RESOLUTION NO. 38-26 
 
A RESOLUTION OF THE MAYOR AND COUNCIL OF THE CITY OF BUCKEYE, 
ARIZONA, ESTABLISHING NEW OR INCREASED MUNICIPAL FEES; 
ESTABLISHING 
AN 
EFFECTIVE 
DATE; 
REPEALING 
CONFLICTING 
RESOLUTIONS; AND PROVIDING FOR SEVERABILITY. 
 
WHEREAS, there is a desire to establish and/or modify municipal fees to further a cost 
recovery philosophy; and 
 
WHEREAS, a comprehensive fee study and report of findings was prepared to provide 
the tools necessary to make informed decisions about the proposed fee adjustments; and  
 
WHEREAS,  pursuant to A.R.S. § 9-499.15, the public notice requirements have been 
completed: (i) a schedule of the proposed new or increased fees that includes the amount of the 
fees and a written report or data that supports the new or increased fees was prepared and filed in 
the office of the City Clerk; (ii) written notice of the proposed charges, the schedule of the proposed 
charges and the written report or data supporting the new charges was posted on the home page of 
the City’s website at least sixty days before the date the proposed new fees are to be approved or 
rejected by the City Council; and (iii) a notice of intent to establish or increase municipal user fees 
which includes the date, time and place of the meeting of the City Council in which the proposed 
new or increased fees will be considered and a statement that a schedule of the proposed new or 
increased fees that includes the amount of the fees and a written report or data that supports the 
new or increased fees is available on the City’s website was posted on the City’s website at least 
fifteen days before the date the proposed new or increased fees will be approved or rejected by the 
City Council, as well as distributed via social media and other electronic communication tools; and 
 
WHEREAS, the City Council held a meeting on May 5, 2026 to consider and approve or 
disapprove the proposed new or increased fees and charges to be implemented by the City and 
has determined that the fees presented and proposed are reasonable and appropriate. 
 
BE IT RESOLVED by the Mayor and Council of the City of Buckeye, Arizona, as follows: 
Section 1. 
The recitals above are hereby incorporated as if fully set forth herein. 
Section 2.  
The Mayor and Council hereby approve and adopt the documents titled 
“Development User Fee Document,” “User Fees Municipal Airport,” and “User Fees Public 
Works Department,” all dated May 5, 2026, and attached hereto as Exhibit A, incorporated 
herein by this express reference, and the fees set forth therein to become effective and be 
implemented May 21, 2026. 
Section 3. 
That all resolutions or parts of resolutions in conflict with the provisions of 
this Resolution are hereby repealed. 
Section 4. 
If any section, subsection, sentence, clause, phrase or portion of this 
Resolution is for any reason held invalid or unconstitutional by the decision of any court of 
competent jurisdiction, such decision shall not affect the validity of the remaining portions thereof. 
Section 5. 
The Mayor, City Manager, City Attorney, and City Clerk are hereby 
authorized and directed to take all steps necessary to carry out the purpose and intent of this 
Resolution.

SUMMARY 
The City of Buckeye has adopted the following Development User Fee Schedule to provide clearly described, 
value-added service to its residents and business partners. This new user fee schedule will assist in streamlining 
the City’s processes and thereby provide a more cost-effective way of meeting the public’s needs for services. 
The Development User Fee Schedule contains in-depth descriptions of what is included with the fees collected 
and is broken down into seven (7) sections for ease of use. Each section describes the fee structure and services 
included with those fees.  
The City Council will review the User Fee Schedule on an annual basis and reserves the right to adjust fees 
based on the Consumer Price Index for Urban Communities (CPI-U). Additionally, the Council will undertake a 
user study every five (5) years to re-evaluate fees based on economic trends and the City's financial status. 
Our Mission Statement is to serve as an exceptional city government that prioritizes the needs of its residents, 
businesses, and visitors. The city aims to provide a safe and sustainable quality of life, foster economic growth 
and stability, and ensure the maintenance of reliable infrastructure. This mission is supported by a strategic 
plan that emphasizes teamwork, innovation, and fiscal responsibility.

