ORDINANCE NO. 30-25 
 
AN ORDINANCE OF THE MAYOR AND COUNCIL OF THE CITY OF BUCKEYE, 
ARIZONA, APPROVING THE TRANSFER OF CERTAIN RIGHTS-OF-WAY AND 
ROADWAYS GENERALLY LOCATED ALONG WATKINS STREET FROM THE 
EAST RIGHT OF WAY OF SOUTH MILLER ROAD, EAST APPROXIMATELY 625 
FEET. 
 
 
WHEREAS, Arizona Revised Statutes (“A.R.S.”) § 9-471(O) provides that a county right-
of-way or roadway may be transferred to an adjacent city or town by mutual consent of the 
governing bodies of the county and the receiving city, if the county and the city each approve 
the proposed transfer as a published agenda item at regular public meetings of their respective 
governing bodies; and 
 
 
WHEREAS, pursuant to A.R.S. § 9-471(O), property so transferred shall be treated as 
though it were newly annexed territory; and 
 
 
WHEREAS, the Maricopa County rights-of-way and roadways to be transferred pursuant 
to this ordinance are generally located along Watkins Street from the East Right of Way of 
South Miller Road, east approximately 625 Feet, approximately 0.641 acres, and as legally 
described in Exhibit A and depicted on Exhibit B, attached hereto and incorporated herein by 
this express reference; and 
 
 
WHEREAS, this ordinance has been acted upon as published agenda item at a regular 
public meeting of the Council. 
 
 
BE IT ORDAINED by the Mayor and Council of the City of Buckeye, Arizona, as follows: 
 
 
Section 1. 
The foregoing recitals are incorporated as if fully set forth herein. 
 
 
Section 2. 
Pursuant to the provisions of A.R.S. § 9-471(O), the City hereby approves 
and consents to the transfer by Maricopa County to the city of the county rights-of-way and 
roadways as legally described in Exhibit A and depicted on Exhibit B. 
 
 
Section 3. 
Upon approval by the Maricopa County Board of Supervisors, the rights-
of-way and roadways as legally described in Exhibit A and depicted on Exhibit B shall be treated 
by the city as newly annexed territory, and the city will be responsible for maintaining these 
rights-of-way and roadways. 
 
 
Section 4. 
The Mayor, City Manager, City Attorney, and City Clerk are hereby 
authorized and directed to take all steps and to execute all documents necessary to carry out 
the purpose and intent of this ordinance, and to ensure that a copy of this ordinance, together 
with documentation of approval by the Maricopa County Board of Supervisors, is recorded in the 
Office of the Maricopa County Recorder.
