C-22-22-151-X-06 Amendment No. 6 HOM Incorporated Amendment 6 Page 1 of 6 AMENDMENT NO. 6 TO THE CONTRACT BETWEEN MARICOPA COUNTY ADMINISTERED BY ITS HUMAN SERVICES DEPARTMENT AND HOM INCORPORATED I. Maricopa County (“County”) administered by its Human Services Department and HOM Incorporated (“Contractor”) fully executed a Competition Impracticable financial Agreement on or about July 14, 2021. The County provided the Contractor with $4,970,555 in American Rescue Plan Act (“ARPA”), Coronavirus State and Local Fiscal Recovery Funds under the Assistance Listing Number 21.027. The purpose of the Agreement is for the Contractor to administer a centralized, systemwide, landlord engagement service for Maricopa County’s homeless services system. The original Agreement term was July 14, 2021, through June 30, 2023. The County and the Contractor are referred to as the “Parties” or individually as the “Party.” The Parties entered into Administrative Change Order No. 1 on or about February 8, 2023. The purpose of the Administrative Change Order was to revise the description for the budget category of Landlord Financial Incentive and Risk Mitigation Funding. Administrative Change Order No. 1 also revised Section 1 (General Provisions) to incorporate Uyghur Forced Labor Prevention Act provision. The Parties entered into Amendment No. 1 on or about June 14, 2023. The purpose of Amendment No. 1 was to extend the term of the Agreement from June 30, 2023, though June 30, 2025. Amendment No. 1 increased the funding amount by $2,500,000, from $4,970,556 to a not to exceed amount of $7,470,556. Amendment No. 1 also revised Section 1 (General Provisions) by incorporating the Force Majeure provision. Section 2 (Special Provisions) subparagraphs 6.4.2 and 6.7.2 are replaced in entirety. Section 3 (Work Statement) subparagraph 3.7 is replaced in its entirety. The budget in Section 4 (Budget and Compensation) is revised and replaced in its entirety. The Parties entered into Amendment No. 2 on or about January 10, 2024. The purpose of Amendment No. 2 was to revise Section 4.0 (Budget and Compensation), paragraph 1.0 (Budget) to make line items changes to the budget by reallocating $677,500 from Total Direct Salaries and Administration to Total Landlord Financial Incentive and Risk Mitigation Funding. The overall Agreement Budget remained the same. The Parties entered into Amendment No. 3 on or about June 12, 2024. The purpose of Amendment No. 3 was to increase funding by $29,444 in ARPA funds for a new total Budget amount of $7,500,000. The Amendment also added required language to the Agreement. The parties entered into Amendment No. 4 on or about December 18, 2024. The purpose of Amendment No. 4 was to update the County POC, extend the term of the agreement through December 30, 2026, award $600,000 in County General funds, update the administrative change order provision, and revise and replace Section 4.0 (Budget and Compensation) for a new FY26 budget, for a new total Agreement funding amount of $8,100,000. C-22-22-151-X-06 Amendment No. 6 HOM Incorporated Amendment 6 Page 2 of 6 The parties entered into Amendment No. 5 on or about June 10, 2026. The purpose of Amendment No. 5 was to update the County POC and award an additional $100,000 in Fiscal Year 2026 County General funds and revise and replace Section 4.0 (Budget and Compensation) with an updated FY26 budget to reflect new total Agreement funding in the amount of $8,200,000. II. The Parties agree to enter into this Amendment No. 6 to amend the Agreement as follows: A. Extend the expiration date of the Agreement from December 31, 2026, to June 30, 2027. B. The County shall hereby increase funding under the Agreement by $800,000 in County general funds, for expenditure in Fiscal Year 2027, FY27 general funds shall be fully expended by June 30, 2027. Maricopa County Human Services Department must receive a final invoice for reimbursement no later than July 15, 2027. C. The total Agreement funding shall hereby increase from $8,200,000 to a new total amount of $9,000,000, comprised of $1,500,000 in County General funds and $7,500,000 in American Rescue Plan Act State and Local Fiscal Recovery Funds (ARPA-SLFRF) under Assistance Listing number (ALN) 21.027. All allowable ARPA-SLFRF costs eligible for reimbursement must still be incurred and submitted to the County no later than November 30, 2026, within the applicable period of performance. The ARPA-SLFRF expenditure deadline remains unchanged by this Agreement extension. D. Revise and replace Section 3.0 (Work Statement) in its entirety with the following updated work statement attached hereto and incorporated into the Agreement. E. Revise Section 4.0 (Budget and Compensation) Paragraph 1.0 BUDGET, by adding paragraph 1.1 Eviction Diversion Budget, Budget to be incorporated into the Agreement by Addendum, with approval of the Human Services Department Director, within 30 days of execution of this Amendment No. 6. 