1 RESOLUTION NO. 72-26 A RESOLUTION OF THE MAYOR AND COUNCIL OF THE CITY OF BUCKEYE, ARIZONA, APPROVING THE INTERGOVERNMENTAL AGREEMENT BETWEEN THE CITY OF BUCKEYE, ARIZONA, AND BUCKEYE UNION HIGH SCHOOL DISTRICT #201 FOR EXCHANGE OF REAL PROPERTY AND JOINT ESCROW INSTRUCTIONS. WHEREAS, in accordance with A.R.S. § 9-401, et. seq., the City of Buckeye (“City”) is vested with the authority to acquire, exchange, and sell real property on terms and conditions as it may determine and approve; and WHEREAS, in accordance with A.R.S. §§ 15-341(A)(7), (9), (11) and 15-342(7), (10), (23), the Buckeye Unified High School District #201 is a political subdivision with the power to acquire, exchange, and sell real property on such terms and conditions as it may determine and approve; and WHEREAS, under A.R.S. §§ 11-951, et. seq. and 15-342(13), the City and the District may contract with one another to provide any function, service, or facilities through an intergovernmental agreement; and WHEREAS, the District owns real property comprised of approximately 60.07 acres of land comprising a portion of that certain real property described in that certain quitclaim deed recorded at Book 7431, Page 935, official records of Maricopa County, bearing reputed Assessor’s Parcel Number (APN) 504-20-004J (“District Property”); and WHEREAS, the City owns real property comprised of approximately 4 acres of land comprising the entirety of APNs 400-75-105K, 400-75-105J, and 400-75-106, and approximately 2 acres of land comprising the entirety of APN 400-16-004B (collectively, the “City Property”); and WHEREAS, the District desires to acquire the City Property from the City for District purposes; and WHEREAS, the City desires to acquire the District Property from the District for City purposes; and WHEREAS, the City and the District have negotiated the terms of an intergovernmental agreement for the exchange of the City Property and the District Property, to take effect as described within that document (the “Land Exchange IGA”) and that is the subject of this Resolution. BE IT RESOLVED by the Mayor and Council of the City of Buckeye, Arizona, as follows: Section 1. The recitals above are hereby incorporated as if fully set forth herein. Section 2. The Land Exchange IGA is hereby approved in substantially similar form and format as the Land Exchange IGA on file with the City Clerk. Section 3. The City Manager is hereby authorized to execute and deliver the Land Exchange IGA and, further, as authorized or required by A.R.S. § 11-952 and/or other applicable 2 legal authority, the Mayor, City Manager, City Attorney, and City Clerk are hereby authorized and directed to take all steps necessary to cause the execution and delivery of the Land Exchange IGA and all documents and other necessary or desirable instruments connected with the Land Exchange IGA and to take all steps necessary to carry out the purpose and intent of this Resolution.
