RESOLUTION NO. 32-25
RESOLUTION OF THE COUNCIL OF THE CITY OF BUCKEYE, ARIZONA DECLAR-
ING THE INTENTION TO FORM A MAINTENANCE IMPROVEMENT DISTRIC’
DESIGNATING SUCH DISTRICT AS “CITY OF BUCKEYE MAINTENANCE IMPROV!
MENT DISTRICT NO. MID-2024-004"; TO PROVIDE FOR THE MAINTENANCE OF
PARKINGS, PARKWAYS, RETENTION BASINS AND DETENTION BASINS IN THE
PROPOSED AREA OF THE DISTRICT; ORDERING POSTING AND PUBLICATION OF
THIS RESOLUTION; AND DECLARING AN EMERGENCY.
ea IT RESOLVED by the Mayor and Council of the City of Buckeye, Arizona, as
‘ollows:
The streets within the areas within
the City of Buckeye (the “City") known as Tyler Ranch ("Tyler Ranch") and adjacent
to such areas, are not currently within the boundaries of a maintenance improve-
ment district. The legal description and map of the area to be added are set forth
the in Exhibits A and C. By this resolution the Mayor and Council of the City will
declare its intention of the formation the City of Buckeye Maintenance Improve-
ment District No. MID-2024-004 (the “District”) to include the area forth in Exhib-
its. A and C, to operate, maintain, repair and improve Parkings, Parkways, Reten-
tion Basins and Detention Basins within, adjacent to, or that serve the District, as
it now exists or is hereafter dedicated, constructed, modified or enlarged, and
public landscaping, all headwalls, pumps, piping, canals, washes, ditches, storm
drain inlets, scuppers, dry wells, and other adjuncts and appliances related to such
Parkings, Parkways, Retention Basins and Detention Basins. Exhibit B contains the
most recent owner identified in City records. Current ownership records can be
obtained from the Maricopa County Recorder's Office.
In this Resolution, the following terms shall have the
following meanings:
“City” shall mean the City of Buckeye, Arizona.
“Clerk” shall mean the Clerk of the City of Buckeye, Arizona located at 530 East
Monroe Avenue, Buckeye, Arizona 85326.
“Detention Basin” shall mean a flood control structure that captures and diverts
stormwater runoff and typically does not retain a permanent pool of water.
“District” shall mean the City of Buckeye Maintenance Improvement District
No. MID-2024-004, encompassing the property described in and
C attached hereto. For a more particular description of the District reference is
hereby made to a map and list of the relevant County Assessor's parcel numbers
on file with the Clerk.
“Mayor and Council” shall mean the Mayor and Council of the City,
“Landscaping” shall mean trees, plants, grass, ornamental structures, lighting
structures and facilities for watering or otherwise maintaining such landscaping
that are now in place or hereafter constructed or acquired for beautification of
streets within or adjacent to the District.
“Parking” shall mean the landscaped public area lying between a sidewalk and the
adjacent street.
“Parkway” shall mean a street with landscaped sides and/or a landscaped center
median and shall also include ornamentation that enhances the beauty of a street.
“Petition” shall mean the petition, waiver and consent to formation of a municipal
arkway maintenance improvement district by the City on file in the Clerk's office.
Public Property” shall mean any lot or parcel belonging to the United States,
the state of Arizona (the “State"), any county, city, town, school district or any
political subdivision or institution of the State or county that is physically located
within the District, including, without limitation any public street, avenue, alley or
public easement located within the District hereinafter dedicated to public use.
"Retention Basin” shall mean a stormwater control structure that captures and
retains stormwater runoff and typically retains a permanent pool of water.
“Work” shall mean the operation, maintenance, repair and improvement of Park-
ings, Parkways, Retention Basins and Detention Basins within, adjacent to, or
that serve the District, as it now exists or is hereafter dedicated, constructed,
modified or enlarged, and public Jandscaping, street lights, all headwalls, pumps,
piping, canals, washes, ditches, storm drain inlets, scuppers, dry wells, and other
adjuncts and appliances related to such Parkings, Parkways, Retention Basins and
Detention Basins.
i The public
interest and convenience require and it is the intention of the Mayor and Council
to order the Work through formation of the District pursuant to Title 48, Chapter
4, Article 2, Arizona Revised Statutes. The District's sole purpose shall be for the
operation, maintenance, repair and improvement of Parkings, Parkways, Reten-
tion Basins and Detention Basins within, adjacent to, or that serve the District,
as it now exists or is hereafter dedicated, constructed, modified or enlarged, and
public Landscaping, street lights, all headwalls, pumps, piping, canals, washes,
ditches, storm drain inlets, scuppers, dry wells, and other adjuncts and appliances
related to such Parkings, Parkways, Retention Basins and Detention Basins. For
purposes of this Resolution and of all resolutions, ordinances and notices pertain-
ing hereto, the District shall be known as, and is hereby designated, “City of
Buckeye Maintenance Improvement District No. MID-2024-004",
Any Public Property or
property owned by a homeowners’ association that is included within the District
shall be omitted from all assessments or taxes hereafter to be made with respect
to the District. Additionally, any public streets, avenues, alleys, or public ease-
ments hereafter dedicated to public use shall become exempt after such dedica-
tion.
Section 5, Statutory Authority, All proceedings pertaining to the District shall
be done under and as authorized by Title 48, Chapter 4, Article 2, Arizona Revised
Statutes, and all amendments thereto including, without limitation, Section
48-574. All Incidental Expenses shall become the obligation of the District.
R This Resolution of Intention shall be published
in successive issues, two times in a weekly newspaper, published and of general
circulation in the City. There shall also be conspicuously posted along the streets
within the Tyler Ranch and adjacent streets within the proposed District, at not
more than three hundred feet apart, notices of the passage of this Resolution. The
posted notice shall be headed “NOTICE OF PROPOSED IMPROVEMENT" in letters
at least one inch in height.
i i rr’: i The District's sole purpose will be for the opera-
tion, maintenance, repair and improvement of Parkings, Parkways, Retention
Basins and Detention Basins within, adjacent to, or that serve the District, and
public Landscaping, street lights, all headwalls, pumps, piping, canals, washes,
ditches, storm drain inlets, scuppers, dry wells, and other adjuncts and appliances
related to such Parkings, Parkways, Retention Basins and Detention Basins in the
event such maintenance is not performed by the homeowner's association. No
engineer's estimate, plans, or specifications have been filed with the Clerk.
If either the formation of the District occurs
after November 1 of the year preceding the year in which initial assessments
are to be levied, or the resolution ordering the Work is not filed with both the
Arizona Department of Revenue and the Maricopa County Assessor prior to such
November 1, the Mayor and Council hereby request, subject to the November 30
deadline for such request as provided in A.RS. § 42-17257(B), that the Director
of the Arizona Department of Revenue extend the deadline prescribed by A.RS. §
42-17257(A) to December 20, 2025.
i The immediate operation of this Resolution
is necessary for the immediate preservation of the public peace, health or safety
and an emergency is hereby declared to exist, to wit the immediate commence-
ment of the notice procedures is necessary or get the Work completed in an
expeditious manner; and this Resolution shall be in full force and effect from and
after its passage adoption and approval by the Mayor and Council of the City of
Buckeye.
PASSED AND ADOPTED by the Mayor and City Council of the City of Buckeye,
