Council to take action on Resolution No. 09-26 approving Amendment No. 1 to the Wagner Wash
Underground Storage Facility - Permitting and Operation Development Agreement dated February 20,
2024 between the City of Buckeye, an Arizona municipal corporation, Pulte Home Company, LLC, a
Michigan limited liability company, and Del Webb Corporation, a Delaware corporation; and authorizing
the Mayor to execute the Agreement on behalf of the City of Buckeye.
SUMMARY
PROJECT DESCRIPTION:
The City entered into the Development Agreement (Wagner Wash Underground Storage Facility -
Permitting and Operation) dated February 20, 2024 ("Agreement") with Pulte Home Company, LLC
(Pulte) and Del Webb Corporation (Del Webb) for the construction and operation of the Wagner Wash
Underground Storage Facility ("USF"). The Agreement outlined the parties' rights, duties and obligations
regarding the storage and use of stored water and effluent.  The City, Pulte, and Del Webb now seek to
amend the  Agreement for the purposes of adding a new source of water, the Harquahala Valley Water
Project (HVWP) water. This HVWP water is the subject of the Harquahala Water Resources Acquisition
Development Agreement" between the City and Pulte being sought concurrently with this Amendment. 
This Amendment adds the HVWP water to the agreement for the purposes of importing, storing in the
Wagner Wash Underground Storage Facility and serving the water as described by the Agreement.

Responsible management and delivery of City water supplies.
