RESOLUTION NO. 32-26 A RESOLUTION OF THE MAYOR AND COUNCIL OF THE CITY OF BUCKEYE, ARIZONA, APPROVING AND ADOPTING THE RATE SCHEDULE FOR WATER AND WASTEWATER RATES, RATE COMPONENTS, FEES, OR SERVICE CHARGES SET FORTH IN THE DOCUMENT ENTITLED “SCHEDULE OF FEES;” SETTING AN EFFECTIVE DATE; AND REPEALING CONFLICTING RESOLUTIONS OR PARTS OF RESOLUTIONS. WHEREAS, pursuant to the provisions of ARIZ. REV. STAT. § 9-511.01, the Mayor and City Council of the City of Buckeye may adopt new or increase water or wastewater rates or rate components, fees or service charges where (i) a written report supporting the increased rate or rate component, fee or service charge has been prepared and made available to the public at least thirty (30) days prior to the public hearing described in ARIZ. REV. STAT. § 9-511.01.A.2, (ii) a notice of intention to increase water or wastewater rates or rate components, fees or service charges has been adopted, (iii) a public hearing is held on the proposed increase, which shall be held at least sixty (60) days after adoption of the notice of intention, and (iv) a copy of the notice of intention showing the date, time and place of such hearing has been published one time in a newspaper of general circulation within the boundaries of the municipality not less than twenty (20) days prior to the public hearing date; and WHEREAS, a written report entitled “2025 Water and Wastewater Rate Study Report” has been prepared that aims to right-size rate structures, helps establish a reliable rate cycle, and implements rates to support healthy water and wastewater enterprise funds without creating a burden for customers (the “Report”); and WHEREAS, a copy of the Report has been made available to the public by filing a copy in the office of the City Clerk and posting on the City’s website at least thirty (30) days prior to the public hearing on the proposed increase in water and wastewater rates, rate components, fees, or service charges in accordance with ARIZ. REV. STAT. § 9-511.01.A.2; and WHEREAS, a Notice of Intent to increase water and wastewater rates, rate components, fees, or service charges for the City’s water and wastewater utility services was adopted by motion at the February 3, 2026 Council meeting; and WHEREAS, the Mayor and City Council have determined that the rates and charges are just and reasonable. BE IT RESOLVED, by the Mayor and Council of the City of Buckeye, Arizona, as follows: Section 1. The recitals above are hereby incorporated as if fully set forth herein. Section 2. The City Council hereby approves and adopts the Report. Section 3. The water and wastewater rates, rate components, fees, or service charges set forth in the “Schedule of Fees,” attached as Exhibit A attached hereto and incorporated herein by reference, are hereby adopted. Section 4. The “Schedule of Fees” will go into effect on May 7, 2026. Future rate adjustments will occur on January 1, 2027, January 1, 2028, and January 1, 2029. 1 Section 5. That all resolutions or parts of resolutions in conflict with the provisions of this resolution are hereby repealed. Section 6. That the Mayor, City Manager, City Clerk, and City Attorney are hereby authorized and directed to execute all documents and take all steps necessary to carry out the purpose and intent of this Resolution.
