Council to take action on Resolution No. 76-26 approving an Acceptance and Service Agreement with
Trillium Land Company, LLC, a Delaware limited liability company, or designee, for water infrastructure
and related appurtenances, and associated real property, subject to approval of the final form of the
Agreement by the City Attorney.

SUMMARY
PROJECT DESCRIPTION:
Subject to Mayor and Council approval, Resolution No. 76-26 approves an Acceptance and Service
Agreement ("Agreement") by and between the City of Buckeye ("City") and Trillium Land Company, LLC,
a Delaware limited liability company, or designee, ("Master Developer").
As part of the development of Floreo at Teravalis, the Master Developer is required to construct and
install public infrastructure necessary to serve the development and, upon completion, dedicate and
convey such infrastructure to the City at no cost and free of all liens and encumbrances. The Master
Developer must also convey any real property and/or easements necessary for the City to own, operate,
and maintain the infrastructure.
Master Developer has caused the construction of the water infrastructure comprising the Floreo Water
Campus and well sites #1 and #3, and desires to transfer to the City the water infrastructure pursuant to
a bill of sale, and the real property pursuant to a deed.  The Acceptance and Service Agreement is a
requirement of the underlying Development Agreement between the Parties.
Following acceptance, and subject to the required warranties and the terms of the Development
Agreement, the City will assume responsibility for the operation, maintenance, and repair of the accepted
infrastructure.  This item may later be agendized for community facilities district board action for
reimbursement.
BENEFITS:
Acceptance of the Floreo at Teravalis water facilities and the associated property transfers ownership of
the public infrastructure to the City, allowing the City to own, operate, and maintain the improvements in

accordance with the Development Agreement.
FUTURE ACTION:
This item may be agendized for community facilities district board action for reimbursement.
FINANCIAL IMPACT STATEMENT:
There is no financial impact on the acceptance of the infrastructure and dedication of land to the City of
Buckeye apart from assuming maintenance and operations expenses.  These expenses are included as
a part of the FY2027 budget.
