ORDINANCE NO. 03-26 
AN ORDINANCE OF THE MAYOR AND COUNCIL OF THE CITY OF 
BUCKEYE, ARIZONA, APPROVING THE TRANSFER OF CERTAIN 
RIGHTS-OF-WAY AND ROADWAYS, LYING IN SECTION 9, TOWNSHIP 1 
NORTH, RANGE 3 WEST OF THE GILA AND SALT RIVER BASE AND 
MERIDIAN, MARICOPA COUNTY, ARIZONA, WITH A REPUTED STREET 
NAME OF VAN BUREN STREET, LYING WEST OF 239TH AVENUE 
ALIGNMENT. 
WHEREAS, Arizona Revised Statutes (“A.R.S.”) § 9-471(O) provides that a county right- 
of-way or roadway may be transferred to an adjacent city or town by mutual consent of the 
governing bodies of the county and the receiving city, if the county and the city each approve the 
proposed transfer as a published agenda item at regular public meetings of their respective 
governing bodies; and 
WHEREAS, pursuant to A.R.S. § 9-471(O), property so transferred shall be treated as 
though it were newly annexed territory; and 
WHEREAS, the Maricopa County rights-of-way and roadways to be transferred pursuant 
to this Ordinance are situated in Section 9, Township 1 North, Range 3 West of the Gila and Salt 
River Base and Meridian, Maricopa County, Arizona, with a reputed street name of Van Buren 
Street, lying West of 239th Avenue alignment, as legally described and depicted in the attached 
Exhibits A and B, incorporated herein by this express reference; and 
WHEREAS, this Ordinance has been acted upon as a published agenda item at a regular 
public meeting of the Buckeye City Council. 
BE IT ORDAINED by the Mayor and Council of the City of Buckeye, Arizona, as follows: 
Section 1. 
The foregoing recitals are incorporated as if fully set forth herein. 
Section 2. 
Pursuant to the provisions of A.R.S. § 9-471(O), the City hereby approves 
and consents to the transfer by Maricopa County to the City of the County rights-of-way and 
roadways described and depicted in Exhibits A and B. 
Section 3. 
Upon approval by the Maricopa County Board of Supervisors, the rights- 
of-way and roadways described and depicted in Exhibits A and B shall be treated by the City as 
newly annexed territory, and the City will be responsible for maintaining these rights-of-way and 
roadways.

Section 4. 
The Mayor, City Manager, City Attorney, and City Clerk are hereby 
authorized and directed to take all steps and to execute all documents necessary to carry out the 
purpose and intent of this Ordinance, and to ensure that a copy of this Ordinance, together with 
documentation of approval by the Maricopa County Board of Supervisors, is recorded in the 
Office of the Maricopa County Recorder.
