liquor Stores; Cash Advance and Payday Loan 
Facilities; Pawn Shop; Group care facilities and hospitals; Mobile Home Sales; & 
Storage/maintenance of agricultural equipment. Additionally, this C-2 district shall 
expressly allow for Luxury Garage Condominium for individual sale

Relationship to Surrounding Properties 
 
The subject Property is surrounded by a variety of land uses. Properties to the 
south and west are zoned R1-6. To the east is a PAD located within the City of 
Goodyear. Most notably, properties to the north are in unincorporated county and 
zoned RU-43. However, the neighborhood north along W Coolidge St. includes 
several non-residential and higher-impact uses, including a recently approved SUP 
for a wireless communications facility (Z2023034), a pickleball court, Buckeye 
Valley Fire District Station 321, another SUP for a towing yard (Z88-108), and a 
trailer manufacturing facility. These uses generate noise and visual impacts, 
whereas the proposed use is quieter in nature and does not create unsightly 
conditions, but rather stores any potential unsightly conditions in a luxury enclosed 
facility. See Exhibit 1 for attached photos.  
 
Justification 
 
The proposed rezoning to allow Luxury Garage Condominiums represents a 
compatible, low-impact land use that meets a demonstrated community need while 
maintaining compatibility with surrounding properties. As the area is urbanizing, 
nearby homebuilders like Fulton homes are creating smaller home products that 
lack sufficient storage. Our firm had a conversation with Fulton Homes, the 
homebuilder directly to the south, and is satisfied with the product we are building. 
These Luxury Garage Condominiums are generally quiet in nature, generate 
minimal traffic, and do not create demands on public services such as schools. 
 
The Luxury Garage Condominiums would provide a valuable community service by 
offering secure, organized storage for high-end collector cars and similar vehicles 
that cannot reasonably be accommodated on typical residential lots. Many 
surrounding properties, particularly in nearby residential areas, lack sufficient 
space to store these items without negatively impacting neighborhood appearance 
or violating local regulations. By providing a designated storage location, the 
Luxury Garage Condominiums help reduce on-street and residential parking 
concerns, as well as providing a safe and secure location for high-value property 
reducing the threat of theft in nearby neighborhoods.

The proposed use is well suited for the site and surrounding context, as it acts as 
an effective transitional buffer between existing and planned residential 
development to the south and east, and nearby uses to the north such as a towing 
company, church, and fire station. The enclosed and controlled nature of the facility 
helps mitigate noise and visual impacts, contributing to overall compatibility with 
adjacent land uses. 
 
Overall, the requested rezoning supports responsible land use planning by 
providing a low-impact commercial use that serves a clear community need, 
enhances neighborhood organization and safety, and maintains compatibility with 
surrounding land uses while offering long-term benefits to the community. 
 
Location and Accessibility 
 
The site is located along N Perryville Road, a designated arterial, with proposed 
access exclusively from N Perryville Road. This sufficient access point ensures 
minimal disturbance to surrounding properties. The Luxury Garage Condominiums 
will generate very low traffic volumes, especially during peak commuting hours, 
and typically require minimal customer parking as they or their visitors are going to 
park in or in front of the garages. 
 
Compliance with City/Town General Plan 
 
The site is located within Buckeye Planning Area and shows the property as Rural. 
The Property is part of the Buckeye General Plan 2040 and is classified as Rural. 
While commercial use is not traditionally categorized as a rural land use, the 
surrounding context demonstrates a clear pattern of commercial and industrial 
development operating under Special Use Permits (SUPs). Properties located 
north of the site, although similarly designated as RU-43, contain uses that are 
commercial and industrial in nature. This establishes a precedent of non-
agricultural and residential, revenue-generating activity within the immediate area. 
This pattern also makes sense given the location next to a major arterial.  
 
This Property is not in a county island and is therefore not subject to A.R.S. § 11-
814 (general plan requirements), as the Property is not completely surrounded by a 
city or town. While the Property borders the City of Goodyear, it is within Buckeye’s 
planning jurisdiction. Therefore, the guidelines in the adopted general plan of 
Buckeye do not apply. However, our firm plans to meet with Buckeye staff before 
the Planning and Zoning Commission to review the additional use regulations in 
the amended narrative and address any remaining concerns.

Circulation System 
 
Perryville Road is maintained by the City of Goodyear. According to the City of 
Goodyear’s Annual Daily Traffic Flow Map for Year 2019 Arterial Streets, this road 
only receives 5,196 vehicles a day. Surrounding roadways in the area are 
transitioning to becoming improved generally allowing for curb, gutter, and 
sidewalk. Currently, the property frontage is a two-lane roadway.  
 
