ORDINANCE NO. 20-25 
 
AN ORDINANCE OF THE MAYOR AND COUNCIL OF THE CITY 
OF BUCKEYE, ARIZONA, APPROVING THE TRANSFER OF 
CERTAIN RIGHTS-OF-WAY AND ROADWAYS GENERALLY 
LOCATED ALONG SOUTHERN AVENUE FROM STATE ROUTE 
HIGHWAY 85 APPROXIMATELY 2,630 FEET WEST AND 
BASELINE ROAD FROM SR HIGHWAY 85 APPROXIMATELY 
3,130 FEET. 
 
 
WHEREAS, Arizona Revised Statutes (“A.R.S.”) § 9-471(O) provides that a county 
right- of-way or roadway may be transferred to an adjacent city or town by mutual consent of 
the governing bodies of the county and the receiving city, if the county and the city each 
approve the proposed transfer as a published agenda item at regular public meetings of their 
respective governing bodies; and 
 
 
WHEREAS, pursuant to A.R.S. § 9-471(O), property so transferred shall be treated as 
though it were newly annexed territory; and 
 
 
WHEREAS, the Maricopa County rights-of-way and roadways to be transferred 
pursuant to this ordinance are generally located along Southern Avenue from State Route 
Highway 85 approximately 2,630 feet west and Baseline Road from State Route Highway 85 
approximately 3,130 feet, as legally described in Exhibit A and depicted on Exhibit B, attached 
hereto and incorporated herein by this express reference; and 
 
 
WHEREAS, this ordinance has been acted upon as a published agenda item at a 
regular public meeting of the Council. 
 
 
BE IT ORDAINED, by the Mayor and Council of the City of Buckeye, Arizona, as 
follows: 
 
 
Section 1. 
The foregoing recitals are incorporated as if fully set forth herein. 
 
 
Section 2. 
Pursuant to the provisions of A.R.S. § 9-471(O), the City hereby 
approves and consents to the transfer by Maricopa County to the city of the county rights-of-
way and roadways as legally described in Exhibit A and depicted on Exhibit B. 
 
 
Section 3. 
Upon approval by the Maricopa County Board of Supervisors, the rights-
of-way and roadways as legal described in Exhibit A and depicted on Exhibit B shall be treated 
by the city as newly annexed territory, and the city will be responsible for maintaining these 
rights-of-way and roadways. 
 
 
Section 4. 
The Mayor, City Manager, City Attorney, and City Clerk are hereby 
authorized and directed to take all steps and to execute all documents necessary to carry out

the purpose and intent of this ordinance, and to ensure that a copy of this ordinance, together 
with documentation of approval by the Maricopa County Board of Supervisors, is recorded in 
the Office of the Maricopa County Recorder.
