No-Build Easement Agreement with the City of Avondale
Action Requested:

Approve and execute a No-Build Easement Agreement granting the City of Avondale a 
non-exclusive, perpetual easement over a portion of County-owned property for 
purposes of maintaining an open, unoccupied area and allowing the installation, 
maintenance, repair, replacement, and removal of a fence, wall, or barrier in connection 
with the City’s transitional housing project. Unanimous Consent of the Board is 
required.
Additional Information:
Maricopa County owns property adjacent to a City of Avondale parcel that is being 
developed as a transitional housing project. The City requires a no-build easement over 
a portion of the County property to satisfy applicable zoning and building code 
separation requirements for the project. The proposed agreement grants the City a non-
exclusive, perpetual easement for no-build and access purposes while allowing the 
County to retain all rights not expressly granted under the easement. The City will be 
responsible for maintaining any fence, wall, barrier, and related improvements installed 
within the easement area.
