Council to take action on the Addendum to Second Amendment to Bid Submission and Real Property
Purchase Agreement between the City of Buckeye, an Arizona municipal corporation, and Mattamy
Arizona LLC, a Delaware limited liability company; and authorize the Mayor to execute said Addendum
on behalf of the City of Buckeye.

SUMMARY
PROJECT DESCRIPTION:
The City of Buckeye (COB) and Mattamy Arizona LLC (Mattamy), as successor to Jen Arizona 36, LLC,
are parties to a Purchase Agreement originally dated August 17, 2021, and subsequently amended.
Under this agreement, COB agreed to sell, and Mattamy agreed to buy the entire Sonoran Ridge Water
System, including all related facilities and rights. Tract T, part of the Sonoran Ridge Water System and
known as Maricopa County Assessor’s Parcel No. 502-14-456, was inadvertently omitted from the
original conveyance. Both parties now intend to correct this by entering into an Addendum to the Second
Amendment, whereby the COB will convey Tract T to Mattamy via a special warranty deed, for $10.00.
FUTURE ACTION:
None.
FINANCIAL IMPACT STATEMENT:
The City will receive $10.
