ORDINANCE NO. 05-26

ORDINANCE ADOPTING THE ESTABLISHMENT AND LEVY OF AN ANNUAL
ASSESSMENT BY THE GOVERNING BODY OF THE FOLLOWING STREET
LIGHTING IMPROVEMENT DISTRICTS (“SLIDS”); FOR FISCAL YEAR 2027
BEGINNING JULY 1, 2026 AND ENDING JUNE 30, 2027 UPON EACH PROPERTY
WITHIN THE DISTRICT, A CERTAIN SUM SUFFICIENT TO RAISE THE AMOUNTS
ESTIMATED TO BE REQUIRED IN THE ANNUAL BUDGET.

WHEREAS, in accordance with Arizona Revised Statutes Section 48-616, and following
published notice, the Governing Body of the following Street Lighting Improvement Districts
conducted a public hearing on June 2, 2026 at which meeting any taxpayer in the District was
privileged to appear and be heard in favor of or against any of the proposed expenditures or annual
assessment; and

WHEREAS, it appears that all notices have been duly published, as required by law and
posted on the City of Buckeye, Arizona website; and

WHEREAS, in the budget filed with the Clerk, the Governing Body has made the annual
statements and estimates of the costs and expenditures of the District, including the amount of the
annual assessment to be raised to pay the expenses of purchasing energy for the District and has
conducted a hearing on such statements; and

WHEREAS, Maricopa County, Arizona (the “County”) is now the assessing and collecting
authority for each District.

BE IT ORDAINED by the governing body for the following Street Lighting Improvement
Districts as follows:

Section 1.
Levy of Annual Assessment. FOR EACH STREET LIGHTING
IMPROVEMENT DISTRICT LISTED HEREUNDER, there is hereby levied an assessment on all property,
within the boundaries of, except such property as may by law be exempt from taxation, a tax assessment
levy sufficient to raise the amount of expenses of each Street Lighting Improvement District. The purpose of
the tax assessment shall be to provide a fund for the annual expenses of each Street Lighting
Improvement District listed hereunder, for the fiscal year ending the 30th day of June, 2027 with an aggregate
total of $647,700:

Section 2.
No Invalidation of Proceedings. No failure by County officials to properly
return the delinquent list and no irregularity in the assessment or omission in the same, or
irregularity of any kind in any proceedings shall invalidate such proceedings or invalidate any title
conveyed by any tax deed, nor shall any failure or neglect of any officer or officers to perform any of

the duties assigned to him or to them on the day or time specified work an invalidation of any
proceedings or of any such deed or sale or affect the validity of the assessment and levy of taxes
or of the judgment or sale by which the collection of the same may be enforced or in any manner
affect the lien of the District upon such property for the delinquent annual assessments unpaid
thereon, and no overcharge as to part of the assessment or of costs shall invalidate any proceedings
for collecting of annual assessments or the foreclosure, and all acts of officers de facto shall be
valid as if performed by officers de jure.

Section 3.
Transmission of Ordinance to County. The Clerk is hereby directed to
transmit a certified copy of this Ordinance to the Assessor and Board of Supervisors of the County.

Section 4.
Conflicting Ordinances Repealed. All ordinances and parts of ordinances in
conflict are hereby repealed.

PASSED AND ADOPTED by the Governing Body of the Street Lighting Improvement District
SLID No. #1 on this 16th day of June, 2026.
