COOPERATIVE CONTRACT PURCHASE ADDENDUM (CCPA)

CHANGE ORDER # 1 
THIS CHANGE ORDER # 1 (this “Change Order”) is entered into as of ______________, 
between the City of Buckeye, an Arizona municipal corporation (the “City”) and Empire 
Southwest LLC., a Delaware limited liability company  (the “Contractor”). This Change Order 
modifies certain sections of Contract No. 32500054 (the “Contract”), with those sections not 
expressly modified remaining in full effect pursuant to their terms.  
RECITALS: 
The City and Contractor entered into Contract No. 32500054 dated April 21, 2025. Pursuant to 
which Contractor was to provide Heavy Equipment, Parts Accessories, Supplies and Related 
Services with an expiration date of October 2, 2026, and a not-to-exceed amount of $100,000.00. 
CONTRACT CHANGES: 
1.
Contract Price, is amended by increasing the not-to-exceed amount by
$399,279.53 from $100,000.00 to $499,279.53. 
2.
Exhibit B Fee Schedule and Proposal is amended to incorporate the additional
services set forth in Exhibit 1 of this Change Order #1. 
ADDITIONAL PROVISIONS: 
Except as amended herein, all provisions of the Contract remain in full force and effect.
In the event of any conflict or discrepancy between the terms of this Change Order, the 
Contract, and any other contract documents, the documents shall govern in that order.   
This Change Order may be canceled pursuant to the provisions of A.R.S. § 38-511.
