A RESOLUTION OF THE MAYOR AND COUNCIL OF THE CITY OF BUCKEYE, 
ARIZONA, AUTHORIZING AMENDMENT NO. 1 TO INTERGOVERNMENTAL 
AGREEMENT C-22-25-014-X-00 BETWEEN THE CITY OF BUCKEYE AND 
MARICOPA 
COUNTY

SEDIMENT; AND AUTHORIZING THE MAYOR AND CITY MANAGER TO 
EXECUTE 
AND 
DELIVER 
SAID 
AMENDMENT 
NO. 
1 
TO 
THE 
INTERGOVERNMENTAL AGREEMENT AND RELATED DOCUMENTS ON 
BEHALF OF THE CITY. 
 
WHEREAS, Arizona Revised Statutes (“A.R.S.”) § 11-952 authorizes two or more public 
agencies to enter into intergovernmental agreements to contract for services if authorized by 
their legislative or governing bodies; and 
 
WHEREAS, the City of Buckeye (the "City") recognizes the need to provide 
improvements to reduce dust and sediment loading onto alleyways, roads, and stormwater 
retention basins by installing asphalt paving, sidewalks, landscaping, lighting, utility 
adjustments, and a storm drain system through the use of Community Development Block Grant 
("CDBG"), funding from the United States Government under Title I of the Housing and 
Community Development Act of 1974, as amended (“HCD Act”); and 
 
WHEREAS, the United States government, through adoption and administration of the 
HCD Act will make CDBG funds available for expenditure during and through the October 1, 
2024, to September 30, 2026; and 
 
WHEREAS, on or near October 1, 2024, the City approved Resolution No. 50-24, 
authorizing and entering into intergovernmental agreement C-22-25-014-X-00 (“IGA”) between 
the Maricopa County (“County”) and the City for the CDBG program dated October 1, 2024 to 
September 30, 2026; and 
 
WHEREAS, the City desires to amend the IGA to extend the program’s timeline 
deliverables, augment funding, and clarify certain provisions of said IGA. 
 
BE IT RESOLVED by the Mayor and Council of the City of Buckeye, Arizona, as follows: 
 
Section 1. 
The recitals above are hereby incorporated as if fully set forth herein. 
 
Section 2. 
Amendment No. 1 to IGA C-22-25-014-X-00 is approved in substantially 
the form and substance on file with the City Clerk, which is incorporated herein by reference. 
 
Section 3.  
The Mayor is hereby authorized to execute and deliver Amendment No. 
1, and the Mayor, the City Clerk, and the City Attorney are hereby authorized and directed to 
execute any necessary or desirable documents or other instruments connected therewith, and 
to take all steps necessary to carry out the purpose and intent of this Resolution.
