Council to take action on the In-kind Conduit Agreement between the City of Buckeye, an Arizona
municipal corporation, Accipiter Communications, Inc. dba Zona Wyyerd, a Nevada corporation and
Wyyerd Connect, LLC d/b/a Wyyerd Fiber, a Delaware limited liability company.
SUMMARY
PROJECT DESCRIPTION:
The City of Buckeye and Wyyerd desire to enter into an In-Kind Conduit Agreement ("Agreement") to
facilitate an in-kind exchange of conduit infrastructure within the City’s right-of-way with the goal of
supporting fiber-based network expansion for municipal and commercial use. The Agreement supports
Wyyerd’s plans to install and maintain fiber-to-the-premises networks for homes, businesses, and
government facilities, while also allowing City access to new conduit infrastructure to optimize network
deployment and reduce costs.
This Agreement serves a public purpose by strengthening Buckeye’s broadband infrastructure,
promoting cost-effective network expansion, and ensuring long-term collaboration for future connectivity
projects.
BENEFITS:
The Agreement embodies "Dig Once" best practices by leveraging existing infrastructure for efficient,
non-redundant deployment — promoting competition, faster connectivity, reduced taxpayer burden, and
stronger public-private collaboration. It delivers high return on investment through cost avoidance,
shared resources, and enhanced community infrastructure resilience.
FINANCIAL IMPACT STATEMENT:
The Agreement promotes a public purpose and involves an exchange of benefits: the City grants to
Wyyerd the use of its conduit in exchange for Wyyerd granting the City access to its available micro
conduit. This non-monetary transaction aligns with Dig Once best practices and results in no direct costs
to the City.