While there is very little information regarding traffic numbers for Luxury Garage 
Condominiums, these facilities commit low traffic volumes compared to almost any 
other commercial, industrial, and even residential use. Compared to RV & Boat 
storage or other types of mini storage, the Institute of Transportation Engineers 
(ITE) publication Trip Generation, 11th Edition, 2021, give these types of facilities a 
very low rate of use. According to the 11th Edition, per 100 storage units only 1.68 
trips and hours (at average PM peak) would take place. Additionally, since these 
are Luxury Garage Condominiums, there is a strong likelihood that these should be 
even less than mini storage, so therefore it will most likely not significantly increase 
the number of vehicles using this roadway. Luxury Garage Condominiums would 
be better than most other uses for the property. 
 
Development Schedule 
 
A Plan of Development (POD) for development of the Property will be applied 
subsequent to obtaining commercial zoning entitlement approval once specific land 
use(s) are determined. 
 
Public Services 
 
Water – Arizona Water Co. 
Wastewater – Septic System, but may possibly be connected to Goodyear 
Fire – Arizona Fire & Medical Authority (Buckeye Valley Fire District) 
Police – Maricopa County Sheriff 
 
Conclusion 
 
The requested rezone to C-2 CUPD is justified given the location to major 
crossroads, future development of the area, and proximity to communities that 
utilize Luxury Garage Condominiums. Given this location to other noxious uses, lot 
size, shape and width, the Property is not suitable for rural or large-scale 
residential development. This use conforms with the purpose of the C-2 zoning 
district because it is both compatible with nearby properties and supported by the

Onsite Wastewater (Septic) –  
A Notice of Intent to Discharge application for a septic system is required for any 
construction. Application must be submitted to the MCESD Onsite Wastewater Program.

impact study (TIS) shall be approved by the City of Goodyear since access will 
be via Perryville Road which is under Goodyear jurisdiction.  
a. Since access is via Perryville Road, City of Goodyear roadway, please 
seek a TIS review waiver from MCDOT. 
   
2. Engineering and drainage review was based on a zone change without a plan 
of development. Therefore, without the submittal of a precise plan of 
development, no development approval is inferred by this review, including,

access and roadway alignments. These items will be addressed as 
development plans progress and are submitted to the County for further review 
and/or entitlement.

The City's General Plan designates the property as Rural, which does not support the proposed 
zoning intensity. 
• 
The proposed C-2 zoning is not supported by City staff due to proximity to residential properties, 
incongruence with the General Plan, and midblock location not located at an arterial intersection.
o Staff may be more amenable to the request if it was amended to either a SUP or if the 
CUPD eliminated all commercial uses other than the garage condos.  With the current 
proposal staff has to assess the request as if it would develop as any of the allowed C-2 
uses other than the few explicitly prohibited in the proposed use table. This is even more 
vital with no POD or site plan included with the CUPD request.

City staff requests an updated narrative to include a list of uses that the proposed garage condos 
will allow garage owners to utilize their garage for.  Will the units be utilized for full car 
repair/restoration?  What other uses could future owners have in the units?  Would something like 
a small wood working business be allowed to operate? 
o City staff would request that the CUPD include limits of what each individual unit could be 
used for.  Staff understands that there will likely be a condo association to monitor uses of 
the units, however it is still important that the allowed uses a crystal clear in the CUPD use 
table. 
• 
City staff requests that if approved the CUPD includes landscaping and design requirements that 
mirror the City's development code.  It is vital that commercial development does not occur 
within the City's municipal boundary that does not meet the City's expectations for site design.

After reviewing the revised narrative our position on this one remains unchanged. 
 
• 
The CUPD overlay still allows most commercial uses that we view as not compatible with the 
surrounding residential uses, the mid-block location of the site, and non-compliance with the 
City's General Plan.  
• 
The narrative does not address the City's request to codify design and landscaping requirements 
to mirror City requirements. 
• 
The applicant has not reached out to City planning staff to discuss these concerns. 
 
Staff are not opposed to the ultimate proposed development of luxury storage units; however, we cannot 
support the requested C-2 CUPD zoning as it would allow a myriad of potential commercial uses (minus 
the few that are specifically prohibited).  Modifications to the request that would make it more palatable 
to City staff would be restricting the use in the CUPD to just luxury storage and including enhanced 
design and landscaping requirements.  This would provide certainty of how the site would develop and 
allow for a reassessment if a different use is proposed in the form of an amendment to the CUPD.

operations?  Are the SUPs still valid? It appears the  two of the three SUPs to the north are over 
thirty years old and would likely have already sunset unless they were granted extensions.
