Delivery Order is subject to and governed by the terms and conditions of Job Order Contract No.
2025081 between the City and Contractor, dated September 3, 2024

ARTICLE 1
SCOPE OF WORK
The Contractor shall furnish all labor, materials, and equipment, as more fully set forth in the
Proposal, which is attached hereto as Exhibit A, and the Scope of Work, which is attached hereto
as Exhibit B, and both are incorporated as if fully set forth herein
, to complete the
Monroe Avenue Pavement Marking Improvements project.
ARTICLE 2
SCHEDULE OF COMPLETION OF WORK
The Contractor shall commence work within ten (10) days from issuance by the City of a Notice
to Proceed, and shall complete the Work on or before August 31, 2026. In view of the difficulty
or impossibility of determining the City's damages from delay, should the Contractor fail to
achieve Substantial Completion with the above number of calendar days, as may be extended by
any City-approved Change Orders, the Contractor agrees to pay and will pay to the City, in
addition to all other sums owed pursuant to the Contract, the sum of Five Hundred Seventy
Dollars and Zero Cents ($570.00) for each calendar day of delay as liquidated damages for such
delay and not as a penalty. This sum may be withheld from the balance of the contract price as
it becomes due. Should liquidated damages exceed the contract price due or to become due,
then the Contractor shall pay the City the difference within three (3) days of receipt of written
demand.
ARTICLE 3
COST OF CONSTRUCTION
The total cost to complete the Work under this Delivery Order shall not exceed Eight Hundred
Ninety-Three Thousand Two Hundred Sixty-Six Dollars and Ninety-One Cents ($893,266.91).

ARTICLE 4
INSURANCE & BONDS
In accordance with Article 19 of the Contract, the Contractor agrees to issue the required
insurance ACORD form(s). Payment and Performance Bonds are required for this project, and will
be provided by the Contractor prior to the start of the Work.
ARTICLE 5
ADDITIONAL TERMS
This Delivery Order is subject to the terms and conditions of the Contract and may be canceled
pursuant to the provisions of A.R.S. § 38-511.
By executing this Delivery Order, the Contractor certifies its compliance with A.R.S. § 35-393.01.
To the extent applicable under A.R.S. § 35-394, the Contractor certifies that it does not, and will
not for the duration of the Contract, use the forced labor, any goods or services produced by the
forced labor, or any contractors, subcontractors, or suppliers that use the forced labor or any
China.
In the event of any conflict or discrepancy between the terms of this Delivery Order, the Contract,
Exhibit A, and Exhibit B to this Delivery Order, the documents shall govern in that order.

SCOPE OF WORK
City of Buckeye – Monroe Avenue Pavement Marking Improvements (Miller Rd to
Eason Ave)
Contractor: M.R. Tanner Development & Construction, LLC
1. Project Description
The City of Buckeye (“City”) is undertaking pavement preservation and roadway marking
improvements along Monroe Avenue to extend pavement life, enhance safety, and improve
operational efficiency. The work includes slurry seal application, pavement preparation,
utility adjustments, pavement markings, traffic control, and associated improvements in
accordance with approved construction documents.

3. Plans and Specifications
All work shall be performed in strict accordance with the Dibble 100 Percent Construction
Plans, titled:

The plans include, but are not limited to:

These plans are hereby incorporated by reference into this Exhibit A and shall be
considered part of the Contract Documents.
4. Scope of Work

The Contractor shall furnish all labor, materials, equipment, supervision, and incidentals
necessary to complete the Monroe Avenue Slurry Seal Project, including but not limited to
the following:
4.1 Pavement Preparation
Removal of existing pavement markings and liquid roadway markings by grinding.
Removal of existing stamped asphalt crosswalk treatments and repaving in
accordance with the Dibble 100% Construction Plans.
Cleaning and preparation of pavement surfaces before slurry seal application.
4.2 Slurry Seal Application
Furnish and apply Type II Latex Modified Slurry Seal in accordance with City of
Buckeye and MAG specifications.
4.3 Utility Adjustments
Adjustment of manholes, water valves, and survey monuments to finished grade.
4.4 Traffic Control
Preparation, submission, and implementation of a Traffic Control Plan.
Compliance with MUTCD and City of Buckeye requirements.
Coordination of off-duty law enforcement when required.
5. Pavement Markings and Striping
(Traffic Engineering–Required Language)
Pavement striping, markings, symbols, legends, and raised pavement markers shall be
installed in strict conformance with the Dibble 100 Percent Signing and Marking Plans,
Sheets 15 through 20, unless otherwise directed in writing by the City.
The Contractor shall not deviate from the approved striping layout, spacing, offsets, or
configurations shown on the Dibble plans without prior written authorization from the
City’s Engineering and Traffic Engineering Divisions.
5.1 Striping Layout Review
Prior to installation of permanent pavement markings, the Contractor shall coordinate with
the City for field layout verification and approval. Permanent striping shall not proceed
until City authorization is received.

Field layout verification is for confirmation purposes only and does not authorize
deviations from the approved Dibble 100 Percent plans unless directed in writing by the
City.

6. Future HAWK Signal Coordination – 9th Street & Monroe Avenue
The Contractor acknowledges that the City of Buckeye intends to install a future High-
Intensity Activated Crosswalk (HAWK) signal at the intersection of 9th Street and Monroe
Avenue.
All pavement striping and markings within the project limits shall be installed to match and
accommodate the future HAWK signal configuration as depicted on the Dibble 100 Percent
plans. Striping shall be placed in a manner that supports future signal installation and
minimizes the need for re-striping or modification at the time the HAWK system is
constructed.
No additional compensation shall be provided for striping installed in accordance with this
requirement.
7. Future Infrastructure Coordination Clause
(Signals, Fiber, ITS)
The Contractor shall coordinate construction activities to avoid conflicts with existing or
planned City infrastructure, including but not limited to:
Traffic signal systems
Future HAWK signal equipment
Fiber optic and communications conduit
Intelligent Transportation Systems (ITS) infrastructure
The Contractor shall notify the City immediately upon identification of any potential
conflict and shall not proceed in affected areas without written City direction.

Final acceptance shall not occur until all documentation is submitted and approved.
The Monroe Avenue Slurry Seal Project includes pavement marking improvements
installed in accordance with Dibble’s 100% signing and marking plans. The striping
configuration intentionally accommodates the City’s planned future HAWK pedestrian
signal at 9th Street and Monroe Avenue, ensuring that the roadway markings remain
compatible with future signal installation and minimizing the need for re-striping or
additional costs. Incorporating these requirements at this stage supports long-term
infrastructure planning, improves pedestrian safety, and reduces costs for future capital
projects.
