ORDINANCE NO. 31-25 
 
AN ORDINANCE OF THE MAYOR AND COUNCIL OF THE CITY OF 
BUCKEYE, 
ARIZONA, 
EXTENDING 
AND 
INCREASING 
THE 
CORPORATE LIMITS OF THE CITY OF BUCKEYE, MARICOPA 
COUNTY, STATE OF ARIZONA, PURSUANT TO THE PROVISIONS OF 
TITLE 9, CHAPTER 4, ARTICLE 7, ARIZONA REVISED STATUTES AND 
AMENDMENTS THERETO, BY ANNEXING APPROXIMATELY 1.86 
ACRES GENERALLY LOCATED AT THE SOUTHEAST CORNER OF 
TUTHILL ROAD AND YUMA ROAD. 
 
 
WHEREAS, the City of Buckeye, Arizona (the “City”) desires to annex certain territory, 
which is contiguous to the City; and 
 
 
WHEREAS, on October 28, 2025 a blank petition was filed with the Maricopa County 
Recorder’s office, setting forth a description and accurate map of all the exterior boundaries of 
the territory proposed to be annexed; and 
 
 
WHEREAS, on November 18, 2025 the City Council held a Public Hearing to discuss 
this annexation proposal; and 
 
 
WHEREAS, at least six (6) days before the public hearing and at least fifteen (15) days 
before the end of the thirty-day waiting period following the filing of the blank petition with the 
Maricopa County Recorder’s office, notice was given by publication at least once in a 
newspaper of general circulation published or circulated in the City and the area to be annexed; 
at least six (6) days before the public hearing, notice was also posted in at least three (3) 
conspicuous public places in the territory proposed to be annexed, sent by first-class mail to the 
clerk of the Maricopa County Board of Supervisors and the County assessor, and sent by first-
class mail with an accurate map of the territory to be annexed to each owner of real and 
personal property that would be subject to taxation by the City in the event of annexation; and  
 
 
WHEREAS, within one (1) year of the last day of the thirty-day waiting period, a petition 
has been presented in writing to the Mayor and Council, signed by the owners of one-half or 
more in value of the real and personal property and more than one-half of the persons owning 
real and personal property that would be subject to taxation by the City in the event of 
annexation, as shown by the last assessment of the property, asking that the property be 
annexed to the City; and 
 
 
WHEREAS, the petition sets forth a true and correct description of all exterior 
boundaries of the territory proposed to be annexed, and no changes to such territory have been 
made after the petition had been signed; and   
 
 
WHEREAS, proper and sufficient certification and proof of the foregoing facts are now 
on file in the office of the City Clerk; together with the original petition referred to herein; and

WHEREAS, the estimated current population of the area to be annexed is zero (0), and 
the estimated future population of the area to be annexed shall be in compliance with the 
Buckeye General Plan land use and density requirements;  
 
 
BE IT ORDAINED, by the Mayor and Council of the City of Buckeye, Arizona, as follows:  
 
 
Section 1. 
The foregoing recitals are incorporated as if fully set forth herein. 
 
 
Section 2. 
The territory legally described on Exhibit A and depicted on Exhibit B, 
incorporated herein by this express reference, is hereby annexed to the City of Buckeye, and 
the City’s corporate limits are extended and increased to include the same. 
 
 
Section 3. 
This annexation shall become final upon the expiration of thirty (30) days 
from the date of adoption of this ordinance. 
 
 
Section 4. 
The City Clerk is hereby directed to record a certified copy of this 
ordinance, together with all exhibits hereto, with the Maricopa County Recorder’s office 
immediately after this annexation becomes final. 
 
 
Section 5. 
The territory annexed by this ordinance shall be initially zoned and shown 
on the City’s official zoning map as Single-Family Residential (R1-43). 
 
 
Section 6. 
The Mayor and City Council hereby elect that the City be the provider of 
regular City Fire Department services to the subject property. 
 
 
Section 7. 
The Mayor, City Manager, City Attorney, and City Clerk are hereby 
authorized and directed to take all steps and to execute all documents necessary to carry out 
the purpose and intent of this ordinance. 
 
 
 
PASSED AND ADOPTED by the Mayor and Council of the City of Buckeye, Arizona,
