sections of Delivery Order No. 2 to Contract No. 2025088
Delivery Order , with those
sections not expressly modified remaining in full effect pursuant to their terms.
RECITALS:
The City and Contractor entered into Delivery Order No. 2 to Contract No. 2025088 dated
February 3, 2026. Pursuant to which Contractor was to provide construction services for the Miller
Road Landscape Improvements: Lower Buckeye Pima Street Phase I project with the completion
of the Work eight weeks from the issuance from the Notice to Proceed and a not-to-exceed amount
of $400,000.00.
DELIVERY ORDER CHANGES:
1.
Article 1 Scope of Work and Exhibit A of the Original Delivery Order - Proposal,
are amended to incorporate the additional services set forth in Exhibit 1 of Change Order #1.
2.
Article 2
Schedule of Completion of Work, is amended by revising the
completion date for the Work from eight (8) weeks from the effective date of the Notice to Proceed,
to ten (10) weeks from the effective date of the Notice to Proceed.
3.
Article 3 Cost of Construction, is amended by increasing the total not-to-exceed
amount by $139,624.72, from $400,000.00 to $539,624.72.
ADDITIONAL PROVISIONS:
Except as amended herein, all provisions of the Delivery Order and Contract remain in full
force and effect.
In the event of any conflict or discrepancy between the terms of this Change Order, the
Delivery Order, the Contract, and any other contract documents, the documents shall govern in
that order.

This Change Order may be canceled pursuant to the provisions of A.R.S. § 38-511.

Attached is the change order request to provide the electrical panel and electrical connections for the two irrigation controllers.
This includes the assumption that all underground raceways are existing and clear. We have included a $75,000 allowance for
the APS design, once the design is provided it will be priced and submitted for a separate change order. We are requesting an
additional 10 days to complete this scope of work.
