RESOLUTION NO. 99-25 
A RESOLUTION OF THE MAYOR AND COUNCIL OF THE CITY OF BUCKEYE, 
ARIZONA, APPROVING THE DEVELOPMENT AGREEMENT BETWEEN THE 
CITY OF BUCKEYE, AN ARIZONA MUNICIPAL CORPORATION AND SKYLINE 
62, LLC, AN ARIZONA LIMITED LIABILITY COMPANY RELATING TO WATER 
AND SEWER INFRASTRUCTURE; AND AUTHORIZING THE MAYOR TO 
EXECUTE AND DELIVER THE AGREEMENT.  
WHEREAS, the City of Buckeye, an Arizona municipal corporation (“City”) and Skyline 
62, LLC, an Arizona limited liability company (“Owner”) desire to enter into a development 
agreement (“Agreement”) related to the design, construction and installation by Owner of water 
and sewer infrastructure as specified in the Agreement, as part of the development of a project 
known as Coyote Crest, located on approximately 64.45 acres of real property legally described 
and depicted in Exhibit A; and  
WHEREAS, Owner agrees to the terms and conditions of the Agreement; and 
WHEREAS, Buckeye City Code, Chapter 18, Section 18-11, authorizes development 
impact fee credits for eligible Capital Facilities, as defined in the City Code, that are identified in 
the City’s adopted Infrastructure Improvements Plan and Fee Report (“IIP”) as a Capital Facility 
for which a development impact fee was assessed; and  
WHEREAS,  Buckeye City Code, Chapter 20, Section 20-19, authorizes repayment 
agreements for the repayment of improvements by the owners of parcels which specifically 
benefit from such improvements; and  
WHEREAS, the City is authorized to enter into development agreements by 
resolution, pursuant to Arizona Revised Statutes § 9-500.05, and the Agreement is consistent 
with the City's General Plan. 
BE IT RESOLVED by the Mayor and City Council of the City of Buckeye, Arizona, as 
follows:  
Section 1. 
 The recitals above are hereby incorporated as if fully set forth herein. 
Section 2. 
The Agreement relating to, among other things, the design, construction 
and installation of water and sewer infrastructure, and subsequent impact fee credit, or 
repayment thereof by benefitted properties, is hereby approved in substantially the form and 
substance on file with the City Clerk and incorporated by reference. 
Section 3.        The Mayor, City Manager, City Attorney, and City Clerk are hereby 
authorized and directed to execute any and all documents and any other necessary or desirable 
instruments, and to take all steps necessary to carry out the purpose and intent of this 
Resolution.
