Council to take action on Resolution No. 49-25 approving the abandonment of that certain easement
described within the instrument entitled Access Easement Agreement, recorded at Instrument Number
2009-0286730, Maricopa County Recorder (MCR), situated generally in the north one half of Lot 17,
Valencia Heights, as recorded in Book 21, Page 31, MCR.
SUMMARY
PROJECT DESCRIPTION:
The City of Buckeye ("City") is the applicant for this abandonment request. The purpose of this request is
to abandon a private access easement within the City jurisdiction area south of Encanto Blvd, north of
the City's Park-and-Ride location. This access easement does not serve property other than that which is
privately owned, is not needed for the development of property in accordance with the currently
approved use of the property, and serves no public purpose.
BENEFITS:
As this private access easement serves no public purpose and falls within vacant, privately owned
property, the abandonment removes it from the City of Buckeye's responsibility and honors the intent of
the parties to the original easement.
