REQUEST: The applicant is requesting a rezoning from Commercial Center (CC)
to Downtown Commercial (DC).
Introduction:
The purpose of this rezoning is to obtain the necessary rights and entitlements to develop,
maintain, and operate a commercial building at the property located on 120 S & 17 S 4th Street
Buckeye, Arizona, 85326. The site is currently zoned CC (Commercial Center), with the proposed
rezoning change to DC (Downtown Commercial) which allows for a lot of the same uses as the CC
(Commercial Center) zoning but, it reduces user fees by 75% and depending on the use or the area
user fees may be reduced by 100% and will allow you to utilize much more of the site than if you were
to keep the existing zoning. The building that will be made on this land will be on both properties with
the interior containing 4 suites, the type of uses for these suites is yet to be specified, but we
anticipate retail and/or restaurant uses. The property receives its utility services directly from the City
of Buckeye, ensuring access to reliable water and sewer infrastructure. The exterior design of the
building will be coordinated to match the character and aesthetic of surrounding buildings,
contributing to a cohesive streetscape that aligns with the City’s vision.

Maricopa County, Arizona.
Location:
The selected location for this commercial project is Parcel #400-26-040 and #400-26-038, a
0.19-acre (8,124 square foot) empty lot. The site is situated on the northeastern intersection of 4th
Street and E Jackson Avenue and is surrounded by a mix of established commercial buildings and
residential properties all under the Commercial Center zoning, North of the subject site is a (B)
Business Use Occupancy suite, Buckeye Valley News, South of the subject site is a NAPA Auto Parts
shop which falls under the (M) Mercantile occupancy use, East of the subject site is a residential

consistent with surrounding land use patterns. Per the development standards, setback
requirements include a 0-foot front setback, 0-foot side setbacks, 0-foot street side setbacks, and a
rear setback requirement is in DC is 5'; with a 30' building face to building face separation
requirement across the alley. The proposed building area is 6,000 square feet, resulting in a lot
coverage of approximately 73.85%. Per the PAC Meeting, the maximum building height allowed is 60’-
0”, our project aligns as it is 1 story at 21’-4” in height being proposed.
Re-Zoning:
We are requesting a rezoning of this site from its current CC (Commercial Center) designation to DC
(Downtown Commercial). This change better supports the intended scale and form of development
for the property and aligns with the objectives of the Buckeye Downtown Specific Area Plan (DSAP).
The DSAP designates this site as part of the Downtown Core subarea, which emphasizes compact,
pedestrian-oriented, and mixed-use development. The proposed project aligns with this vision by
maximizing site utilization, as the current CC zoning limits site coverage to 50%, which is
insufficient for the proposed 73.85% coverage. The DC zoning district permits increased lot
coverage, supporting the continuous street wall and pedestrian-friendly streetscape envisioned for
Downtown Buckeye.
The project also activates the street frontage through four tenant suites, including potential uses
such as retail shops and a coffee shop. These uses are intended to generate consistent activity and
reinforce the Downtown Core’s role as a local gathering and commercial destination. By providing
leasable spaces for local businesses, the project advances economic development and supports
the community-focused values highlighted in the DSAP.
In terms of scale, the project proposes a one-story building with a height of 21’-4”, which is
consistent with the DSAP’s guideline of no more than 60’-0” and no more than three stories within
the Downtown Core.
In summary, rezoning this site to DC allows the project to fully align with the Downtown Core land
use designation and the DSAP’s goals of creating a vibrant, walkable, and economically diverse
downtown.
Building Design:
The architectural design of our proposed commercial building has been thoughtfully
developed in accordance with all the standards as well as the outlined Sections 5.8.3.B.3 and
5.8.3.D.2 of the City of Buckeye Development Code. While we have ensured that our design
complements the surrounding context by utilizing a consistent architectural theme, including similar
materials, textures, and colors, we have intentionally avoided directly replicating adjacent or nearby
structures. Instead, our approach emphasizes compatible proportions and recurring design
elements to maintain visual harmony within the district. These design strategies ensure that the
building integrates cohesively with the existing streetscape while maintaining a distinct identity. The
building is planned as a single-story structure constructed using Type V-B construction methods. The
occupancy classification will include both “B” (Business) and “M” (Mercantile), as appropriate for the
proposed commercial uses. At least 50% shading will be provided along all building facades adjacent
to or facing streets, outdoor gathering spaces, or parking areas. Shaded sidewalks will constitute a
minimum of 30% of the sidewalks within the site.
Site and Building Data:
The utilities for the proposed commercial project will include water and sewer services from the City
of Buckeye, electric services from APS, and gas from Southwest Gas. The health department with
jurisdiction is the Maricopa County Health Department. The site comprises two parcels—APN 400-
26-040 and 400-26-038—with a combined lot size of 8,124 square feet. The current zoning
designation is CC (Commercial Center). The plan is to combine the two parcels and have one
building over two parcels.
As proposed, the building footprint covers approximately 6,000 square feet, resulting in a site
coverage of 73.85%. However, this exceeds the maximum allowable lot coverage of 50% permitted
under the CC zoning regulations. If the project does not pursue a rezoning request or variance, the
building footprint would need to be reduced to comply with the 50% maximum lot coverage
requirement.
Project Timeline and Phasing:
Following the approval of the site plan, we will begin documentation for the design review process,
including the rezoning process required to align the proposed development with applicable zoning
standards. There will be no phasing for this project. Once all entitlements, rezoning approvals, and
permits are secured in 2025, groundbreaking and construction will begin immediately. The plan is to
complete the entire project in a single phase to minimize disruption to the surrounding community.
Construction of the site improvements and facilities is expected to begin in late 2025, with target
completion and full operational occupancy anticipated by late 2026.
