PROJECT DESCRIPTION: 
1. Rob Gubser, Colliers Engineering and Design, on behalf of property owner GDC OZ, LLC, is 
requesting an annexation of four (4) parcels of land totaling approximately 49.617 acres 
located approximately 1,350 feet south of the southwest corner of 269th Avenue and 
Lower Buckeye Road (Exhibits A, B, and C). The applicant’s annexation project narrative is 
included as Exhibit D.  
2. The parcels are presently zoned Rural-43 (RU-43) in Maricopa County. Upon approval of 
the annexation, the property will be assigned Single-Family Residential (R1-43) zoning 
most comparable to the property’s existing county zoning. The R1-43 district allows for 
large lot single-family residential development and ancillary uses with a rural character.  
3. A request for a Minor General Plan Amendment to change the property’s land use 
designation from Business Commerce to Master Planned Community (MPC), along with a 
concurrent Major Community Master Plan (CMP) Amendment to incorporate the 
property into the Westpark CMP and allow it to develop with future light industrial uses, 
have been submitted for review. Along with consideration of an ordinance approving this 
annexation, both the GPA and CMP Amendment will be considered by Council at a future 
public hearing, the date of which has not yet been determined. 
4. The blank petition for the proposed annexation was recorded on May 26, 2026 (Exhibit 
E). Per state law governing annexation, a public hearing providing any affected parties 
with an opportunity to comment on the request must be held at least 20, but no more 
than 30 days following recordation of the blank petition. Holding the public hearing for 
this annexation on June 16, 2026, conforms to timing requirements established by state 
statute.

6. The applicant is required to provide notices and postings at least fifteen days in advance 
of the public hearing as required by the Buckeye Development Code and Arizona Revised 
State Statutes (ARS 9.471). Written notice to the Maricopa County Board of Supervisors 
is required at least six days in advance of the public hearing. Due to staff report submittal 
deadlines, certain required notices have not been completed as of May 26, 2026, but are 
scheduled for completion in advance of the state and local deadlines.

8. No public comment concerning the annexation request has been received to date.  
ANALYSIS: 
9. The subject property is presently located in the jurisdiction of Maricopa County and zoned 
Rural-43 (RU-43). Upon annexation, the parcels included with this request will be initially 
assigned City of Buckeye Single-Family Residential 43 (R1-43) zoning, the district most 
closely aligned with the property’s current County zoning designation.

10. The property is currently designated Business Commerce by the Buckeye General Plan. 
This designation is intended for community- and regional-serving commercial 
development, office uses, and business parks. A request for a Minor General Plan 
Amendment to change the land use designation to Master Planned Community (MPC) is 
currently under review. The MPC designation is applied to areas governed by separate 
development approvals that establish permitted land uses, densities, intensities, and 
overall character. Approval of the proposed General Plan Amendment would allow the 
property to be incorporated into the expanded Westpark Community Master Plan (CMP) 
described in the following paragraph. 
11. An application for a Major Amendment to the Westpark Community Master Plan (CMP) 
is currently under review. The proposed amendment would expand the boundaries of the 
CMP to incorporate this property and portions of two adjacent CMPs (Silverrock and 
Westwind), while also revising permitted land uses and development standards to allow 
for primarily light industrial development. 
12. Approval of this annexation does not in any way commit the City Council to approving the 
above-mentioned General Plan Amendment and/or rezoning requests when those items 
are presented at a future meeting.  
13. The annexation parcels are annexation eligible per the requirements outlined in ARS §9‐
471. 
14. Upon annexation, the property will be serviced by City of Buckeye Police, City of Buckeye 
Fire, and will be within the City of Buckeye sewer and water service areas.  Plans for future 
water and sewer service to the property will be determined during future development 
review processes.  
15. Annexation of the property would allow future development to occur under the City of 
Buckeye’s planning, engineering, and development standards. While the property is 
currently undeveloped and no specific site plan has been approved, future development 
would be subject to applicable development impact fees and infrastructure requirements 
intended to offset demands on public services and facilities. Municipal service needs and 
infrastructure improvements will be evaluated in greater detail during those future 
entitlement and development review processes. 
16. The property is located within the Buckeye Union High School and spans both the Buckeye 
Elementary School and Palo Verde Elementary School Districts. Annexation and 
development of the property with light industrial uses, as anticipated, would not result in 
any impact to either district.

17. The following City of Buckeye departments have reviewed and have found no outstanding 
issues with the application:

RECOMMENDATION: 
18. City Council should conduct the required public hearing related to the annexation. No 
additional action is required at this meeting.     
 
19. The annexation will return to the City Council for a second hearing and consideration of 
the annexation Ordinance at a later, currently unidentified date.
