Council to take action on the City's grant of a utility easement, as set forth in the Utility Easement
Agreement, between the City of Buckeye, an Arizona municipal corporation, and Arizona Public Service
Company ("APS"), an Arizona corporation; and authorize the City Manager to execute and deliver said
Utility Easement Agreement on behalf of the City upon the Maricopa County Superior Court's entry of the
Final Order of Condemnation in City of Buckeye v. Dusty Cool Ltd. Partnership, case number 2025-
023201.
SUMMARY
PROJECT DESCRIPTION:
This Utility Easement Agreement is a requirement for the construction and maintenance of electrical
services related to Capital Improvement Program (CIP) Project No. 105660 Rooks Road Bridge at
Buckeye Irrigation District (BID). This Utility Easement Agreement is necessary for the construction and
operation of the future Rooks Road Bridge.
CIP No. 105660 – Rooks Road Bridge at Buckeye Irrigation District (BID) requires the relocation of
existing 69kV and 12 kV high-tension power lines that currently span the bridge site diagonally. The lines
obstruct the contractor’s ability to drill foundation shafts for the new canal crossing. Relocating these
lines will permanently clear the construction area, enabling bridge installation and ensuring unobstructed
access for future bridge maintenance. This relocation is essential to the project’s successful completion
and long-term functionality. The total easement area to be conveyed to APS is .080 acres+, or 3,490
square feet.
BENEFITS:
Relocating the 69kV and 12 kV power lines removes construction obstacles, prevents delays, and
ensures safe, efficient completion and long-term maintenance of the Rooks Road Bridge.

Delivery of a complete and constructed Rooks Road Bridge.
