Esencia LLC, on behalf of property owner, Robert Road Spirit LLC, is requesting annexation of one parcel of land totaling approximately 0.89 acres, located at the northeast corner of MC 85 and SR 85 (see Exhibits A, B, and C). The subject property is developed with a convenience store and fuel canopy, and no future phases of development are planned (see Exhibit D, Project Narrative). The property intends to connect to City water upon annexation. 2. The blank petition for the proposed annexation was recorded on January 20, 2026 (Exhibit E). Per state law governing annexation, a public hearing providing any affected parties with an opportunity to comment on the request must be held at least 20, but no more than 30 days following recordation of the blank petition. Holding the public hearing for this annexation on February 17, 2026, conforms to timing requirements established by state statute. The proposed annexation is expected to return to Council for consideration of approval on March 17, 2026. AREA CONTEXT: 3. Table 1: Existing Land Use, General Plan Designation, and Zoning District: PUBLIC PARTICIPATION SUMMARY: 4. The applicant is required to provide notices at least six (6) days in advance of the public hearing and 15 days prior to the end of the waiting period and site postings at least six (6) days in advance of the public hearing, as required by the Arizona Revised Statutes (ARS §9‐ 471). Due to staff report submittal deadlines, required notices and site postings have not been completed as of January 27, 2026, but are scheduled for completion in advance of the deadlines established by state statute. No public comment concerning the annexation request has been received to date. ANALYSIS: 7. The subject property is presently located in the jurisdiction of Maricopa County and zoned General Commercial (C-3). Upon adoption of an annexation ordinance, the parcel included within this request would be assigned City of Buckeye Regional Commercial (C-3) zoning, the district most closely aligned with the property’s current County C-3 zoning designation. No future rezoning of the subject property is anticipated. 8. The property currently features a General Plan land use designation of Employment, which is intended for areas of development that have a focus on employment opportunities that contribute to the overall local and regional economy. This may include industrial uses, such as warehouses and manufacturing facilities, as well as business parks. Industrial uses should be buffered and/or separated from existing or planned residential uses. Uses within the Employment designation should have vehicular access to major arterials. 9. The existing use, convenience store with gas sales, is consistent with both the Employment land use and C-3 zoning. 10. The annexation proposal meets eligibility for size, dimension, and contiguity requirements for annexations as outlined in ARS §9‐471. 11. Once annexed, the property will be serviced by City of Buckeye Police and Fire and will be within the City of Buckeye sewer and water service areas. 12. The property is located within the Buckeye Union High School and Buckeye Elementary School Districts. The proposed annexation has no anticipated impact on either school district. Development Services, including Planning and Engineering/Survey b. Fire c. Public Works d. Water Resources RECOMMENDATION: 14. City Council should conduct the required public hearing related to the annexation. No additional action is required at the February 17, 2026, meeting. 15. The annexation will return to the City Council for consideration of the annexation Ordinance. Staff will recommend the Mayor and City Council approve the annexation Ordinance for the following reasons: a. Furthers goals of the Buckeye General Plan; b. Conformance with the Buckeye Development Code; and c. No outstanding issues from reviewing departments.