SECTION 0: GENERAL REQUIREMENTS 
All new fees are applicable at the time of permit applications and effective at the date of adoption. 
1.
Expired Permit
A.
Any permit that has not requested a required inspection within 180 calendar days from the
permit issuance date or the most recent inspection is considered expired.
B.
Applicants may be required to resubmit plans for review and re-approval.
C.
All non-legitimate requested inspections are required to pay the re-inspection fee, and the
permit expiration date will not be extended.
D.
Pay all applicable fees.
E.
See individual sections for actual fees.
2.
Permit Extension
A.
The Applicant can extend the permit expiration date when requested in writing before the
permit expires.
B.
Permit Extension Fee is 10% of the original Permit Fee.
C.
Each extension is 180 calendar days from the date of request.
D.
There is a maximum of two (2) permit extensions.
3.
Work Commenced Prior to Permit Issuance
A.
The fee is one (1) time the amount of the original calculated permit fee (excludes plan review
fees) and shall be in addition to the required permit fees.
B.
Applies to all work or construction that requires a city permit.
4.
Expedited Submittal Review – *Expedited plan review services are based on resource availability*
A.
Expedited fees are two (2) times the amount of the original calculated fee.
5.
Unclassified or Unspecified Services
A.
The rate for any unclassified or unspecified fees shall be charged at the User Fee hourly rate
per fee Section. This includes, but is not limited to inspections, plan review, meetings, records
investigation, etc. as determined by the city.
6.
Refunds
A.
All refund requests shall be made in writing within 180 calendar days of payment date by the
Permit Applicant stating the reason for the requested refund. All fees not refunded within 180 
calendar days will revert to the city with no exceptions.
B.
Up to 80% of the original permit fee may be refunded if no work has commenced, and no
inspections have been conducted.
C.
No Planning, Building, Fire or Engineering plan review fees will be refunded once City review
has commenced.
7.
Cancellation Fee
A.
Cancellation Fee will be $55.00
B.
This fee shall apply to all cancellation requests.
8.
Inspections
A.
All non-legitimate requested inspections are required to pay the re-inspection fee, and the
permit expiration date will not be extended.

1.
Discovery Meetings are requests for the status of development projects. Information requested at
these meetings generally includes overall project completion status, utility service availability including 
water and sewer capacity, request for documents, and other due diligence items related to
development.
2.
Modification of Condition/s refers to a request for a change to one (1) or more approved Conditions.
The process will include decision from the same body.
3.
Amendment per acreage fee will be calculated on the impacted area only.
4.
Concept Site Plan only applies to the Apache Rainbow Employment Overlay District unless otherwise
specified in the Development Code.
5.
Please refer to the City Development Code and/or application guidelines and checklists for additional
criteria, terms and definitions.

Fee Structure: All engineering reviews are fee based as detailed below. 
1. All engineering construction plans and reports required for project completion must be submitted 
initially together as a “Complete Submittal”. The following is an example list of engineering plans and 
reports:

A. All plan review fees are paid per plan sheet submitted. 
B. The initial per sheet fee includes the first, second, and third reviews of plans. 
C. Fourth and subsequent review fees are charged per redlined sheet for each review (redlined 
sheets charged based on per sheet fee). 
D. “Redlined sheet” means a comment has been added to a sheet that requires the Engineer to 
provide corrections. Redlined sheets must be attached to the subsequent resubmittal.

6.
Master Reports
A.
Master Reports are reports that cover more than one parcel, plan set or large geographical
area, and may include Master Drainage Reports, Master Sewer Reports, Master Water
Reports, Independent Design Reports, Independent Design Letters, Traffic Impact Analysis,
Regional Reports, etc.
B.
Master reports are charged a base fee that includes up to 12 hours of review time. If needed,
the review time after 12 hours will be charged on an hourly basis.
7.
CLOMR and/or LOMR
A.
As the Flood Control District of Maricopa County (FCDMC) is currently the Floodplain
Administrator for the City, applicants will route all CLOMR and LOMR submittals through
FCDMC for review and approval. The City, as the Community Floodplain Administrator, will be
provided with a cursory review of the submittal.
B.
CLOMR and LOMR submittals will be charged a base fee that includes up to 2 hours of review
time. If needed, the review time after 2 hours will be charged on an hourly basis.
C.
In the event that the City becomes the Floodplain Administrator, all CLOMR, LOMR, Floodplain 
Use submittals will be completed by the City and/or a consultant. If a consultant is utilized,
the Consultant’s cost will be charged to the applicant on top of the base fee.
8.
Revised Engineering Plans
A.
Revised engineering plans are any engineering plans that require changes after City approval.
B.
Revised engineering plans are charged on a per revised plan sheet submitted.
C.
Chargeable sheets are only those sheets with revisions.
D.
For additional information and requirements regarding plan revisions, reference the
Engineering Plan Revision Guide found on the City’s website.
9.
Revised Engineering Reports
A.
Revised engineering reports are any engineering reports that require changes after City
approval.
B.
Revised engineering reports are charged a base fee that includes up to 2 hours of review time.
Review time after 2 hours will be charged on an hourly basis.
10. Expired Engineering Plans
A.
Approved engineering plans are considered expired if the plans have not been permitted
within 2 years from the City approval date.
B.
Permitted engineering plans are considered expired if the permit has expired and the plans
are beyond the 2-year maximum allowance.
C.
For additional information regarding expired engineering plans and reports, refer to the
Expired Engineering Plan and Report Guide on the City’s website.
11. Included in engineering fees are all associated with clerical costs for processing and maintaining City
records, preparation of various correspondence from the City Engineer’s office, scheduling meetings
regarding review comments, staff time, and all other associated clerical fees associated with
engineering reviews.