1.1 Housing Stability and Eviction Diversion Budget (to be incorporated by Addendum) III. Section II above contains all the changes to the Agreement made by this Amendment No. 6. The Agreement is amended to incorporate the changes contained in this Amendment No. 6. All other terms and conditions of the Agreement and previously approved amendments remain in full force and effect as executed by the Parties. This Amendment No. 6 is subject to and incorporates the provisions of A.R.S. § 38-511. IV. The Parties have authorized the undersigned to execute this Amendment No. 6, and it shall be effective upon approval and signature by both Parties. HOM, Inc. will work collaboratively with the Maricopa County Human Services Department, the Maricopa Regional Continuum of Care, homeless services practitioners, and other relevant stakeholders in the initial branding, design, planning, and implementation of the service to meet the needs of the community’s homeless housing programs. 1.1 The service will benefit all scattered site, tenant based rental assistance programs that are dedicated to serving individuals and families experiencing homelessness. These generally include homeless housing interventions like Permanent Supportive Housing (PSH), Rapid Rehousing (RRH), Supportive Services for Veteran Families (SSVF), HUD-VASH, and select mainstream low-income housing programs that are targeted to ending homelessness, like HOME TBRA and Housing Choice Vouchers (HCV) with local preferences for homelessness. The programs must participate in the Maricopa Regional Continuum of Care’s coordinated entry system and HMIS. 1.2 The landlord engagement service will include rental market research, outreach and education, recruitment, incentivization, and retention of landlords to expand housing opportunities for people experiencing homelessness. 1.3 Rental Market Research, Outreach, and Marketing 1.3.1 Develop brand identity for the landlord engagement service and leverage the HOM brand as contractor; 1.3.2 Develop marketing materials including print, web, video, email marketing, social media, infographics, and PowerPoint presentations; 1.3.3 Identify, collect, and maintain market research data from community and industry sources; 1.3.4 Identify prospective landlords for the housing programs and generate leads for outreach and recruitment; 1.3.5 Visit properties and management company offices in person to make presentations and distribute housing program marketing materials; 1.3.6 Conduct outreach and education presentations at community and industry events, such as Arizona Multihousing Association (AMA) events, local REALTOR© board events, community service group events (Kiwanis, Rotary, Chambers of Commerce, faith groups) and others; 1.3.7 Convene and staff a Landlord Advisory Council, in coordination with the Arizona Multihousing Association (AMA); 1.3.8 Coordination and partnership with public and private funders of affordable rental housing development (LIHTC, HOME, HTF, etc.) to target marketing and recruitment efforts; 1.3.9 Use existing landlord pool to identify and network with sister properties, peers, and colleagues; 1.3.10 Market the housing programs to prospective landlords and explain all program facets of various housing programs and paperwork requirements; 1.3.11 Recruit landlords whose tenant screening criteria will provide opportunities for applicants with criminal backgrounds, including those with felony convictions; 1.3.12 Coordinate with external supportive services providers around the housing search and lease-up process; C-22-22-151-X-06 Amendment No. 6 HOM Incorporated Amendment 6 Page 5 of 6 1.3.13 Operate a landlord phone hotline, online portal, dedicated and monitored email address or other communication method with a designated Landlord Engagement Specialist to coordinate a response to concerns or issues brought forward by landlords regarding participants or providers; 1.3.14 Coordinate with the Human Services Department to identify and refer potentially qualified properties for services in the Lead Safe Maricopa County program; and 1.3.15 Collect feedback from landlords about experience working with the housing programs and recommend improvements. 