RESOLUTION NO. 36-26 
 
A RESOLUTION OF THE MAYOR AND COUNCIL OF THE CITY OF BUCKEYE, 
ARIZONA, APPROVING THE INTERGOVERNMENTAL AGREEMENT (ADOT 
CAR NO.: IGA 26-0011590-I) BETWEEN THE CITY OF BUCKEYE, AN 
ARIZONA MUNICIPAL CORPORATION, AND THE STATE OF ARIZONA 
ACTING BY AND THROUGH ITS DEPARTMENT OF TRANSPORTATION, 
RELATING TO IMPROVEMENTS ALONG STATE ROUTE 85 AND BROADWAY 
ROAD,  STATE ROUTE 85 AND BASELINE ROAD, AND STATE ROUTE 85 
AND SOUTHERN AVENUE; AND AUTHORIZING THE MAYOR TO EXECUTE 
AND DELIVER SAID AGREEMENT. 
WHEREAS, pursuant to A.R.S. §§ 11-951 through 11-954, the City of Buckeye (“City”) 
and the State of Arizona, through its Department of Transportation (“ADOT”) are authorized to 
enter into Intergovernmental Agreement 26-0011590-I (the “IGA”), relating to improvements along 
State Route 85 (“SR 85”) and Broadway Road, SR 85 and Baseline Road, and SR 85 and 
Southern Avenue (collectively, the “Project”); and 
WHEREAS, the City’s project includes the installation of two traffic signals and crossroad 
widening at SR 85 and Southern Avenue (“City’s Project”); and 
WHEREAS, pursuant to the IGA, the City will designate the ADOT as the City’s 
authorized Agent for the Project; and 
WHEREAS, pursuant to the IGA, ADOT will design, advertise, award and administer 
construction of intersection improvements on SR 85 and Broadway and SR 85 and Baseline; and 
WHEREAS, pursuant to the IGA, ADOT will also administer the design and construction 
of the City’s Project, which is estimated to cost a total of $12,500,000; and 
WHEREAS, pursuant to the IGA, ADOT will assume operations and maintenance of the 
City’s Project upon completion; and 
WHEREAS, pursuant to the IGA, ADOT will invoice the City for the project development 
administration (“PDA”) costs, estimated at $100,000, as well as the City’s share of the Project 
design costs, estimated at $900,000; ADOT will provide design plans, specifications, and 
documents and services required for bidding and construction of the City’s Project, and  invoice the 
City for its share of the construction costs, estimated at $11,500,000; and, further, ADOT will either 
reimburse or invoice the City for any difference in estimated costs and actual costs; 
WHEREAS, pursuant to the IGA, the City will pay ADOT within thirty (30) days of receipt 
of invoices for the PDA costs, design costs, and construction costs, as described herein; and 
WHEREAS, pursuant to the IGA, the City will certify necessary rights of way have been 
or will be acquired prior to advertisement for bids, as well as removal of unauthorized 
encroachments. 
 
BE IT RESOLVED by the Mayor and Council of the City of Buckeye, Arizona, as follows: 
 
Section 1. 
The recitals above are hereby incorporated as if fully set forth herein.

Section 2. 
The IGA is hereby approved in the form on file with the City Clerk. 
 
Section 3. 
The Mayor is hereby authorized to execute and deliver the IGA and related 
documents, and the Mayor, City Manager, City Attorney, and City Clerk are hereby authorized and 
directed to take all steps necessary to cause the execution and delivery of the IGA and all 
documents and other necessary or desirable instruments connected with the IGA and to take all 
steps necessary to carry out the purpose and intent of this Resolution.
