Document Summary (i.e. Purpose and General Description) 
This Agreement is for the SRP Irrigation structure “Deactivation.”  This will allow the 
existing above ground irrigation structure, that is in direct conflict with TT0712, 51st Ave. 
and Olney Ave. Intersection, to be removed. This has gone through legal review. 
Document History and Approvals (Division Manager signature required for Budget & HR 
type items) 
The Developer, Homes of Towne, is required to pay for the SRP design, removal of the 
existing structure and installation of the at-grade structure that will replace the system 
permanently.  These “Deactivation” agreements can only be requested by a municipality 
and as it currently exists with the MC Right-of-Way, we are the municipality that must 
make the request. 
Though it requires the County to ensure it’s re-activation “if” it should be required in the 
future, MCDOT would recover any of those expenses on behalf of Maricopa County from 
the party that would be performing any work that would require reinstallation.   It is 
extremely rare these deactivated facilities are ever reactivated.