CONSTRUCTION 
Fee Structure: All fees charged as detailed below. 
1.
Fees are based on Construction Permit Type (i.e., grading, drainage, sewer, water, street lighting,
concrete, paving landscaping, dry utility, etc.).
2.
Fees are paid at the time of permit issuance.
3.
Item/Quantity fee-based calculation. All plans shall show a quantity breakdown in accordance with
this fee schedule and the sections shown below.
4.
Class Permit Descriptions are listed in the City Code.
5.
Services described in this section are for customary and usual inspection services and inspection
periods of time, additional fees may be required for services beyond what is considered customary
and usual.
Services Included with Construction Permit Fee Payment: 
1.
Pre-Construction Meeting, project coordination, and project closeout.
2.
Construction coordination / project management.
3.
Approval of Maintenance and Performance Bonds and follow-up.
4.
Inspections, Field Directives, and Utility Testing.
5.
Material Submittal reviews.
6.
As-Built Plan Reviews:
A.
Three (3) reviews included in base permit fee.
B.
4th and subsequent reviews charged on a per sheet basis for redlined sheets only (see Section
2: Engineering Review fees).

1.

Per City Code, pavement cuts in streets that have been overlaid or paved within the last four (4) years
require a mill and overlay as required by the City Engineer.
3.
All other pavement cuts are to pay the pavement restoration fees.
Haul Permits 
1.
Offsite hauling permits are required for hauling fill or excavation exceeding 10,000 cubic yards.
2.
All offsite hauling permits may be required to include the following documents as requested by the
City: PM10, SWPPP, sweeping schedule and routing, traffic control, uniformed officers, haul quantities,
and/or truck types showing the number of loads as well as gross truck weights.
3.
Oversized haul permits are required for routes that include city streets. Permits may include time
restrictions depending upon the route.

Fee Structure: All fees charged as detailed below.

Downtown Incentive District
A.
This district is to incentivize the downtown Buckeye area for redevelopment and growth.
B.
The incentive for this area is a 75% reduction on all User Fees as identified in this document
with the exception of items (c) and (d) below.
C.
The incentive does not apply to the following;

The Office of Manufactured Housing Set Fee
ii.
Business License Fees
iii.
All Class Permits, (Section 3)
iv.
MIDS and SLIDS, (Section 3)
v.
Annual Fees as listed under the Class Permits, (Section 3)

Council.

Monroe Incentive Corridor (MIC). A 100% full reduction of fees, as excepted in this Section,
will apply to properties with direct frontage on either Monroe Avenue between Miller Road
(1st Street) and Baseline Road and/or 4th Street between Narramore Avenue and Irwin
Avenue. The Monroe Incentive Corridor does not apply to properties with obsolete zoning
and only applies to land uses allowed within the Downtown Commercial (DC) zoning district.
G.
The pictorial area for the Downtown Incentive Districts A and B, and the Monroe Incentive
Corridor are identified on the following map. Incentive Districts A and B are not inclusive of
each other – the boundaries are unique and distinct without overlapping. The MIC, however,

Public Works Fee Explanation 
HHW drop off fee - $40.00 
This fee represents the average cost per participating resident for disposal of household hazardous waste (not 
including paint). It includes the annual receiving, storage, and disposal costs incurred by the city for the 
household hazardous waste program, per participant.   This cost was obtained by calculating the disposal 
costs per pound of material per participant over the past three years of household hazardous waste 
collection. 
Curbside Collection of Freon Appliances $45.00 
This fee covers the average transport cost of collecting an item from a home in Buckeye and transporting the 
item to our Public Works Yard, including associated staff time and materials. The fee is the same for freon 
appliances or household hazardous waste, as it is only for transport.  This service is offered in response to 
resident requests for staff collection of these materials. 
Freon Appliance Disposal - $25.00 
This fee is based on the average cost to hire a contractor to remove freon from appliances, with a minimum of 
15 refrigerators processed at one time. This represents a collective purchasing power for this service. 
Annual Price increase of 4% 
The solid waste industry has seen consistent year-over-year cost increases, driven by higher over-the-road 
shipping expenses, rising regulatory fees, and increased staffing costs. To sustain responsible and cost-
effective operations, annual rate adjustments will be adopted using the Bureau of Labor Statistics (BLS) 
Consumer Price Index (CPI) subcategory for “Water and Sewer and Trash Collection Services.”

Public Works recommends a 4.0% annually for the next 5 years.

This benchmark closely reflects industry inflation and ensures that city rates remain up-to-date with
actual operating cost pressures, including ongoing increases in labor, transportation, and regulatory
compliance across the solid waste sector.
