SUMMARY
PROJECT DESCRIPTION:
This workshop provides an overview of the proposed Cost Recovery Ordinance and its integration into
the City’s Capital Improvement Program (CIP). The ordinance establishes a consistent, legally compliant
framework to allocate a proportionate share of arterial roadway costs to properties that directly benefit
from those improvements.
The ordinance defines qualifying costs to include design, right-of-way acquisition, engineering,
construction, and related infrastructure improvements. Implementation includes a transparent process
with Council oversight, including a Determination of Necessity, public hearing, and final assessment
adoption upon project completion. Assessments are recorded as a lien and are due upon development-
related triggers such as site plan approval, platting, permitting, or rezoning.
The workshop will also highlight current CIP projects anticipated for cost recovery and outline next steps
toward Council consideration and implementation.
BENEFITS:
The approach is based on the principle that “growth pays for growth,” allowing the City to construct
infrastructure in advance of development while recovering eligible costs at the time development occurs
and aligns with Arizona Revised Statutes.
FUTURE ACTION:
Staff will return to Council on 05/05/2026 for formal consideration and approval of the Cost Recovery
Ordinance, followed by implementation through CIP projects and development processes.
FINANCIAL IMPACT STATEMENT:
The Cost Recovery Ordinance will offset City-funded capital costs by allocating a proportional share of
eligible infrastructure expenses to benefiting properties at the time of development.
