PROJECT DESCRIPTION: 
1. Esencia LLC, on behalf of property owner, Robert Road Spirit LLC, is requesting annexation of 
one parcel of land totaling approximately 0.89 acres, located at the northeast corner of MC 
85 and SR 85 (see Exhibits A, B, and C). The subject property is developed with a convenience 
store and fuel canopy, and no future phases of development are planned (see Exhibit D, 
Project Narrative). The property intends to connect to City water upon annexation. 
2. The blank petition for the proposed annexation was recorded on January 20, 2026 (Exhibit E). 
Per state law governing annexation, a public hearing providing any affected parties with an 
opportunity to comment on the request must be held at least 20, but no more than 30 days 
following recordation of the blank petition. The initial public hearing for this annexation was 
held on February 17, 2026, conforming to timing requirements established by state statute. 
3. The signed petition for the proposed annexation was recorded on March 18, 2026 (Exhibit F).

5. The applicant is required to provide published notice at least six (6) days in advance of the 
first public hearing and 15 days prior to the end of the waiting period and site postings at 
least six (6) days in advance of the public hearing, as required by the Arizona Revised Statutes 
(ARS §9‐471). Because the first round of applicant notices did not identify the second public 
hearing date, an additional published notice and updated site postings are required 15 days 
in advance of the second public hearing. Due to staff report submittal deadlines, the second

published notice and updated site postings have not been completed as of March 17, 2026, 
but are scheduled for completion in advance of the deadlines. 
6. At least six (6) days in advance of the first public hearing, City staff mails notice to all property 
owners within the annexation boundary (based on information received from the Maricopa 
County Assessor and the Arizona Department of Revenue) and the Maricopa County Board of 
Supervisors. Mailing notice, advertising both hearing dates, was completed in accordance 
with the Development Code and Arizona Revised Statutes (ARS §9‐471) prior to the first 
hearing.

8. No public spoke during the public hearing for this item on February 17, 2026. No public 
comment concerning the annexation request has been received to date.  
ANALYSIS: 
9. The subject property is presently located in the jurisdiction of Maricopa County and zoned 
General Commercial (C-3). Upon adoption of an annexation ordinance, the parcel included 
within this request would be assigned City of Buckeye Regional Commercial (C-3) zoning, the 
district most closely aligned with the property’s current County C-3 zoning designation. No 
future rezoning of the subject property is anticipated. 
10. The property currently features a General Plan land use designation of Employment, which is 
intended for areas of development that have a focus on employment opportunities that 
contribute to the overall local and regional economy. This may include industrial uses, such

as warehouses and manufacturing facilities, as well as business parks. Industrial uses should 
be buffered and/or separated from existing or planned residential uses. Uses within the 
Employment designation should have vehicular access to major arterials. 
11. The existing use, convenience store with gas sales, is consistent with both the Employment 
land use and C-3 zoning. 
12. The annexation proposal meets eligibility for size, dimension, and contiguity requirements 
for annexations as outlined in ARS §9‐471. 
13. Once annexed, the property will be serviced by City of Buckeye Police and Fire and will be 
within the City of Buckeye sewer and water service areas. 
14. The property is located within the Buckeye Union High School and Buckeye Elementary School 
Districts. The proposed annexation has no anticipated impact on either school district.  
15. The following City of Buckeye departments have reviewed and have found no outstanding 
issues with the application:  
a. Development Services, including Planning and Engineering/Survey 
b. Fire 
c. Public Works 
d. Water Resources 
RECOMMENDATION: 
16. The Staff recommends the City Council conduct a public hearing and adopt the Ordinance 
approving the annexation for the following reasons: 
a. Furthers goals of the Buckeye General Plan; 
b. Conformance with the Buckeye Development Code; and 
c. No outstanding issues from reviewing departments.