1.4 Administration of Padmission Housing Search Platform 1.4.1 Administer HOM’s custom-built landlord engagement and housing search software platform; 1.4.2 Work with landlords to maintain real time information of available units that are categorized by location, size, property type, amenities, programs accepted, and screening criteria; 1.4.3 Facilitate collaboration, coordination and information sharing among community stakeholders; 1.4.4 Provide access to Padmission for community homeless service providers and program participants; and 1.4.5 Utilize Padmission reporting and analytics to inform outreach and identify areas of needed support for housing programs. 1.5 Administration of Landlord Financial Incentives, Risk Mitigation Funds and Housing Stability- Eviction Diversion Funds 1.5.1 Pay signing bonuses to landlords willing to work with and/or retain designated housing programs; 1.5.2 Pay unit hold/reservation fees to landlords willing to set aside units at properties for participation in designated housing programs; 1.5.3 Administer risk mitigation fund and process landlord claims for damage and/or vacancy loss re-imbursement in accordance with guidelines. 1.5.4 Administer eviction diversion assistance funds and process landlord payments for rental arrears to prevent formal eviction by leveraging HOM's housing assistance infrastructure, payment systems, compliance controls, landlord engagement network, and housing program expertise to include: 1.5.4.1 referral and application fee 1.5.4.2 Eligibility and review 1.5.4.3 landlord/Vendor verification 1.5.4.4 approval and Issuance of Payment 1.5.4.5 Reporting as outlined in paragraph 3.0 (Performance Management Deliverables) 2.0 STAFFING HOM, Inc. identifies the following dedicated staff for the landlord engagement service: One (1) Senior Manager, Landlord Relations 0.33 FTE One (1) Landlord Engagement Supervisor 1.0 FTE Two (2) Housing Location Specialists 2.0 FTE One (1) Landlord Engagement Specialist - Hotline 1.0 FTE One (1) Landlord Support Specialist 1.0 FTE One (1) Communications Coordinator 0.50 FTE One (1) Administrative Assistant 0.30 FTE 3.0 PERFORMANCE MANAGEMENT DELIVERABLES C-22-22-151-X-06 Amendment No. 6 HOM Incorporated Amendment 6 Page 6 of 6 HOM, Inc. will collect and report the following performance-related data to the Maricopa County Human Services Department Senior Services and Community Resilience division quarterly. 3.1 Total number of properties that accept homeless housing programs; 3.2 Number of new properties recruited to accept homeless housing programs; 3.3 Total number of units available by unit size, city, zip code, and housing programs accepted with an emphasis on units in zip codes that support de-concentration efforts; 3.4 Number of active users in Padmission; including service provider case managers, housing program participants, and property managers; 3.5 Number of landlord outreach and education events hosted or participated in by landlord engagement service; 3.6 Quarterly Landlord Advisory Council meeting minutes, recommendations, and action steps; and 3.7 Annual performance report highlighting key outputs, outcomes, and lessons learned. 3.8 Eviction diversion data quarterly reporting may include but is not limited to the following: total households served, demographics, reason for eviction and other data points determined by the Human Services Department and Housing Stability Stakeholder Workgroup; Reporting template to be agreed upon by the Parties within 30 days of Amendment execution which shall be incorporated into the Agreement by Addendum may include: 3.8.1 Real time utilization tracking 3.8.2 Application and Time to Payment 3.8.3 Zip code/Landlord concentration (eligibility) 3.8.4 Type of Assistance 3.8.5 Reason for Housing Instability 3.8.5 Financial metrics such as average financial assistance amount and reductions in late/legal fees. 3.8.6 Collaboration with Maricopa County Justice Courts, landlords, and attorney’s as defined by the Housing Stability Stakeholder Workgroup and accepted by HOM Inc. 4.0. OUTCOME STATEMEMT This service will increase the rate of acceptance and participation by landlords in targeted homeless housing programs in the Maricopa Regional Continuum of Care. Through targeted outreach, education, recruitment, incentivization, and retention activities for landlords, the homeless services system will increase its rate of permanent housing outcomes for people experiencing homelessness in Maricopa County. The increase in participating landlords and available units will allow the Maricopa County homeless services agencies to increase housing placements by 20% in the first year and incrementally increase by 10% in each subsequent year. The Housing Stability and Eviction Diversion Program is expected to assist approximately 200 households per year in the County through eviction diversion assistance, utility assistance, and other housing stabilization services and funding in high impact areas such as zip codes 85008, 85041, and 85042.
