SLID-2015-001” TO PROVIDE FOR THE PURCHASE OF ENERGY FOR LIGHTING OF PUBLIC STREETS AND PARKS WITHIN AND ADJA- CENT TO STREETS IN THE PROPOSED ANNEXATION TO THE DISTRICT; ORDER- ING POSTING AND PUBLICATION OF THIS RESOLUTION; AND DECLARING AN EMERGENCY. Ee IT RESOLVED by the Mayor and Council of the City of Buckeye, Arizona, as ‘ollows: Section 1, Findings and Declaration of Intent, The streets within the areas within the City of Buckeye (the "City") known as Tyler Ranch (“Tyler Ranch") is served by street lights and the streets within and adjacent to such areas, are not currently within, the boundaries of a street light improvement district. The legal descrip- tion and map of the area to be added are set forth in the Exhibits A and C. By this resolution the Mayor and Council of the City will declare its intention to annex the area forth in Exhibits A and C to the City of Buckeye Street Lighting Improvement District No. SLID-2015-001 (the “District”) to serve Tyler Ranch. Exhibit B contains the most recent owner identified in City records. Current ownership records can be obtained from the Maricopa County Recorder's Office. The sole purpose of the District is to purchase (and not generate) energy for street or public park lighting within the District and adjacent streets. By this resolution the Mayor and Council of the City will declare its intention to annex the area described in i and C to the City of Buckeye Street Lighting Improvement District No. SLID-2015- 001 to purchase (and not generate) energy for street or public park lighting within the District and adjacent streets. In this resolution, the following terms shall have the following meanings: “Clerk” shall mean the Clerk of the City located at 530 E. Monroe Street, Buckeye, Arizona 85326. “Director” shall mean the Director of the Arizona Department of Revenue. “District” or “Improvement District” shall mean City of Buckeye Street Lighting Improvement District No. SLID-2015-001. For a more particular description of the District reference is hereby made to a map and list of the relevant County Asses- sor’s parcel numbers on file with the Clerk. “Governing Body” shall mean the Mayor and Council of the City. “Incidental Expenses” shall mean the costs of posting, publication, recording, mailing and legal fees with respect to the formation and expansion of the District and the annual levy of taxes. "Street Lighting System” shall mean all publicly owned street and traffic lights and all wire, apparatus and other facilities now in place or hereafter constructed or acquired for the lighting of public streets and parks within the District and on streets adjacent to the District. “City” shall mean the City of Buckeye, Arizona. “Work” shall mean the purchasing (not generation) of energy for the operation of the Street Lighting System The public interest and canvenience require and it is the intention of the Govern- ing Body to order the Work through annexation of the area described in and the land described in Exhibits A. B and C of the District pursuant to A.R.S. Title 48, Chapter 4, Article 2. The District's sale purpose shall be the purchase, not generation, of energy to operate the Street Lighting System as it now exists or is ereafter modified or enlarged. For purposes of this resolution and of all resolu- tions, ordinances and notices pertaining hereto, the Improvement District shall be known as and is hereby designated the “City of Buckeye Street Lighting Improve- ment District No. SLID-2015-001." i issi H Any Public Property or Property ‘owned by a homeowners’ association that is included within the District shall be omitted from all assessments or taxes hereafter to be made with respect to the District. Additionally, any public streets, avenues, alleys, or public ease- ments hereafter dedicated to public use shall become exempt after such dedica- tion. Section 5. Statutory Authority: Payment of Incidental Expenses. All proceed- ings pertaining to the District shall be done under and as authorized by Title 48, Chapter 4, Article 2, Arizona Revised Statutes, and all amendments thereto including, without limitation, Sections 48-616 and 617. All Incidental Expenses shall become the obligation of the District. H This Resolution of Intention shall be published in successive issues, two times in a weekly newspaper, published and of general circulation in the City. There shall also be conspicuously posted along the streets within the Tyler Ranch and adjacent streets within the proposed District, at not more than three hundred feet apart, notices of the passage of this Resolution. The posted notice shall be headed “NOTICE OF PROPOSED IMPROVEMENT" in letters at least one inch in height. Section ZEngincer's Estimate. Flans and Specifications. Because the Street Lighting System now exists, the District’s sole purpose will be to purchase, and not generate, energy to operate the Street Lighting System. Except as stated in Section 8 below, no plans, specification or engineer's estimate have been filed with the City Clerk, be Paid, The type of lighting shall be the type now in place within the District, which consists of Arizona Public Service Co. Standard Code 1940.38, and/or 8030. S2AF*D, and/or 8050.SS8AH4°D consisting of poles, mast arms and luminaires in accordance with City of Buckeye Engineering Standard Chapter 7: Street Light- ing, Section 1; Street Lighting as updated from time to time, and to be operated nightly from dusk to dawn, or such other lighting facilities as may be acquired in the future by the City or some other entity for use within or adjacent to, the District. The Mayor and Council have considered the rate to be paid for purchasing energy for the proposed district to be determined by the most current APS Rate Schedule £-59, plus applicable taxes and service charges. This rate is established by the Arizona Corporation Commission and may be increased in the future, The estimated annual cost of the energy to light a street light to be paid with District Money is: for 100W streetlights the annual cost per streetlight is approximately $31.74; for 150W streetlights the annual cost per streetlight is approximately $53.43; and for 250W streetlights the annual cost per strestlight is approximately $76.67. The estimate of the District’s costs and expenses of purchasing energy for the operation of the Street Lighting System is subject to change or connec- tion when the actual costs of operation are known and is subject to change due to inflation, new construction or acquisition of additional portions of the Street Lighting System. i Because the expansion of the District may occur after November 1 2025, of the year preceding the year in which assessments or taxes will be initially levied the Mayor and Council of the City of Buckeye, Arizona hereby request that the Director of the Arizona Department of Revenue extend the deadline prescribed by Subsection A of Section 42-17257, Arizona Revised Statutes to the next February 15 to allow the City to file the required information. To implement this request a certified copy of this resolution shall be delivered to the Director of the Department of Revenue and the Maricopa County Assessor, i The immediate operation of this Reso- lution is necessary for the immediate preservation of the public peace, health or safety and an emergency is hereby declared to exist, to wit the immediate commencement of the notice procedures is necessary or get the Work completed in an expeditious manner; and this Resolution shall be in full force and effect from and pitied its passage adoption and approval by the Mayor and Council of the City of Buckeye.
