RESOLUTION NO. 03-26 
A RESOLUTION OF THE MAYOR AND CITY COUNCIL OF THE CITY OF 
BUCKEYE, ARIZONA, APPROVING AMENDMENT NO. ONE TO THE 
INTERGOVERNMENTAL AGREEMENT BETWEEN THE STATE OF ARIZONA 
BY AND THROUGH ITS DEPARTMENT OF TRANSPORTATION AND THE CITY 
OF BUCKEYE, TO REMOVE THE SCOPE OF WORK RELATED TO THE 
WARNER STREET BRIDGE.  
WHEREAS, that certain Intergovernmental Agreement between the State of Arizona by 
and through its Department of Transportation (“ADOT”) and the City of Buckeye (“City”), 
known as IGA/JPA 08-148-I, A.G. Contract No. P0012008004871, State Route 85 -- Southern 
to Interstate 10, was executed on March 16, 2009 (the “Original Agreement”); and 
WHEREAS, the Original Agreement addresses the parties’ respective rights and 
responsibilities concerning State Route 85, including the construction and maintenance of the 
Warner Street overpass structure, also known as  Warner Street Bridge; and 
WHEREAS, ADOT and the City would like to amend the Original Agreement to remove 
the scope of work related to the Warner Street Bridge. 
BE IT RESOLVED by the Mayor and Council of the City of Buckeye, Arizona, as follows: 
Section 1. 
The recitals above are hereby incorporated as if fully set forth herein. 
Section 2. 
Amendment No. One to the Original Agreement between ADOT and the 
City (“Amendment No. One to Agreement”) is hereby approved in the form on file with the City 
Clerk. 
Section 3. 
The City Manager is hereby authorized to execute and deliver the 
Amendment No. One to Agreement and related documents, and the Mayor, City Manager, City 
Clerk, and City Attorney are hereby authorized and directed to take all steps necessary to carry 
out the purpose and intent of this Resolution. 
PASSED AND ADOPTED by the Mayor and City Council of the City of Buckeye, Arizona 
on the 6th day of January 2026.
