Both property owners expressed questions and concerns over ultimate development. No other public comments have been received to date. Recommendation: Public Hearing and Action Case PLZM-25-0087 – Rainbow 461 Annexation Page 2 of 4 PROJECT DESCRIPTION: 1. Cindy Paddock of Colliers Engineering and Design, on behalf of property owner, Rainbow 121 LLLP, is requesting annexation of one parcel of land totaling approximately 3.5 acres, located about 220’ north of the northeast corner of Rainbow Road and Broadway Road (see Exhibit A), As indicated in Exhibit D (Project Narrative). 2. The property subject to this proposed annexation is just a small portion of a 470-acre site that the applicant intends to develop as a single-family residential neighborhood. Following approval of the annexation the applicant intends to submit for a rezoning of the subject 3.5 acres to bring it into a more compatible zoning district with the rest of the 470 acres. 3. The blank petition for the proposed annexation was recorded on February 9, 2026 (Exhibit E). Per state law governing annexation, a public hearing providing any affected parties with an opportunity to comment on the request must be held at least 20, but no more than 30 days following recordation of the blank petition. A public hearing was held on March 3, 2026, fulfilling this requirement. AREA CONTEXT: 4. Table 1: Existing Land Use, General Plan Designation, and Zoning District: PUBLIC PARTICIPATION SUMMARY: 5. The applicant is required to provide notices at least six (6) days in advance of the public hearing and 15 days prior to the end of the waiting period and site postings at least six (6) days in advance of the public hearing, as required by the Arizona Revised Statutes (ARS §9‐ 471). A member of the public who identified himself as an adjacent property owner spoke on this item on March 3, 2026. The gentleman expressed concerns over ultimate development of the property and surrounding properties and how this would impact the three residential properties south of the subject site. Items of concern included drainage impacts, impact on private wells, and how roadways would eventually develop. Following the meeting staff received one email with similar questions and concerns. No other public comment has been received. ANALYSIS: 8. The subject property is presently located in the jurisdiction of Maricopa County and zoned Rural-43 (RU-43). Upon adoption of an annexation ordinance, the parcel subject to this request would be assigned City of Buckeye Single-Family Residential 43 (R1-43) zoning, the district most closely aligned with the property’s current County Rural-43 (RU-43) zoning designation. 9. The property currently features a General Plan land use designation of Neighborhood, which may include both community and regional development. Zoning districts consistent with this designation include SF-18, SF-10, SF-6, SF-3, SF-1, MF-1, MF-2, NMU, CMU, and C-1. The applicant intends to rezone the property to a district consistent with the Neighborhood land use designation prior to development of the site. 10. The annexation proposal meets eligibility for size, dimension, and contiguity requirements for annexations as outlined in ARS §9‐471. Case PLZM-25-0087 – Rainbow 461 Annexation Page 4 of 4 11. Once annexed, the property will be serviced by City of Buckeye Police, City of Buckeye Fire, and will be within the City of Buckeye sewer and water service areas. 12. The property is located within the Buckeye Union High School and Buckeye Elementary School Districts. While impacts to the school districts from the subject 3.5 acre annexation will be minimal the applicant will coordinate with the districts as the larger site develops. 13. The following City of Buckeye departments have reviewed and have found no outstanding issues with the application: a. Development Services, including Planning and Engineering/Survey b. Fire c. Police d. Public Works e. Water Resources RECOMMENDATION: 14. The Staff recommends the City Council conduct a public hearing and adopt Ordinance No. 16-26, approving the annexation for the following reasons: a. Furthers goals of the Buckeye General Plan; b. Conformance with the Buckeye Development Code; and c. No outstanding issues from reviewing departments.
