RESOLUTION NO. 31-26 
 
A RESOLUTION OF THE MAYOR AND COUNCIL OF THE CITY OF BUCKEYE, 
ARIZONA, APPROVING AMENDMENT NO. ONE TO INTERGOVERNMENTAL 
AGREEMENT NO. IGA 24-0010903-I BETWEEN THE CITY OF BUCKEYE, AN 
ARIZONA MUNICIPAL CORPORATION, AND THE STATE OF ARIZONA, 
RELATING TO IMPROVEMENTS ALONG MARICOPA COUNTY ROUTE 85 
AND MILLER ROAD; AND AUTHORIZING THE MAYOR TO EXECUTE AND 
DELIVER AMENDMENT NO. ONE TO SAID AGREEMENT. 
WHEREAS, pursuant to A.R.S. §§ 11-951 through 11-954, the City of Buckeye (“City”) 
and State of Arizona acting by and through its Department of Transportation (“ADOT”) are 
authorized to enter into Amendment No. One to Intergovernmental Agreement 24-0010903-I dated 
July 1, 2025, relating to improvements that include fiber optic cable infrastructure along Maricopa 
County Route 85 and Miller Road (the “Project”); and 
WHEREAS, Amendment No. One to the Agreement provides that after completion of 
design, within 30 days of receipt of an invoice from ADOT and prior to bid advertisement, the City 
will pay ADOT any outstanding Project Development Administration costs, the City’s share of the 
Project construction costs, estimated at $110,401, and if applicable, the difference between the 
final and initial construction cost estimates; the City will also pay the difference between the 
estimated construction cost and Project bid amount prior to award; and after Project completion, 
the City will pay any outstanding Project costs, within 30 days of receipt of an invoice. 
 
BE IT RESOLVED by the Mayor and Council of the City of Buckeye, Arizona, as follows: 
 
Section 1. 
The recitals above are hereby incorporated as if fully set forth herein. 
 
Section 2. 
The Amendment No. One to Intergovernmental Agreement No. 24-0010903-
I  (“Amendment No. One”) is hereby approved in the form on file with the City Clerk. 
 
Section 3. 
The City Manager is hereby authorized to execute and deliver the Amendment 
No. One and related documents, and the Mayor, City Manager, City Attorney, and City Clerk are 
hereby authorized and directed to take all steps necessary to cause the execution and delivery of 
Amendment No. One and all documents and other necessary or desirable instruments connected 
with said Amendment No. One and to take all steps necessary to carry out the purpose and intent 
of this Resolution.
